66 AN ACT
77 relating to the application of the open meetings and public
88 information laws to the Texas Mutual Insurance Company.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2054.003(c), Insurance Code, is amended
1111 to read as follows:
1212 (c) The company is not a state agency or executive agency or
1313 a governmental entity for any purpose and is subject to a law
1414 applicable to such an agency or entity only as provided by this
1515 chapter.
1616 SECTION 2. Section 2054.007, Insurance Code, is amended to
1717 read as follows:
1818 Sec. 2054.007. APPLICABILITY OF OPEN MEETINGS LAW AND OPEN
1919 RECORDS LAW; EXCEPTIONS [NOT APPLICABLE]. (a) Except as provided by
2020 Subsections (b) and (c) [Notwithstanding any other state law],
2121 Chapters 551 and 552, Government Code, apply [do not apply] to the
2222 company.
2323 (b) The board may hold closed meetings to consider:
2424 (1) information relating to claims, rates, or the
2525 company's underwriting guidelines; or
2626 (2) other information that would give advantage to a
2727 competitor or bidder.
2828 (c) The board may refuse to disclose:
2929 (1) information relating to claims, rates, or the
3030 company's underwriting guidelines; or
3131 (2) other information that would give advantage to a
3232 competitor or bidder.
3333 SECTION 3. Section 2054.008(d), Insurance Code, is amended
3434 to read as follows:
3535 (d) Except as provided by Subsection (e), a company
3636 investigation file:
3737 (1) is confidential and not subject to disclosure
3838 under Chapter 552, Government Code; and
3939 (2) may be disclosed only:
4040 (A) in a criminal proceeding;
4141 (B) in a hearing conducted by the division of
4242 workers' compensation of the department;
4343 (C) on a judicial determination of good cause; or
4444 (D) to a governmental agency, political
4545 subdivision, or regulatory body if the disclosure is necessary or
4646 proper for the enforcement of a law of this state, another state, or
4747 the United States.
4848 SECTION 4. Section 2054.256(b), Insurance Code, is amended
4949 to read as follows:
5050 (b) Except as otherwise required or permitted by Chapter
5151 552, Government Code, the [The] company may not provide to an
5252 insurance agent information obtained from another insurance agent.
5353 SECTION 5. The following sections of the Government Code
5454 are repealed:
5555 (1) Section 552.0225(c); and
5656 (2) Section 552.143(f).
5757 SECTION 6. (a) The change in law made to Section 2054.007,
5858 Insurance Code, by this Act applies only to a meeting of the Texas
5959 Mutual Insurance Company for which notice is given under Chapter
6060 551, Government Code, on or after the effective date of this Act.
6161 (b) The change in law made by this Act applies only to a
6262 request for information that is received by the Texas Mutual
6363 Insurance Company or an officer for public information on or after
6464 the effective date of this Act. A request for information that was
6565 received before the effective date of this Act is governed by the
6666 law as it existed on the date the request was received, and the
6767 former law is continued in effect for that purpose.
6868 (c) The change in law made by this Act applies to
6969 information maintained in investigation files of the Texas Mutual
7070 Insurance Company without regard to the date the information is
7171 collected, compiled, or developed or otherwise becomes part of the
7272 investigation file.
7373 SECTION 7. This Act takes effect September 1, 2015.
