6	6	AN ACT
7	7	relating to the application of the open meetings and public
8	8	information laws to the Texas Mutual Insurance Company.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 2054.003(c), Insurance Code, is amended
11	11	to read as follows:
12	12	(c) The company is not a state agency or executive agency or
13	13	a governmental entity for any purpose and is subject to a law
14	14	applicable to such an agency or entity only as provided by this
15	15	chapter.
16	16	SECTION 2. Section 2054.007, Insurance Code, is amended to
17	17	read as follows:
18	18	Sec. 2054.007. APPLICABILITY OF OPEN MEETINGS LAW AND OPEN
19	19	RECORDS LAW; EXCEPTIONS [NOT APPLICABLE]. (a) Except as provided by
20	20	Subsections (b) and (c) [Notwithstanding any other state law],
21	21	Chapters 551 and 552, Government Code, apply [do not apply] to the
22	22	company.
23	23	(b) The board may hold closed meetings to consider:
24	24	(1) information relating to claims, rates, or the
25	25	company's underwriting guidelines; or
26	26	(2) other information that would give advantage to a
27	27	competitor or bidder.
28	28	(c) The board may refuse to disclose:
29	29	(1) information relating to claims, rates, or the
30	30	company's underwriting guidelines; or
31	31	(2) other information that would give advantage to a
32	32	competitor or bidder.
33	33	SECTION 3. Section 2054.008(d), Insurance Code, is amended
34	34	to read as follows:
35	35	(d) Except as provided by Subsection (e), a company
36	36	investigation file:
37	37	(1) is confidential and not subject to disclosure
38	38	under Chapter 552, Government Code; and
39	39	(2) may be disclosed only:
40	40	(A) in a criminal proceeding;
41	41	(B) in a hearing conducted by the division of
42	42	workers' compensation of the department;
43	43	(C) on a judicial determination of good cause; or
44	44	(D) to a governmental agency, political
45	45	subdivision, or regulatory body if the disclosure is necessary or
46	46	proper for the enforcement of a law of this state, another state, or
47	47	the United States.
48	48	SECTION 4. Section 2054.256(b), Insurance Code, is amended
49	49	to read as follows:
50	50	(b) Except as otherwise required or permitted by Chapter
51	51	552, Government Code, the [The] company may not provide to an
52	52	insurance agent information obtained from another insurance agent.
53	53	SECTION 5. The following sections of the Government Code
54	54	are repealed:
55	55	(1) Section 552.0225(c); and
56	56	(2) Section 552.143(f).
57	57	SECTION 6. (a) The change in law made to Section 2054.007,
58	58	Insurance Code, by this Act applies only to a meeting of the Texas
59	59	Mutual Insurance Company for which notice is given under Chapter
60	60	551, Government Code, on or after the effective date of this Act.
61	61	(b) The change in law made by this Act applies only to a
62	62	request for information that is received by the Texas Mutual
63	63	Insurance Company or an officer for public information on or after
64	64	the effective date of this Act. A request for information that was
65	65	received before the effective date of this Act is governed by the
66	66	law as it existed on the date the request was received, and the
67	67	former law is continued in effect for that purpose.
68	68	(c) The change in law made by this Act applies to
69	69	information maintained in investigation files of the Texas Mutual
70	70	Insurance Company without regard to the date the information is
71	71	collected, compiled, or developed or otherwise becomes part of the
72	72	investigation file.
73	73	SECTION 7. This Act takes effect September 1, 2015.
