| 7 | 7 | | relating to the allocation of Texas Emissions Reduction Plan funds. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 9 | 9 | | SECTION 1. Section 386.252(a), Health and Safety Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (a) Money in the fund may be used only to implement and |
|---|
| 12 | 12 | | administer programs established under the plan. Money |
|---|
| 13 | 13 | | appropriated to the commission to be used for the programs under |
|---|
| 14 | 14 | | Section 386.051(b) shall be allocated as follows: |
|---|
| 15 | 15 | | (1) not more than four percent may be used for the |
|---|
| 16 | 16 | | clean school bus program under Chapter 390; |
|---|
| 17 | 17 | | (2) not more than three percent may be used for the new |
|---|
| 18 | 18 | | technology implementation grant program under Chapter 391, from |
|---|
| 19 | 19 | | which at least $1 million will be set aside for electricity storage |
|---|
| 20 | 20 | | projects related to renewable energy; |
|---|
| 21 | 21 | | (3) five percent shall be used for the clean fleet |
|---|
| 22 | 22 | | program under Chapter 392; |
|---|
| 23 | 23 | | (4) not more than $1 [$3] million may be used by the |
|---|
| 24 | 24 | | commission to fund a regional air monitoring program in commission |
|---|
| 25 | 25 | | Regions 3 and 4 to be implemented under the commission's oversight, |
|---|
| 26 | 26 | | including direction regarding the type, number, location, and |
|---|
| 27 | 27 | | operation of, and data validation practices for, monitors funded by |
|---|
| 28 | 28 | | the program through a regional nonprofit entity located in North |
|---|
| 29 | 29 | | Texas having representation from counties, municipalities, higher |
|---|
| 30 | 30 | | education institutions, and private sector interests across the |
|---|
| 31 | 31 | | area; |
|---|
| 32 | 32 | | (5) not less than 16 percent shall be used for the |
|---|
| 33 | 33 | | Texas natural gas vehicle grant program under Chapter 394; |
|---|
| 34 | 34 | | (6) not more than five percent may be used to provide |
|---|
| 35 | 35 | | grants for natural gas fueling stations under the clean |
|---|
| 36 | 36 | | transportation triangle program under Section 394.010; |
|---|
| 37 | 37 | | (7) not more than five percent may be used for the |
|---|
| 38 | 38 | | Texas alternative fueling facilities program under Chapter 393; |
|---|
| 39 | 39 | | (8) a specified amount may be used each year to support |
|---|
| 40 | 40 | | research related to air quality as provided by Chapter 387; |
|---|
| 41 | 41 | | (9) not more than $200,000 may be used for a health |
|---|
| 42 | 42 | | effects study; |
|---|
| 43 | 43 | | (10) $200,000 [$500,000] is to be deposited in the |
|---|
| 44 | 44 | | state treasury to the credit of the clean air account created under |
|---|
| 45 | 45 | | Section 382.0622 to supplement funding for air quality planning |
|---|
| 46 | 46 | | activities in affected counties; |
|---|
| 47 | 47 | | (11) at least $4 million and up to four percent to a |
|---|
| 48 | 48 | | maximum of $7 million, whichever is greater, is allocated to the |
|---|
| 49 | 49 | | commission for administrative costs; |
|---|
| 50 | 50 | | (12) at least two percent and up to five percent of the |
|---|
| 51 | 51 | | fund is to be used by the commission for the drayage truck incentive |
|---|
| 52 | 52 | | program established under Subchapter D-1; |
|---|
| 53 | 53 | | (13) not more than five percent may be used for the |
|---|
| 54 | 54 | | light-duty motor vehicle purchase or lease incentive program |
|---|
| 55 | 55 | | established under Subchapter D; |
|---|
| 56 | 56 | | (14) not more than $216,000 is allocated to the |
|---|
| 57 | 57 | | commission to contract with the Energy Systems Laboratory at the |
|---|
| 58 | 58 | | Texas Engineering Experiment Station annually for the development |
|---|
| 59 | 59 | | and annual computation of creditable statewide emissions |
|---|
| 60 | 60 | | reductions obtained through wind and other renewable energy |
|---|
| 61 | 61 | | resources for the state implementation plan; |
|---|
| 62 | 62 | | (15) 1.5 percent of the money in the fund is allocated |
|---|
| 63 | 63 | | for administrative costs incurred by the laboratory; and |
|---|
| 64 | 64 | | (16) at least 50 percent, and any remaining balance as |
|---|
| 65 | 65 | | determined by the commission, [the balance] is to be used by the |
|---|
| 66 | 66 | | commission for the diesel emissions reduction incentive program |
|---|
| 67 | 67 | | under Subchapter C [as determined by the commission]. |
|---|
| 68 | 68 | | SECTION 2. This Act takes effect September 1, 2015. |
