66 AN ACT
77 relating to the allocation of Texas Emissions Reduction Plan funds.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 386.252(a), Health and Safety Code, is
1010 amended to read as follows:
1111 (a) Money in the fund may be used only to implement and
1212 administer programs established under the plan. Money
1313 appropriated to the commission to be used for the programs under
1414 Section 386.051(b) shall be allocated as follows:
1515 (1) not more than four percent may be used for the
1616 clean school bus program under Chapter 390;
1717 (2) not more than three percent may be used for the new
1818 technology implementation grant program under Chapter 391, from
1919 which at least $1 million will be set aside for electricity storage
2020 projects related to renewable energy;
2121 (3) five percent shall be used for the clean fleet
2222 program under Chapter 392;
2323 (4) not more than $1 [$3] million may be used by the
2424 commission to fund a regional air monitoring program in commission
2525 Regions 3 and 4 to be implemented under the commission's oversight,
2626 including direction regarding the type, number, location, and
2727 operation of, and data validation practices for, monitors funded by
2828 the program through a regional nonprofit entity located in North
2929 Texas having representation from counties, municipalities, higher
3030 education institutions, and private sector interests across the
3131 area;
3232 (5) not less than 16 percent shall be used for the
3333 Texas natural gas vehicle grant program under Chapter 394;
3434 (6) not more than five percent may be used to provide
3535 grants for natural gas fueling stations under the clean
3636 transportation triangle program under Section 394.010;
3737 (7) not more than five percent may be used for the
3838 Texas alternative fueling facilities program under Chapter 393;
3939 (8) a specified amount may be used each year to support
4040 research related to air quality as provided by Chapter 387;
4141 (9) not more than $200,000 may be used for a health
4242 effects study;
4343 (10) $200,000 [$500,000] is to be deposited in the
4444 state treasury to the credit of the clean air account created under
4545 Section 382.0622 to supplement funding for air quality planning
4646 activities in affected counties;
4747 (11) at least $4 million and up to four percent to a
4848 maximum of $7 million, whichever is greater, is allocated to the
4949 commission for administrative costs;
5050 (12) at least two percent and up to five percent of the
5151 fund is to be used by the commission for the drayage truck incentive
5252 program established under Subchapter D-1;
5353 (13) not more than five percent may be used for the
5454 light-duty motor vehicle purchase or lease incentive program
5555 established under Subchapter D;
5656 (14) not more than $216,000 is allocated to the
5757 commission to contract with the Energy Systems Laboratory at the
5858 Texas Engineering Experiment Station annually for the development
5959 and annual computation of creditable statewide emissions
6060 reductions obtained through wind and other renewable energy
6161 resources for the state implementation plan;
6262 (15) 1.5 percent of the money in the fund is allocated
6363 for administrative costs incurred by the laboratory; and
6464 (16) at least 50 percent, and any remaining balance as
6565 determined by the commission, [the balance] is to be used by the
6666 commission for the diesel emissions reduction incentive program
6767 under Subchapter C [as determined by the commission].
6868 SECTION 2. This Act takes effect September 1, 2015.
