| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 280.003, Transportation Code, is amended |
|---|
| 13 | 13 | | by amending Subsection (b) and adding Subsection (d) to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | (b) The commissioners court of a [the] county may by order |
|---|
| 16 | 16 | | provide for the establishment of street lights along a county road |
|---|
| 17 | 17 | | located in a subdivision. The order may provide for: |
|---|
| 18 | 18 | | (1) the installation, operation, and maintenance of |
|---|
| 19 | 19 | | the street lights by: |
|---|
| 20 | 20 | | (A) the county; or |
|---|
| 21 | 21 | | (B) another public or private entity with which |
|---|
| 22 | 22 | | the county may contract; |
|---|
| 23 | 23 | | (2) the imposition of a fee on landowners in the |
|---|
| 24 | 24 | | subdivision who benefit from the street lights; |
|---|
| 25 | 25 | | (3) the collection of a fee imposed under this |
|---|
| 26 | 26 | | subsection by[: |
|---|
| 27 | 27 | | [(A)] the county tax assessor-collector[; or |
|---|
| 28 | 28 | | [(B) another public or private entity with which |
|---|
| 29 | 29 | | the county may contract]; and |
|---|
| 30 | 30 | | (4) any other matter the commissioners court finds |
|---|
| 31 | 31 | | necessary to the installation, operation, or maintenance of the |
|---|
| 32 | 32 | | street lights. |
|---|
| 33 | 33 | | (d) The county tax assessor-collector of a county in which a |
|---|
| 34 | 34 | | fee is imposed under this section shall include the fee in the tax |
|---|
| 35 | 35 | | bill prepared under Section 31.01, Tax Code, for each landowner |
|---|
| 36 | 36 | | whose real property is benefited by the street lights for which the |
|---|
| 37 | 37 | | fee is imposed. The tax bill must separately state the amount of |
|---|
| 38 | 38 | | the fee imposed under this section. The county tax |
|---|
| 39 | 39 | | assessor-collector shall collect the fee for the county in the same |
|---|
| 40 | 40 | | manner that the county tax assessor-collector collects ad valorem |
|---|
| 41 | 41 | | taxes for the county. |
|---|
| 42 | 42 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 43 | 43 | | a fee imposed by a county under Section 280.003, Transportation |
|---|
| 44 | 44 | | Code, as amended by this Act, on or after the effective date of this |
|---|
| 45 | 45 | | Act. |
|---|
| 46 | 46 | | SECTION 3. This Act takes effect September 1, 2015. |
