99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to peace officers commissioned by the State Board of
1212 Veterinary Medical Examiners.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Article 2.12, Code of Criminal Procedure, is
1515 amended to read as follows:
1616 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
1717 officers:
1818 (1) sheriffs, their deputies, and those reserve
1919 deputies who hold a permanent peace officer license issued under
2020 Chapter 1701, Occupations Code;
2121 (2) constables, deputy constables, and those reserve
2222 deputy constables who hold a permanent peace officer license issued
2323 under Chapter 1701, Occupations Code;
2424 (3) marshals or police officers of an incorporated
2525 city, town, or village, and those reserve municipal police officers
2626 who hold a permanent peace officer license issued under Chapter
2727 1701, Occupations Code;
2828 (4) rangers and officers commissioned by the Public
2929 Safety Commission and the Director of the Department of Public
3030 Safety;
3131 (5) investigators of the district attorneys', criminal
3232 district attorneys', and county attorneys' offices;
3333 (6) law enforcement agents of the Texas Alcoholic
3434 Beverage Commission;
3535 (7) each member of an arson investigating unit
3636 commissioned by a city, a county, or the state;
3737 (8) officers commissioned under Section 37.081,
3838 Education Code, or Subchapter E, Chapter 51, Education Code;
3939 (9) officers commissioned by the General Services
4040 Commission;
4141 (10) law enforcement officers commissioned by the
4242 Parks and Wildlife Commission;
4343 (11) airport police officers commissioned by a city
4444 with a population of more than 1.18 million located primarily in a
4545 county with a population of 2 million or more that operates an
4646 airport that serves commercial air carriers;
4747 (12) airport security personnel commissioned as peace
4848 officers by the governing body of any political subdivision of this
4949 state, other than a city described by Subdivision (11), that
5050 operates an airport that serves commercial air carriers;
5151 (13) municipal park and recreational patrolmen and
5252 security officers;
5353 (14) security officers and investigators commissioned
5454 as peace officers by the comptroller;
5555 (15) officers commissioned by a water control and
5656 improvement district under Section 49.216, Water Code;
5757 (16) officers commissioned by a board of trustees
5858 under Chapter 54, Transportation Code;
5959 (17) investigators commissioned by the Texas Medical
6060 Board;
6161 (18) officers commissioned by:
6262 (A) the board of managers of the Dallas County
6363 Hospital District, the Tarrant County Hospital District, the Bexar
6464 County Hospital District, or the El Paso County Hospital District
6565 under Section 281.057, Health and Safety Code;
6666 (B) the board of directors of the Ector County
6767 Hospital District under Section 1024.117, Special District Local
6868 Laws Code; and
6969 (C) the board of directors of the Midland County
7070 Hospital District of Midland County, Texas, under Section 1061.121,
7171 Special District Local Laws Code;
7272 (19) county park rangers commissioned under
7373 Subchapter E, Chapter 351, Local Government Code;
7474 (20) investigators employed by the Texas Racing
7575 Commission;
7676 (21) officers commissioned under Chapter 554,
7777 Occupations Code;
7878 (22) officers commissioned by the governing body of a
7979 metropolitan rapid transit authority under Section 451.108,
8080 Transportation Code, or by a regional transportation authority
8181 under Section 452.110, Transportation Code;
8282 (23) investigators commissioned by the attorney
8383 general under Section 402.009, Government Code;
8484 (24) security officers and investigators commissioned
8585 as peace officers under Chapter 466, Government Code;
8686 (25) an officer employed by the Department of State
8787 Health Services under Section 431.2471, Health and Safety Code;
8888 (26) officers appointed by an appellate court under
8989 Subchapter F, Chapter 53, Government Code;
9090 (27) officers commissioned by the state fire marshal
9191 under Chapter 417, Government Code;
9292 (28) an investigator commissioned by the commissioner
9393 of insurance under Section 701.104, Insurance Code;
9494 (29) apprehension specialists and inspectors general
9595 commissioned by the Texas Juvenile Justice Department as officers
9696 under Sections 242.102 and 243.052, Human Resources Code;
9797 (30) officers appointed by the inspector general of
9898 the Texas Department of Criminal Justice under Section 493.019,
9999 Government Code;
100100 (31) investigators commissioned by the Texas
101101 Commission on Law Enforcement under Section 1701.160, Occupations
102102 Code;
103103 (32) commission investigators commissioned by the
104104 Texas Private Security Board under Section 1702.061(f),
105105 Occupations Code;
106106 (33) the fire marshal and any officers, inspectors, or
107107 investigators commissioned by an emergency services district under
108108 Chapter 775, Health and Safety Code;
109109 (34) officers commissioned by the State Board of
110110 Dental Examiners under Section 254.013, Occupations Code, subject
111111 to the limitations imposed by that section;
112112 (35) investigators commissioned by the Texas Juvenile
113113 Justice Department as officers under Section 221.011, Human
114114 Resources Code; [and]
115115 (36) the fire marshal and any related officers,
116116 inspectors, or investigators commissioned by a county under
117117 Subchapter B, Chapter 352, Local Government Code; and
118118 (37) officers commissioned by the State Board of
119119 Veterinary Medical Examiners under Section 801.164, Occupations
120120 Code.
121121 SECTION 2. Subchapter D, Chapter 801, Occupations Code, is
122122 amended by adding Section 801.164 to read as follows:
123123 Sec. 801.164. PEACE OFFICERS. (a) The board may
124124 commission as a peace officer to enforce this chapter an employee
125125 who has been certified as qualified to be a peace officer by the
126126 Texas Commission on Law Enforcement.
127127 (b) An employee commissioned as a peace officer under this
128128 chapter has the powers, privileges, and immunities of a peace
129129 officer while carrying out duties as a peace officer under this
130130 chapter.
131131 SECTION 3. This Act takes effect immediately if it receives
132132 a vote of two-thirds of all the members elected to each house, as
133133 provided by Section 39, Article III, Texas Constitution. If this
134134 Act does not receive the vote necessary for immediate effect, this
135135 Act takes effect September 1, 2015.
