66 AN ACT
77 relating to the release of bulk criminal history record information
88 by certain individuals and agencies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1111 amended by adding Section 552.1426 to read as follows:
1212 Sec. 552.1426. DISSEMINATION OF BULK CRIMINAL HISTORY
1313 RECORD INFORMATION. (a) In this section:
1414 (1) "Bulk criminal history record information
1515 request" means a request submitted to a district clerk, county
1616 clerk, clerk of a justice or municipal court, or criminal justice
1717 agency for production, in any format, of all or a significant
1818 portion of the criminal history record information maintained by
1919 that clerk, court, or agency.
2020 (2) "Criminal history record information" means
2121 information about a person that is collected or maintained by a
2222 district clerk, county clerk, clerk of a justice or municipal
2323 court, or a criminal justice agency and that consists of
2424 identifiable descriptions and notations of arrests, detentions,
2525 indictments, informations, and other formal criminal charges and
2626 their dispositions. The term does not include:
2727 (A) identification information, including
2828 fingerprint records, to the extent that the identification
2929 information does not indicate involvement of the person in the
3030 criminal justice system;
3131 (B) traffic offense information maintained by a
3232 clerk of a municipal or justice court; or
3333 (C) driving record information maintained by the
3434 Department of Public Safety under Subchapter C, Chapter 521,
3535 Transportation Code.
3636 (3) "Criminal justice agency" has the meaning assigned
3737 by Section 411.082.
3838 (b) A district clerk, county clerk, clerk of a justice or
3939 municipal court, or criminal justice agency, other than the
4040 Department of Public Safety, that receives from any person or
4141 entity a bulk criminal history record information request
4242 concerning Class A or Class B or felony offenses for which a final
4343 judgment has been rendered shall deny the request and provide the
4444 requestor with instructions for submitting a bulk criminal history
4545 record information request to the Department of Public Safety.
4646 (c) A district clerk, county clerk, clerk of a justice or
4747 municipal court, or criminal justice agency that grants a bulk
4848 criminal history record information request submitted by any person
4949 or entity and that concerns Class C offenses for which final
5050 judgment has been rendered or offenses that are pending final
5151 disposition shall:
5252 (1) maintain a record of the name and contact
5353 information of the requestor and the most recent date criminal
5454 history record information was provided to the requestor; and
5555 (2) publish the record on the clerk's or agency's
5656 Internet website or, if the clerk or agency does not maintain an
5757 Internet website, prominently display the record in a public area
5858 of the clerk's or agency's place of business.
5959 (d) This section does not restrict public access to criminal
6060 history record information, other than through a bulk criminal
6161 history record information request, or limit the general discretion
6262 or authority of any district clerk, county clerk, clerk of a justice
6363 or municipal court, or criminal justice agency.
6464 SECTION 2. Section 411.087(a), Government Code, is amended
6565 to read as follows:
6666 (a) Unless otherwise authorized by Subsection (e), a
6767 person, agency, department, political subdivision, or other entity
6868 that is authorized by this subchapter to obtain from the department
6969 criminal history record information maintained by the department
7070 that relates to another person is authorized to:
7171 (1) obtain through the Federal Bureau of Investigation
7272 criminal history record information maintained or indexed by that
7373 bureau that pertains to that person; or
7474 (2) obtain from any other criminal justice agency in
7575 this state criminal history record information maintained by that
7676 criminal justice agency that relates to that person, except as
7777 otherwise provided by Section 552.1426.
7878 SECTION 3. This Act takes effect September 1, 2015.
