| 7 | 7 | | relating to the awarding of certain contracts of the Veterans' Land |

| 8 | 8 | | Board to veteran-owned businesses. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 161.131, Natural Resources Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 161.131. MINORITY-OWNED AND VETERAN-OWNED BUSINESSES. |
|---|
| 13 | 13 | | (a) The board shall make a good faith effort to award to both |
|---|
| 14 | 14 | | minority-owned and veteran-owned businesses: |
|---|
| 15 | 15 | | (1) contracts relating to the issuance of bonds by the |
|---|
| 16 | 16 | | board under this chapter in the amount of at least 20 percent of the |
|---|
| 17 | 17 | | total costs of issuing those bonds; and |
|---|
| 18 | 18 | | (2) contracts for the items to be financed by bonds |
|---|
| 19 | 19 | | issued by the board in the amount of at least 20 percent of the |
|---|
| 20 | 20 | | proceeds of those bonds. |
|---|
| 21 | 21 | | (b) [(c)] In this section: |
|---|
| 22 | 22 | | (1) "Minority-owned business" means a business entity |
|---|
| 23 | 23 | | at least 51 percent of which is owned by members of a minority group |
|---|
| 24 | 24 | | or, in the case of a corporation, at least 51 percent of the shares |
|---|
| 25 | 25 | | of which are owned by members of a minority group, and that is |
|---|
| 26 | 26 | | managed and controlled by members of a minority group in its daily |
|---|
| 27 | 27 | | operations. |
|---|
| 28 | 28 | | (2) "Minority group" includes: |
|---|
| 29 | 29 | | (A) African Americans; |
|---|
| 30 | 30 | | (B) American Indians; |
|---|
| 31 | 31 | | (C) Asian Americans; and |
|---|
| 32 | 32 | | (D) Mexican Americans and other Americans of |
|---|
| 33 | 33 | | Hispanic origin. |
|---|
| 34 | 34 | | (3) Notwithstanding Section 161.001(a)(7) or (b), |
|---|
| 35 | 35 | | "veteran" means a veteran, as defined by 38 U.S.C. Section 101(2), |
|---|
| 36 | 36 | | who has suffered at least a 20 percent service-connected |
|---|
| 37 | 37 | | disability, as defined by 38 U.S.C. Section 101(16). |
|---|
| 38 | 38 | | (4) "Veteran-owned business" means a business entity |
|---|
| 39 | 39 | | at least 51 percent of which is owned by veterans or, in the case of |
|---|
| 40 | 40 | | a corporation, at least 51 percent of the shares of which are owned |
|---|
| 41 | 41 | | by veterans, and that is managed and controlled by veterans in its |
|---|
| 42 | 42 | | daily operations. |
|---|
| 43 | 43 | | SECTION 2. This Act applies only to a contract for which a |
|---|
| 44 | 44 | | state agency first advertises or otherwise solicits bids, |
|---|
| 45 | 45 | | proposals, offers, or qualifications on or after the effective date |
|---|
| 46 | 46 | | of this Act. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2015. |
