44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the study of the fiscal impact on local governments in
77 Dallas, Ellis, Hunt, Kaufman, Navarro and Rockwall Counties of
88 restructuring the NorthSTAR behavioral health system and the
99 effective implementation the Sunset Commission Health and Human
1010 Services Commission Issue 9 recommendation.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The Texas Health and Human Services Commission
1313 shall contract with a private entity approved by the North Texas
1414 Behavioral Health Authority through a majority vote of the
1515 authority's board of directors to undertake a comprehensive study
1616 of the potential impact on local governments and continuity of
1717 services in Dallas, Ellis, Hunt, Kaufman, Navarro and Rockwall
1818 Counties if the present behavioral health managed care structure,
1919 known as the NorthSTAR system, were to be dismantled in accordance
2020 with the recommendations in Issue 9 of the Health and Human Services
2121 Sunset Commission report.
2222 SECTION 2. The scope of the study shall encompass but not be
2323 limited to
2424 a) Defining the initial and expected impact on
2525 county and municipal budgets of any system that
2626 might replace the present configuration
2727 b) Defining the likelihood of and anticipated
2828 impact of recidivism resulting from increased
2929 acuity in the indigent population presently
3030 served in the current system if care is disrupted
3131 c) Defining the potential impact on network
3232 access
3333 d) Defining the impact on integrated care
3434 e) Defining the overall impact on quality of care
3535 outcomes
3636 f) Defining the overall impact on the cost of
3737 care
3838 g) Defining the initial and expected impact on
3939 local medical and surgical hospitals
4040 SECTION 3. The findings of this study will be reported back
4141 to the North Texas Behavioral Health Authority and the Texas Health
4242 and Human Services Commission no later than June 30, 2016.
4343 SECTION 4.
4444 Collin County may exit NorthSTAR on or by October 1, 2016.
4545 The present deadline for any other changes to the NorthSTAR
4646 model shall be changed to September 1, 2017. This
4747 modification shall be made in order to align the current
4848 contract cycle with the State of Texas fiscal year and allow
4949 the next Legislature the ability to make an appropriately
5050 informed deliberation on the future of public behavioral
5151 health care in Dallas, Ellis, Hunt, Kaufman, Navarro and
5252 Rockwall Counties.
5353 SECTION 5. In the interim period the North Texas
5454 Behavioral Health Authority and the Texas Health and Human
5555 Services Commission shall solicit local stakeholder and
5656 community input, and incorporating the findings of the impact
5757 study, shall work with the representatives designated by the
5858 affected county governments in the development of a system
5959 that incorporates
6060 a) Local control and governance of the system by
6161 member counties through their designated voting
6262 representatives on the North Texas Behavioral
6363 Health Authority
6464 b) True integration and coordination of mental
6565 health services, substance use disorder services,
6666 crisis services and physical health care
6767 c) Equal care for non-Medicaid and Medicaid
6868 behavioral health populations
6969 d) Open access
7070 e) Braided local, state, and federal funding
7171 f) Connectivity and coordination of coverage
7272 which preserves the principles of 'no wrong door'
7373 g) Choice of providers
7474 h) Waiver of Institute of Mental Disease (IMD)
7575 Exclusion
7676 i) Separation of authority and provider
7777 functions
7878 j) Serving all those meeting state criteria for
7979 behavioral health services in one system:
8080 i. Income at or below 200% of Federal
8181 Poverty Level,
8282 ii. All individuals meeting state
8383 behavioral health clinical criteria;
8484 iii. Individuals meeting state Medicaid
8585 requirements
8686 k) Comprehensive evaluation and transparent
8787 publication of data
8888 l) Status as a public local behavioral health
8989 authority entity eligible to put up non-federal
9090 dollars to match federal DSRIP funds
9191 m) Provider payment plan and mechanisms to ensure
9292 a competitive provider market and an adequate
9393 network of providers capable of providing broad
9494 access to services;
9595 n) Plan to ensure quality of services provided to
9696 clients and
9797 o) Incentives of inclusion of local
9898 participation or match requirements
9999 p) Option for Dallas, Ellis, Hunt, Kaufman,
100100 Navarro or Rockwall Counties to continue in the
101101 plan or choose an alternate model and for counties
102102 contiguous to present or future NorthSTAR
103103 counties to join the model if the county
104104 governments of those contiguous counties should
105105 so choose
106106 SECTION 6. This Act takes effect immediately.
