77 relating to the disclosure of information about water used in
88 hydraulic fracturing.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter S, Chapter 91, Natural
1111 Resources Code, is amended to read as follows:
1212 SUBCHAPTER S. DISCLOSURE OF [COMPOSITION OF] HYDRAULIC FRACTURING
1313 INFORMATION [FLUIDS]
1414 SECTION 2. Subchapter S, Chapter 91, Natural Resources
1515 Code, is amended by adding Section 91.852 to read as follows:
1616 Sec. 91.852. DISCLOSURE OF HYDRAULIC FRACTURING WATER
1717 VOLUMES. (a) The commission shall require an operator of a well on
1818 which a hydraulic fracturing treatment is performed to submit to
1919 the commission:
2020 (1) the total volume of water used in the hydraulic
2121 fracturing treatment, with the volume from each source of water
2222 listed separately;
2323 (2) the total volumes from all sources of fresh water,
2424 brackish water, and saline water, listed by type, used in the
2525 hydraulic fracturing treatment; and
2626 (3) the total volume of water returning to the surface
2727 after the hydraulic fracturing treatment.
2828 (b) The commission shall create and maintain an Internet
2929 website to collect and make available to the public the information
3030 described by Subsection (a).
3131 SECTION 3. Section 91.852, Natural Resources Code, as added
3232 by this Act, applies only to a hydraulic fracturing treatment
3333 performed on a well for which an initial drilling permit is issued
3434 on or after the date the initial rules adopted by the Railroad
3535 Commission of Texas under that section take effect. A hydraulic
3636 fracturing treatment performed on a well for which an initial
3737 drilling permit is issued before the date the initial rules take
3838 effect is governed by the law as it existed immediately before the
3939 effective date of this Act, and that law is continued in effect for
4040 that purpose.
4141 SECTION 4. The Railroad Commission of Texas shall adopt
4242 rules under Section 91.852, Natural Resources Code, as added by
4343 this Act, not later than January 1, 2016.
4444 SECTION 5. This Act takes effect September 1, 2015.
