| 14 | 14 | | SECTION 2. Subchapter S, Chapter 91, Natural Resources |

| 15 | 15 | | Code, is amended by adding Section 91.852 to read as follows: |

| 16 | 16 | | Sec. 91.852. DISCLOSURE OF HYDRAULIC FRACTURING WATER |
|---|
| 17 | 17 | | VOLUMES. (a) The commission shall require an operator of a well on |
|---|
| 18 | 18 | | which a hydraulic fracturing treatment is performed to submit to |
|---|
| 19 | 19 | | the commission: |
|---|
| 20 | 20 | | (1) the total volume of water used in the hydraulic |
|---|
| 21 | 21 | | fracturing treatment, with the volume from each source of water |
|---|
| 22 | 22 | | listed separately; |
|---|
| 23 | 23 | | (2) the total volumes from all sources of fresh water, |
|---|
| 24 | 24 | | brackish water, and saline water, listed by type, used in the |
|---|
| 25 | 25 | | hydraulic fracturing treatment; and |
|---|
| 26 | 26 | | (3) the total volume of water returning to the surface |
|---|
| 27 | 27 | | after the hydraulic fracturing treatment. |
|---|
| 28 | 28 | | (b) The commission shall create and maintain an Internet |
|---|
| 29 | 29 | | website to collect and make available to the public the information |
|---|
| 30 | 30 | | described by Subsection (a). |
|---|
| 31 | 31 | | SECTION 3. Section 91.852, Natural Resources Code, as added |
|---|
| 32 | 32 | | by this Act, applies only to a hydraulic fracturing treatment |
|---|
| 33 | 33 | | performed on a well for which an initial drilling permit is issued |
|---|
| 34 | 34 | | on or after the date the initial rules adopted by the Railroad |
|---|
| 35 | 35 | | Commission of Texas under that section take effect. A hydraulic |
|---|
| 36 | 36 | | fracturing treatment performed on a well for which an initial |
|---|
| 37 | 37 | | drilling permit is issued before the date the initial rules take |
|---|
| 38 | 38 | | effect is governed by the law as it existed immediately before the |
|---|
| 39 | 39 | | effective date of this Act, and that law is continued in effect for |
|---|
| 40 | 40 | | that purpose. |
|---|
| 41 | 41 | | SECTION 4. The Railroad Commission of Texas shall adopt |
|---|
| 42 | 42 | | rules under Section 91.852, Natural Resources Code, as added by |
|---|
| 43 | 43 | | this Act, not later than January 1, 2016. |
|---|
| 44 | 44 | | SECTION 5. This Act takes effect September 1, 2015. |
