| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 253, Election Code, is |
|---|
| 11 | 11 | | amended by adding Section 253.044 to read as follows: |
|---|
| 12 | 12 | | Sec. 253.044. USE OF CERTAIN CONTRIBUTIONS BEFORE ELECTION. |
|---|
| 13 | 13 | | (a) This section applies only to a political contribution accepted |
|---|
| 14 | 14 | | by a candidate, a specific-purpose committee supporting or opposing |
|---|
| 15 | 15 | | a candidate, or a general-purpose committee that makes |
|---|
| 16 | 16 | | contributions or expenditures supporting or opposing a candidate, |
|---|
| 17 | 17 | | during the period beginning the 30th day before the date of an |
|---|
| 18 | 18 | | election in which the candidate is on the ballot and ending on that |
|---|
| 19 | 19 | | election day. |
|---|
| 20 | 20 | | (b) A candidate or committee that, during the period |
|---|
| 21 | 21 | | described by Subsection (a), accepts from a single source a |
|---|
| 22 | 22 | | political contribution that when aggregated with all political |
|---|
| 23 | 23 | | contributions from the same source during that period exceeds |
|---|
| 24 | 24 | | $5,000 may not spend the contribution until: |
|---|
| 25 | 25 | | (1) the candidate or committee reports the |
|---|
| 26 | 26 | | contribution to the authority with whom the candidate or committee |
|---|
| 27 | 27 | | reports political contributions and expenditures; and |
|---|
| 28 | 28 | | (2) if the candidate or committee files reports of |
|---|
| 29 | 29 | | political contributions and expenditures with the commission, the |
|---|
| 30 | 30 | | commission has posted on the commission's website the contribution |
|---|
| 31 | 31 | | reported under Subdivision (1). |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2015. |
