12	12	AN ACT
13	13	relating to the creation of the Montgomery-Grimes Counties
14	14	Municipal Utility District No. 146; granting a limited power of
15	15	eminent domain; providing authority to issue bonds; providing
16	16	authority to impose assessments, fees, and taxes.
17	17	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
18	18	SECTION 1. Subtitle F, Title 6, Special District Local Laws
19	19	Code, is amended by adding Chapter 7906 to read as follows:
20	20	CHAPTER 7906. MONTGOMERY-GRIMES COUNTIES MUNICIPAL UTILITY
21	21	DISTRICT NO. 146
22	22	SUBCHAPTER A. GENERAL PROVISIONS
23	23	Sec. 7906.001. DEFINITIONS. In this chapter:
24	24	(1) "Board" means the district's board of directors.
25	25	(2) "Commission" means the Texas Commission on
26	26	Environmental Quality.
27	27	(3) "Director" means a board member.
28	28	(4) "District" means the Montgomery-Grimes Counties
29	29	Municipal Utility District No. 146.
30	30	Sec. 7906.002. NATURE OF DISTRICT. The district is a
31	31	municipal utility district created under Section 59, Article XVI,
32	32	Texas Constitution.
33	33	Sec. 7906.003. CONFIRMATION AND DIRECTORS' ELECTION
34	34	REQUIRED. The temporary directors shall hold an election to
35	35	confirm the creation of the district and to elect five permanent
36	36	directors as provided by Section 49.102, Water Code.
37	37	Sec. 7906.004. CONSENT OF MUNICIPALITY REQUIRED. (a) The
38	38	temporary directors may not hold an election under Section 7906.003
39	39	until each municipality in whose corporate limits or
40	40	extraterritorial jurisdiction the district is located has
41	41	consented by ordinance or resolution to the creation of the
42	42	district and to the inclusion of land in the district.
43	43	(b) Municipal consent to the creation of the district and to
44	44	the inclusion of land in the district granted under this section
45	45	acts as municipal consent to the creation of any new district
46	46	created by the division of the district and to the inclusion of land
47	47	in the new district.
48	48	Sec. 7906.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
49	49	(a) The district is created to serve a public purpose and benefit.
50	50	(b) The district is created to accomplish the purposes of:
51	51	(1) a municipal utility district as provided by
52	52	general law and Section 59, Article XVI, Texas Constitution; and
53	53	(2) Section 52, Article III, Texas Constitution, that
54	54	relate to the construction, acquisition, improvement, operation,
55	55	or maintenance of macadamized, graveled, or paved roads, or
56	56	improvements, including storm drainage, in aid of those roads.
57	57	Sec. 7906.006. INITIAL DISTRICT TERRITORY. (a) The
58	58	district is initially composed of the territory described by
59	59	Section 2 of the Act enacting this chapter.
60	60	(b) The boundaries and field notes contained in Section 2 of
61	61	the Act enacting this chapter form a closure. A mistake made in the
62	62	field notes or in copying the field notes in the legislative process
63	63	does not affect the district's:
64	64	(1) organization, existence, or validity;
65	65	(2) right to issue any type of bond for the purposes
66	66	for which the district is created or to pay the principal of and
67	67	interest on a bond;
68	68	(3) right to impose a tax; or
69	69	(4) legality or operation.
70	70	SUBCHAPTER B. BOARD OF DIRECTORS
71	71	Sec. 7906.051. GOVERNING BODY; TERMS. (a) The district is
72	72	governed by a board of five elected directors.
73	73	(b) Except as provided by Section 7906.052, directors serve
74	74	staggered four-year terms.
75	75	Sec. 7906.052. TEMPORARY DIRECTORS. (a) On or after
76	76	September 1, 2015, the owner or owners of a majority of the assessed
77	77	value of the real property in the district may submit a petition to
78	78	the commission requesting that the commission appoint as temporary
79	79	directors the five persons named in the petition. The commission
80	80	shall appoint as temporary directors the five persons named in the
81	81	petition.
82	82	(b) Temporary directors serve until the earlier of:
83	83	(1) the date permanent directors are elected under
84	84	Section 7906.003; or
85	85	(2) September 1, 2019.
86	86	(c) If permanent directors have not been elected under
87	87	Section 7906.003 and the terms of the temporary directors have
88	88	expired, successor temporary directors shall be appointed or
89	89	reappointed as provided by Subsection (d) to serve terms that
90	90	expire on the earlier of:
91	91	(1) the date permanent directors are elected under
92	92	Section 7906.003; or
93	93	(2) the fourth anniversary of the date of the
94	94	appointment or reappointment.
95	95	(d) If Subsection (c) applies, the owner or owners of a
96	96	majority of the assessed value of the real property in the district
97	97	may submit a petition to the commission requesting that the
98	98	commission appoint as successor temporary directors the five
99	99	persons named in the petition. The commission shall appoint as
100	100	successor temporary directors the five persons named in the
101	101	petition.
102	102	SUBCHAPTER C. POWERS AND DUTIES
103	103	Sec. 7906.101. GENERAL POWERS AND DUTIES. The district has
104	104	the powers and duties necessary to accomplish the purposes for
105	105	which the district is created.
106	106	Sec. 7906.102. MUNICIPAL UTILITY DISTRICT POWERS AND
107	107	DUTIES. The district has the powers and duties provided by the
108	108	general law of this state, including Chapters 49 and 54, Water Code,
109	109	applicable to municipal utility districts created under Section 59,
110	110	Article XVI, Texas Constitution.
111	111	Sec. 7906.103. AUTHORITY FOR ROAD PROJECTS. Under Section
112	112	52, Article III, Texas Constitution, the district may design,
113	113	acquire, construct, finance, issue bonds for, improve, operate,
114	114	maintain, and convey to this state, a county, or a municipality for
115	115	operation and maintenance macadamized, graveled, or paved roads, or
116	116	improvements, including storm drainage, in aid of those roads.
117	117	Sec. 7906.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
118	118	road project must meet all applicable construction standards,
119	119	zoning and subdivision requirements, and regulations of each
120	120	municipality in whose corporate limits or extraterritorial
121	121	jurisdiction the road project is located.
122	122	(b) If a road project is not located in the corporate limits
123	123	or extraterritorial jurisdiction of a municipality, the road
124	124	project must meet all applicable construction standards,
125	125	subdivision requirements, and regulations of each county in which
126	126	the road project is located.
127	127	(c) If the state will maintain and operate the road, the
128	128	Texas Transportation Commission must approve the plans and
129	129	specifications of the road project.
130	130	Sec. 7906.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
131	131	OR RESOLUTION. (a) The district shall comply with all applicable
132	132	requirements of any ordinance or resolution that is adopted under
133	133	Section 54.016 or 54.0165, Water Code, and that consents to the
134	134	creation of the district or to the inclusion of land in the
135	135	district.
136	136	(b) Section 54.016(f), Water Code, does not apply to the
137	137	district.
138	138	Sec. 7906.106. DIVISION OF DISTRICT. (a) The district may
139	139	be divided into two or more new districts only if the district:
140	140	(1) has no outstanding bonded debt; and
141	141	(2) is not imposing ad valorem taxes.
142	142	(b) This chapter applies to any new district created by the
143	143	division of the district, and a new district has all the powers and
144	144	duties of the district.
145	145	(c) Any new district created by the division of the district
146	146	may not, at the time the new district is created, contain any land
147	147	outside the area described by Section 2 of the Act creating this
148	148	chapter.
149	149	(d) The board, on its own motion or on receipt of a petition
150	150	signed by the owner or owners of a majority of the assessed value of
151	151	the real property in the district, may adopt an order dividing the
152	152	district.
153	153	(e) The board may adopt an order dividing the district
154	154	before or after the date the board holds an election under Section
155	155	7906.003 to confirm the creation of the district and before or after
156	156	an election under Section 7906.151 to authorize the issuance of
157	157	bonds.
158	158	(f) An order dividing the district must:
159	159	(1) name each new district;
160	160	(2) include the metes and bounds description of the
161	161	territory of each new district;
162	162	(3) appoint temporary directors for each new district;
163	163	and
164	164	(4) provide for the division of assets and liabilities
165	165	between or among the new districts.
166	166	(g) On or before the 30th day after the date of adoption of
167	167	an order dividing the district, the district shall file the order
168	168	with the commission and record the order in the real property
169	169	records of each county in which the district is located.
170	170	(h) Any new district created by the division of the district
171	171	shall hold a confirmation and directors' election as required by
172	172	Section 7906.003.
173	173	(i) Any new district created by the division of the district
174	174	must hold an election as required by this chapter to obtain voter
175	175	approval before the district may impose a maintenance tax or issue
176	176	bonds payable wholly or partly from ad valorem taxes.
177	177	(j) If the creation of the new district is confirmed, the
178	178	new district shall provide the election date and results to the
179	179	commission.
180	180	SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
181	181	Sec. 7906.151. ELECTIONS REGARDING TAXES OR BONDS.
182	182	(a) The district may issue, without an election, bonds and other
183	183	obligations secured by:
184	184	(1) revenue other than ad valorem taxes; or
185	185	(2) contract payments described by Section 7906.153.
186	186	(b) The district must hold an election in the manner
187	187	provided by Chapters 49 and 54, Water Code, to obtain voter approval
188	188	before the district may impose an ad valorem tax or issue bonds
189	189	payable from ad valorem taxes.
190	190	(c) The district may not issue bonds payable from ad valorem
191	191	taxes to finance a road project unless the issuance is approved by a
192	192	vote of a two-thirds majority of the district voters voting at an
193	193	election held for that purpose.
194	194	Sec. 7906.152. OPERATION AND MAINTENANCE TAX. (a) If
195	195	authorized at an election held under Section 7906.151, the district
196	196	may impose an operation and maintenance tax on taxable property in
197	197	the district in accordance with Section 49.107, Water Code.
198	198	(b) The board shall determine the tax rate. The rate may not
199	199	exceed the rate approved at the election.
200	200	Sec. 7906.153. CONTRACT TAXES. (a) In accordance with
201	201	Section 49.108, Water Code, the district may impose a tax other than
202	202	an operation and maintenance tax and use the revenue derived from
203	203	the tax to make payments under a contract after the provisions of
204	204	the contract have been approved by a majority of the district voters
205	205	voting at an election held for that purpose.
206	206	(b) A contract approved by the district voters may contain a
207	207	provision stating that the contract may be modified or amended by
208	208	the board without further voter approval.
209	209	SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
210	210	Sec. 7906.201. AUTHORITY TO ISSUE BONDS AND OTHER
211	211	OBLIGATIONS. The district may issue bonds or other obligations
212	212	payable wholly or partly from ad valorem taxes, impact fees,
213	213	revenue, contract payments, grants, or other district money, or any
214	214	combination of those sources, to pay for any authorized district
215	215	purpose.
216	216	Sec. 7906.202. TAXES FOR BONDS. At the time the district
217	217	issues bonds payable wholly or partly from ad valorem taxes, the
218	218	board shall provide for the annual imposition of a continuing
219	219	direct ad valorem tax, without limit as to rate or amount, while all
220	220	or part of the bonds are outstanding as required and in the manner
221	221	provided by Sections 54.601 and 54.602, Water Code.
222	222	Sec. 7906.203. BONDS FOR ROAD PROJECTS. At the time of
223	223	issuance, the total principal amount of bonds or other obligations
224	224	issued or incurred to finance road projects and payable from ad
225	225	valorem taxes may not exceed one-fourth of the assessed value of the
226	226	real property in the district.
227	227	SECTION 2. The Montgomery-Grimes Counties Municipal
228	228	Utility District No. 146 initially includes all the territory
229	229	contained in the following area:
230	230	428.212 Acres
231	231	Joseph G. Ferguson Survey, A-221
232	232	Montgomery County, Texas
233	233	Being 428.212 acres of land situated in the Joseph G. Ferguson
234	234	Survey, A-221, Montgomery County, Texas, and being out of a
235	235	residual of a certain 1936.077 acres of land as described in deed
236	236	recorded under County Clerk's File No. 2007-037712 of the Real
237	237	Property Records of Montgomery County, Texas, said 428.212 acres of
238	238	land being more particularly described by metes and bounds as
239	239	follows:
240	240	BEGINNING at a concrete monument found in the west line of F.M.
241	241	1486, a 110 foot right-of-way, for the southeast corner of Blake
242	242	Ranch as described in deed recorded under County Clerk's File
243	243	No. 9366055 of the Real Property Records of Montgomery County,
244	244	Texas, same being the northeast corner and POINT OF BEGINNING of
245	245	the herein described tract;
246	246	THENCE South 02 degrees 33 minutes 01 seconds East, along the west
247	247	line of said F.M. 1486 and the east boundary line of the said
248	248	1936.077 acres of land, same being the east boundary line of the
249	249	herein described tract, a distance of 2677.01 feet to a 5/8 inch
250	250	iron rod with survey cap (Moyer) set for the northeast corner of Lot
251	251	1, Block 8, Crown Ranch Section One Amending Plat No. 1, according
252	252	to the map or plat thereof recorded in Cabinet Z, Sheets 755 thru
253	253	759 of the Map Records of Montgomery County, Texas, and the
254	254	southeast corner of the herein described tract;
255	255	THENCE North 85 degrees 35 minutes 50 seconds West, along the north
256	256	boundary line of Lots 1, 2, 3, and 4, Block 8, of said Crown Ranch
257	257	and the southerly boundary line of the herein described tract, a
258	258	distance of 1128.30 feet to a 5/8 inch iron rod with survey cap
259	259	(Moyer) set for an angle point;
260	260	THENCE South 59 degrees 34 minutes 02 seconds West, continuing

693	693	under Section 59, Article XVI, Texas Constitution, and Chapter 313,

695	695	(b) The governor, one of the required recipients, has
696	696	submitted the notice and Act to the Texas Commission on
697	697	Environmental Quality.
698	698	(c) The Texas Commission on Environmental Quality has filed
699	699	its recommendations relating to this Act with the governor, the
700	700	lieutenant governor, and the speaker of the house of
701	701	representatives within the required time.
702	702	(d) All requirements of the constitution and laws of this
703	703	state and the rules and procedures of the legislature with respect
704	704	to the notice, introduction, and passage of this Act are fulfilled
705	705	and accomplished.
706	706	SECTION 4. (a) If this Act does not receive a two-thirds
707	707	vote of all the members elected to each house, Subchapter C, Chapter
708	708	7906, Special District Local Laws Code, as added by Section 1 of
709	709	this Act, is amended by adding Section 7906.107 to read as follows:
710	710	Sec. 7906.107. NO EMINENT DOMAIN POWER. The district may
711	711	not exercise the power of eminent domain.
712	712	(b) This section is not intended to be an expression of a
713	713	legislative interpretation of the requirements of Section 17(c),
714	714	Article I, Texas Constitution.
715	715	SECTION 5. This Act takes effect September 1, 2015.
