1010 AN ACT
1111 relating to the creation of the Fort Bend County Municipal Utility
1212 District No. 218; granting a limited power of eminent domain;
1313 providing authority to issue bonds; providing authority to impose
1414 assessments, fees, and taxes.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1717 Code, is amended by adding Chapter 7927 to read as follows:
1818 CHAPTER 7927. FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 218
1919 SUBCHAPTER A. GENERAL PROVISIONS
2020 Sec. 7927.001. DEFINITIONS. In this chapter:
2121 (1) "Board" means the district's board of directors.
2222 (2) "Commission" means the Texas Commission on
2323 Environmental Quality.
2424 (3) "Director" means a board member.
2525 (4) "District" means the Fort Bend County Municipal
2626 Utility District No. 218.
2727 Sec. 7927.002. NATURE OF DISTRICT. The district is a
2828 municipal utility district created under Section 59, Article XVI,
2929 Texas Constitution.
3030 Sec. 7927.003. CONFIRMATION AND DIRECTORS' ELECTION
3131 REQUIRED. The temporary directors shall hold an election to
3232 confirm the creation of the district and to elect five permanent
3333 directors as provided by Section 49.102, Water Code.
3434 Sec. 7927.004. CONSENT OF MUNICIPALITY REQUIRED. The
3535 temporary directors may not hold an election under Section 7927.003
3636 until each municipality in whose corporate limits or
3737 extraterritorial jurisdiction the district is located has
3838 consented by ordinance or resolution to the creation of the
3939 district and to the inclusion of land in the district.
4040 Sec. 7927.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
4141 (a) The district is created to serve a public purpose and benefit.
4242 (b) The district is created to accomplish the purposes of:
4343 (1) a municipal utility district as provided by
4444 general law and Section 59, Article XVI, Texas Constitution; and
4545 (2) Section 52, Article III, Texas Constitution, that
4646 relate to the construction, acquisition, improvement, operation,
4747 or maintenance of macadamized, graveled, or paved roads, or
4848 improvements, including storm drainage, in aid of those roads.
4949 Sec. 7927.006. INITIAL DISTRICT TERRITORY. (a) The
5050 district is initially composed of the territory described by
5151 Section 2 of the Act enacting this chapter.
5252 (b) The boundaries and field notes contained in Section 2 of
5353 the Act enacting this chapter form a closure. A mistake made in the
5454 field notes or in copying the field notes in the legislative process
5555 does not affect the district's:
5656 (1) organization, existence, or validity;
5757 (2) right to issue any type of bond for the purposes
5858 for which the district is created or to pay the principal of and
5959 interest on a bond;
6060 (3) right to impose a tax; or
6161 (4) legality or operation.
6262 SUBCHAPTER B. BOARD OF DIRECTORS
6363 Sec. 7927.051. GOVERNING BODY; TERMS. (a) The district is
6464 governed by a board of five elected directors.
6565 (b) Except as provided by Section 7927.052, directors serve
6666 staggered four-year terms.
6767 Sec. 7927.052. TEMPORARY DIRECTORS. (a) On or after
6868 September 1, 2015, the owner or owners of a majority of the assessed
6969 value of the real property in the district may submit a petition to
7070 the commission requesting that the commission appoint as temporary
7171 directors the five persons named in the petition. The commission
7272 shall appoint as temporary directors the five persons named in the
7373 petition.
7474 (b) Temporary directors serve until the earlier of:
7575 (1) the date permanent directors are elected under
7676 Section 7927.003; or
7777 (2) September 1, 2019.
7878 (c) If permanent directors have not been elected under
7979 Section 7927.003 and the terms of the temporary directors have
8080 expired, successor temporary directors shall be appointed or
8181 reappointed as provided by Subsection (d) to serve terms that
8282 expire on the earlier of:
8383 (1) the date permanent directors are elected under
8484 Section 7927.003; or
8585 (2) the fourth anniversary of the date of the
8686 appointment or reappointment.
8787 (d) If Subsection (c) applies, the owner or owners of a
8888 majority of the assessed value of the real property in the district
8989 may submit a petition to the commission requesting that the
9090 commission appoint as successor temporary directors the five
9191 persons named in the petition. The commission shall appoint as
9292 successor temporary directors the five persons named in the
9393 petition.
9494 SUBCHAPTER C. POWERS AND DUTIES
9595 Sec. 7927.101. GENERAL POWERS AND DUTIES. The district has
9696 the powers and duties necessary to accomplish the purposes for
9797 which the district is created.
9898 Sec. 7927.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9999 DUTIES. The district has the powers and duties provided by the
100100 general law of this state, including Chapters 49 and 54, Water Code,
101101 applicable to municipal utility districts created under Section 59,
102102 Article XVI, Texas Constitution.
103103 Sec. 7927.103. AUTHORITY FOR ROAD PROJECTS. Under Section
104104 52, Article III, Texas Constitution, the district may design,
105105 acquire, construct, finance, issue bonds for, improve, operate,
106106 maintain, and convey to this state, a county, or a municipality for
107107 operation and maintenance macadamized, graveled, or paved roads, or
108108 improvements, including storm drainage, in aid of those roads.
109109 Sec. 7927.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
110110 road project must meet all applicable construction standards,
111111 zoning and subdivision requirements, and regulations of each
112112 municipality in whose corporate limits or extraterritorial
113113 jurisdiction the road project is located.
114114 (b) If a road project is not located in the corporate limits
115115 or extraterritorial jurisdiction of a municipality, the road
116116 project must meet all applicable construction standards,
117117 subdivision requirements, and regulations of each county in which
118118 the road project is located.
119119 (c) If the state will maintain and operate the road, the
120120 Texas Transportation Commission must approve the plans and
121121 specifications of the road project.
122122 Sec. 7927.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
123123 OR RESOLUTION. The district shall comply with all applicable
124124 requirements of any ordinance or resolution that is adopted under
125125 Section 54.016 or 54.0165, Water Code, and that consents to the
126126 creation of the district or to the inclusion of land in the
127127 district.
128128 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
129129 Sec. 7927.151. ELECTIONS REGARDING TAXES OR BONDS.
130130 (a) The district may issue, without an election, bonds and other
131131 obligations secured by:
132132 (1) revenue other than ad valorem taxes; or
133133 (2) contract payments described by Section 7927.153.
134134 (b) The district must hold an election in the manner
135135 provided by Chapters 49 and 54, Water Code, to obtain voter approval
136136 before the district may impose an ad valorem tax or issue bonds
137137 payable from ad valorem taxes.
138138 (c) The district may not issue bonds payable from ad valorem
139139 taxes to finance a road project unless the issuance is approved by a
140140 vote of a two-thirds majority of the district voters voting at an
141141 election held for that purpose.
142142 Sec. 7927.152. OPERATION AND MAINTENANCE TAX. (a) If
143143 authorized at an election held under Section 7927.151, the district
144144 may impose an operation and maintenance tax on taxable property in
145145 the district in accordance with Section 49.107, Water Code.
146146 (b) The board shall determine the tax rate. The rate may not
147147 exceed the rate approved at the election.
148148 Sec. 7927.153. CONTRACT TAXES. (a) In accordance with
149149 Section 49.108, Water Code, the district may impose a tax other than
150150 an operation and maintenance tax and use the revenue derived from
151151 the tax to make payments under a contract after the provisions of
152152 the contract have been approved by a majority of the district voters
153153 voting at an election held for that purpose.
154154 (b) A contract approved by the district voters may contain a
155155 provision stating that the contract may be modified or amended by
156156 the board without further voter approval.
157157 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
158158 Sec. 7927.201. AUTHORITY TO ISSUE BONDS AND OTHER
159159 OBLIGATIONS. The district may issue bonds or other obligations
160160 payable wholly or partly from ad valorem taxes, impact fees,
161161 revenue, contract payments, grants, or other district money, or any
162162 combination of those sources, to pay for any authorized district
163163 purpose.
164164 Sec. 7927.202. TAXES FOR BONDS. At the time the district
165165 issues bonds payable wholly or partly from ad valorem taxes, the
166166 board shall provide for the annual imposition of a continuing
167167 direct ad valorem tax, without limit as to rate or amount, while all
168168 or part of the bonds are outstanding as required and in the manner
169169 provided by Sections 54.601 and 54.602, Water Code.
170170 Sec. 7927.203. BONDS FOR ROAD PROJECTS. At the time of
171171 issuance, the total principal amount of bonds or other obligations
172172 issued or incurred to finance road projects and payable from ad
173173 valorem taxes may not exceed one-fourth of the assessed value of the
174174 real property in the district.
175175 SECTION 2. The Fort Bend County Municipal Utility District
176176 No. 218 initially includes all the territory contained in the
177177 following area:
178178 A 232.215 acre, or 10,115,268 square feet more or less tract of
179179 land, being all of that 250 acre tract of land conveyed to Frank
180180 Chalupa and described in a deed recorded in Volume 182, Page 194 of
181181 the Deed Records of Fort Bend County, Texas, subsequently divided
182182 into seven parcels and conveyed as follows: 41.58 acres conveyed to
183183 Edwin G. Chalupa et al in a deed recorded in Volume 708, Page 5,
184184 corrected in document recorded in Volume 753, Page 746, Deed
185185 Records of Fort Bend County, Texas, subsequently conveyed to
186186 Patrick B. Chalupa, Melissa K. Chalupa aka Melissa Chalupa Gonzalez
187187 by deeds recorded in Document Numbers 9621563, 2007000110,
188188 2007061950, 2014005282, and 2014005283 of the Official Public
189189 Records of Fort Bend County, Texas; 41.58 acres conveyed to Robert

400400 accordance with a survey made on the ground and a survey description

403403 SECTION 3. (a) The legal notice of the intention to
404404 introduce this Act, setting forth the general substance of this
405405 Act, has been published as provided by law, and the notice and a
406406 copy of this Act have been furnished to all persons, agencies,
407407 officials, or entities to which they are required to be furnished
408408 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
409409 Government Code.
410410 (b) The governor, one of the required recipients, has
411411 submitted the notice and Act to the Texas Commission on
412412 Environmental Quality.
413413 (c) The Texas Commission on Environmental Quality has filed
414414 its recommendations relating to this Act with the governor, the
415415 lieutenant governor, and the speaker of the house of
416416 representatives within the required time.
417417 (d) All requirements of the constitution and laws of this
418418 state and the rules and procedures of the legislature with respect
419419 to the notice, introduction, and passage of this Act are fulfilled
420420 and accomplished.
421421 SECTION 4. (a) If this Act does not receive a two-thirds
422422 vote of all the members elected to each house, Subchapter C, Chapter
423423 7927, Special District Local Laws Code, as added by Section 1 of
424424 this Act, is amended by adding Section 7927.106 to read as follows:
425425 Sec. 7927.106. NO EMINENT DOMAIN POWER. The district may
426426 not exercise the power of eminent domain.
427427 (b) This section is not intended to be an expression of a
428428 legislative interpretation of the requirements of Section 17(c),
429429 Article I, Texas Constitution.
430430 SECTION 5. This Act takes effect September 1, 2015.
