9	9	relating to the territory included in, the composition of the board
10	10	of directors of, and the powers of the Harris County Improvement
11	11	District No. 17.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subchapter C, Chapter 3891, Special District
14	14	Local Laws Code, is amended by adding Section 3891.109 to read as
15	15	follows:
16	16	Sec. 3891.109. ENFORCEMENT OF REAL PROPERTY RESTRICTIONS.
17	17	Section 54.237, Water Code, applies to the district.
18	18	SECTION 2. Subchapter D, Chapter 3891, Special District
19	19	Local Laws Code, is amended by adding Sections 3891.159 and
20	20	3891.160 to read as follows:
21	21	Sec. 3891.159. POWERS OF MUNICIPAL UTILITY DISTRICT TO
22	22	ESTABLISH DEFINED AREAS AND DESIGNATED PROPERTY; TAXES; BONDS. The
23	23	district has the powers of a municipal utility district under
24	24	Subchapter J, Chapter 54, Water Code, including the power to:
25	25	(1) implement a plan;
26	26	(2) issue bonds; and
27	27	(3) impose a tax in a defined area established under
28	28	that subchapter.
29	29	Sec. 3891.160. PETITION REQUIRED FOR CERTAIN ASSESSMENTS.
30	30	The board may not impose an assessment on territory added to the
31	31	district by an act of the legislature enacted after May 1, 2015,
32	32	unless a written petition consenting to the imposition of
33	33	assessments in the added territory has been filed with the board.
34	34	The petition must be signed by the owners of at least two-thirds of
35	35	the assessed value of real property in the added territory subject
36	36	to assessment according to the most recent certified tax appraisal
37	37	roll for the county or counties in which the real property is
38	38	located.
39	39	SECTION 3. (a) On the later of June 1, 2015, or the
40	40	effective date of this Act, the board of directors of the Harris
41	41	County Improvement District No. 17 is dissolved and is
42	42	reconstituted to be composed of the following directors:

62	62	SECTION 4. The following territory is added to the
63	63	territory of the Harris County Improvement District No. 17:

65	65	Tract 1 (FM 2920 and Telge) is +/- 117 acres in size, within the W.
66	66	Hurd Survey (Abstract No. 377) and situated southwest of the
67	67	intersection of Farm-to-Market 2920 (Waller-Tomball) and Telge
68	68	Roads in northwest Harris County with point of beginning being
69	69	northeast corner of 111 tract (ABST 377W HURD TRS 3C 3D 4A & 5A) and
70	70	west Right-Of-Way (ROW) of Telge Road;
71	71	Then south along west ROW of Telge Road and east boundary of 111

772	772	(b) The governor, one of the required recipients, has
773	773	submitted the notice and Act to the Texas Commission on
774	774	Environmental Quality.
775	775	(c) The Texas Commission on Environmental Quality has filed
776	776	its recommendations relating to this Act with the governor,
777	777	lieutenant governor, and speaker of the house of representatives
778	778	within the required time.
779	779	(d) The general law relating to consent by political
780	780	subdivisions to the creation of districts with conservation,
781	781	reclamation, and road powers and the inclusion of land in those
782	782	districts has been complied with.

787	787	SECTION 6. This Act takes effect immediately if it receives
788	788	a vote of two-thirds of all the members elected to each house, as

790	790	Act does not receive the vote necessary for immediate effect, this
791	791	Act takes effect September 1, 2015.
