64 AN ACT
75 relating to the transfer of certain state property from the Texas
86 Juvenile Justice Department to the State Orphans Home Alumni
97 Association.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. (a) In this Act, "State Orphans Home Alumni
1210 Association" means the association of individuals organized to
1311 honor the former residents and students of Corsicana State Home in
1412 Corsicana, Texas, formerly known as the State Orphans Home.
1513 (b) Not later than January 1, 2016, the Texas Juvenile
1614 Justice Department shall donate and transfer to the State Orphans
1715 Home Alumni Association the real property described by Subsection
1816 (f) of this section.
1917 (c) The State Orphans Home Alumni Association may use the
2018 real property transferred under this Act only for a purpose that
2119 benefits the public interest of the state by preserving and
2220 maintaining the property as a cemetery to commemorate the former
2321 residents of the Corsicana State Home, formerly known as the State
2422 Orphans Home, who are buried there. If the State Orphans Home
2523 Alumni Association uses the property for any purpose other than a
2624 purpose described by this subsection, ownership of the property
2725 automatically transfers to the State of Texas.
2826 (d) The Texas Juvenile Justice Department shall transfer
2927 the real property by an appropriate instrument of transfer. The
3028 instrument of transfer must:
3129 (1) provide that:
3230 (A) the State Orphans Home Alumni Association may
3331 use the property only for a purpose that benefits the public
3432 interest of the state by preserving and maintaining the property as
3533 a cemetery to commemorate the former residents of the Corsicana
3634 State Home, formerly known as the State Orphans Home, who are buried
3735 there; and
3836 (B) ownership of the property will automatically
3937 transfer to the State of Texas if the State Orphans Home Alumni
4038 Association uses the property for any purpose other than a purpose
4139 described by Paragraph (A) of this subdivision; and
4240 (2) describe the property to be transferred by metes
4341 and bounds.
4442 (e) The General Land Office shall retain custody of the
4543 instrument of transfer after the instrument of transfer is filed
4644 for recording in the real property records of Navarro County.
4745 (f) The real property referred to in this section is
4846 described as follows:
4947 A TRACT OF LAND IN THE J. W. WILLIAMS SURVEY ABSTRACT NO. 850 AS
5048 LOCATED IN THE CITY OF CORSICANA, NAVARRO COUNTY, TEXAS, AND BEING
5149 MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
5250 COMMENCING at a State of Texas concrete monument at the southeast
5351 corner of a called 278 acre tract described in a deed from TEXAS
5452 YOUTH COMMISSION to CORSICANA WALLY LTD. in Volume 1804/148 of the
5553 Real Records, Navarro County, Texas; said point being the northeast
5654 corner of a called 2.767 acre tract described in a deed from
5755 CORSICANA WALLY LTD. TO FUTURE BURGER KING in Volume 2007/5618 of
5856 the Deed Records, Navarro County, Texas;
5957 THENCE: N 30°31'11" W 1732.07 feet along the southwest right of way
6058 line of North 45th Street (a 80' wide right of way) to a 1/2" AW
6159 capped IRS for the Point of Beginning of the herein described
6260 subject property;
6361 THENCE: S 59°28'49" W 235.34 feet departing said right of way to a
6462 1/2" AW capped IRS for the southwest corner of the herein described
6563 subject property;
6664 THENCE: N 30°31'11" W 139.83' feet to a 1/2" AW capped IRS for the
6765 northwest corner of the herein described subject property;
6866 THENCE: N 59°28'49" E 235.34 feet to a 1/2" AW capped IRS southwest
6967 right of way of North 45th Street for the northeast corner of the
7068 herein described subject property;
7169 THENCE: S 30°31'11" E to the POINT OF BEGINNING and containing
7270 32,908 sq. ft. or 0.755 acres of land.
7371 SECTION 2. This Act takes effect immediately if it receives
7472 a vote of two-thirds of all the members elected to each house, as
7573 provided by Section 39, Article III, Texas Constitution. If this
7674 Act does not receive the vote necessary for immediate effect, this
7775 Act takes effect September 1, 2015.
