10 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 9 | | SECTION 1. (a) In this Act, "State Orphans Home Alumni |
---|
12 | 10 | | Association" means the association of individuals organized to |
---|
13 | 11 | | honor the former residents and students of Corsicana State Home in |
---|
14 | 12 | | Corsicana, Texas, formerly known as the State Orphans Home. |
---|
15 | 13 | | (b) Not later than January 1, 2016, the Texas Juvenile |
---|
16 | 14 | | Justice Department shall donate and transfer to the State Orphans |
---|
17 | 15 | | Home Alumni Association the real property described by Subsection |
---|
18 | 16 | | (f) of this section. |
---|
19 | 17 | | (c) The State Orphans Home Alumni Association may use the |
---|
20 | 18 | | real property transferred under this Act only for a purpose that |
---|
21 | 19 | | benefits the public interest of the state by preserving and |
---|
22 | 20 | | maintaining the property as a cemetery to commemorate the former |
---|
23 | 21 | | residents of the Corsicana State Home, formerly known as the State |
---|
24 | 22 | | Orphans Home, who are buried there. If the State Orphans Home |
---|
25 | 23 | | Alumni Association uses the property for any purpose other than a |
---|
26 | 24 | | purpose described by this subsection, ownership of the property |
---|
27 | 25 | | automatically transfers to the State of Texas. |
---|
28 | 26 | | (d) The Texas Juvenile Justice Department shall transfer |
---|
29 | 27 | | the real property by an appropriate instrument of transfer. The |
---|
30 | 28 | | instrument of transfer must: |
---|
31 | 29 | | (1) provide that: |
---|
32 | 30 | | (A) the State Orphans Home Alumni Association may |
---|
33 | 31 | | use the property only for a purpose that benefits the public |
---|
34 | 32 | | interest of the state by preserving and maintaining the property as |
---|
35 | 33 | | a cemetery to commemorate the former residents of the Corsicana |
---|
36 | 34 | | State Home, formerly known as the State Orphans Home, who are buried |
---|
37 | 35 | | there; and |
---|
38 | 36 | | (B) ownership of the property will automatically |
---|
39 | 37 | | transfer to the State of Texas if the State Orphans Home Alumni |
---|
40 | 38 | | Association uses the property for any purpose other than a purpose |
---|
41 | 39 | | described by Paragraph (A) of this subdivision; and |
---|
42 | 40 | | (2) describe the property to be transferred by metes |
---|
43 | 41 | | and bounds. |
---|
44 | 42 | | (e) The General Land Office shall retain custody of the |
---|
45 | 43 | | instrument of transfer after the instrument of transfer is filed |
---|
46 | 44 | | for recording in the real property records of Navarro County. |
---|
47 | 45 | | (f) The real property referred to in this section is |
---|
48 | 46 | | described as follows: |

49 | 47 | | A TRACT OF LAND IN THE J. W. WILLIAMS SURVEY ABSTRACT NO. 850 AS |
---|
50 | 48 | | LOCATED IN THE CITY OF CORSICANA, NAVARRO COUNTY, TEXAS, AND BEING |
---|
51 | 49 | | MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: |

52 | 50 | | COMMENCING at a State of Texas concrete monument at the southeast |
---|
53 | 51 | | corner of a called 278 acre tract described in a deed from TEXAS |
---|
54 | 52 | | YOUTH COMMISSION to CORSICANA WALLY LTD. in Volume 1804/148 of the |
---|
55 | 53 | | Real Records, Navarro County, Texas; said point being the northeast |
---|
56 | 54 | | corner of a called 2.767 acre tract described in a deed from |
---|
57 | 55 | | CORSICANA WALLY LTD. TO FUTURE BURGER KING in Volume 2007/5618 of |

58 | 56 | | the Deed Records, Navarro County, Texas; |

59 | 57 | | THENCE: N 30°31'11" W 1732.07 feet along the southwest right of way |

60 | 58 | | line of North 45th Street (a 80' wide right of way) to a 1/2" AW |

61 | 59 | | capped IRS for the Point of Beginning of the herein described |

73 | 71 | | SECTION 2. This Act takes effect immediately if it receives |

74 | 72 | | a vote of two-thirds of all the members elected to each house, as |
---|
75 | 73 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
76 | 74 | | Act does not receive the vote necessary for immediate effect, this |
---|
77 | 75 | | Act takes effect September 1, 2015. |
