66 AN ACT
77 relating to powers and duties of the Porter Special Utility
88 District; providing authority to establish defined areas or
99 designated property, to issue bonds, and to impose taxes for the
1010 benefit of defined areas or designated property; granting a limited
1111 power of eminent domain in the defined areas or designated
1212 property.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subtitle C, Title 6, Special District Local Laws
1515 Code, is amended by adding Chapter 7220 to read as follows:
1616 CHAPTER 7220. PORTER SPECIAL UTILITY DISTRICT
1717 SUBCHAPTER A. GENERAL PROVISIONS
1818 Sec. 7220.001. DEFINITION. In this chapter, "district"
1919 means the Porter Special Utility District.
2020 Sec. 7220.002. NATURE AND PURPOSE OF DISTRICT. (a) The
2121 district is a special utility district created under Section 59,
2222 Article XVI, Texas Constitution.
2323 (b) The district is created to accomplish the purposes of:
2424 (1) a special utility district as provided by general
2525 law and Section 59, Article XVI, Texas Constitution; and
2626 (2) in defined areas or designated property of the
2727 district established in accordance with Subchapter B, a municipal
2828 utility district as provided by general law and Section 59, Article
2929 XVI, Texas Constitution.
3030 SUBCHAPTER B. POWERS AND DUTIES
3131 Sec. 7220.051. GENERAL POWERS AND DUTIES. The district has
3232 the powers and duties necessary to accomplish the purposes for
3333 which the district is created.
3434 Sec. 7220.052. SPECIAL UTILITY DISTRICT POWERS AND DUTIES.
3535 Except as provided by this chapter, the district has all of the
3636 powers and duties provided by general law of this state, including
3737 Chapters 49 and 65, Water Code, applicable to special utility
3838 districts created under Section 59, Article XVI, Texas
3939 Constitution.
4040 Sec. 7220.053. AUTHORITY TO ESTABLISH DEFINED AREAS OR
4141 DESIGNATED PROPERTY. (a) The district may establish and maintain
4242 defined areas or designated property in accordance with Subchapter
4343 J, Chapter 54, Water Code, including the power to impose taxes and
4444 issue bonds in the defined areas or designated property.
4545 (b) Section 65.235, Water Code, does not apply to the
4646 district.
4747 Sec. 7220.054. ANNEXATION OF LAND TO DEFINED AREAS OR
4848 DESIGNATED PROPERTY. The district may annex land to an existing
4949 defined area or designated property in the same manner as land
5050 annexed to a district as provided by Sections 49.301 and 49.302,
5151 Water Code. Land annexed to a defined area or designated property
5252 must also be included in the district but is not required to be
5353 contiguous to the defined area or designated property into which it
5454 is annexed.
5555 Sec. 7220.055. MUNICIPAL UTILITY DISTRICT POWERS AND DUTIES
5656 IN DEFINED AREA OR DESIGNATED PROPERTY. In a defined area or
5757 designated property created by the district, the district has the
5858 powers and duties provided by the general law of this state,
5959 including Chapters 49 and 54, Water Code, applicable to municipal
6060 utility districts created under Section 59, Article XVI, Texas
6161 Constitution.
6262 SECTION 2. (a) The legal notice of the intention to
6363 introduce this Act, setting forth the general substance of this
6464 Act, has been published as provided by law, and the notice and a
6565 copy of this Act have been furnished to all persons, agencies,
6666 officials, or entities to which they are required to be furnished
6767 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
6868 Government Code.
6969 (b) The governor, one of the required recipients, has
7070 submitted the notice and Act to the Texas Commission on
7171 Environmental Quality.
7272 (c) The Texas Commission on Environmental Quality has filed
7373 its recommendations relating to this Act with the governor, the
7474 lieutenant governor, and the speaker of the house of
7575 representatives within the required time.
7676 (d) All requirements of the constitution and laws of this
7777 state and the rules and procedures of the legislature with respect
7878 to the notice, introduction, and passage of this Act are fulfilled
7979 and accomplished.
8080 SECTION 3. This Act takes effect September 1, 2015.
