108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1210 Code, is amended by adding Chapter 7954 to read as follows:
1311 CHAPTER 7954. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 153
1412 SUBCHAPTER A. GENERAL PROVISIONS
1513 Sec. 7954.001. DEFINITIONS. In this chapter:
1614 (1) "Board" means the district's board of directors.
1715 (2) "Commission" means the Texas Commission on
1816 Environmental Quality.
1917 (3) "Director" means a board member.
2018 (4) "District" means the Montgomery County Municipal
2119 Utility District No. 153.
2220 Sec. 7954.002. NATURE OF DISTRICT. The district is a
2321 municipal utility district created under Section 59, Article XVI,
2422 Texas Constitution.
2523 Sec. 7954.003. CONFIRMATION AND DIRECTORS' ELECTION
2624 REQUIRED. The temporary directors shall hold an election to
2725 confirm the creation of the district and to elect five permanent
2826 directors as provided by Section 49.102, Water Code.
2927 Sec. 7954.004. CONSENT OF MUNICIPALITY REQUIRED. The
3028 temporary directors may not hold an election under Section 7954.003
3129 until each municipality in whose corporate limits or
3230 extraterritorial jurisdiction the district is located has
3331 consented by ordinance or resolution to the creation of the
3432 district and to the inclusion of land in the district.
3533 Sec. 7954.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3634 (a) The district is created to serve a public purpose and benefit.
3735 (b) The district is created to accomplish the purposes of:
3836 (1) a municipal utility district as provided by
3937 general law and Section 59, Article XVI, Texas Constitution; and
4038 (2) Section 52, Article III, Texas Constitution, that
4139 relate to the construction, acquisition, improvement, operation,
4240 or maintenance of macadamized, graveled, or paved roads, or
4341 improvements, including storm drainage, in aid of those roads.
4442 Sec. 7954.006. INITIAL DISTRICT TERRITORY. (a) The
4543 district is initially composed of the territory described by
4644 Section 2 of the Act enacting this chapter.
4745 (b) The boundaries and field notes contained in Section 2 of
4846 the Act enacting this chapter form a closure. A mistake made in the
4947 field notes or in copying the field notes in the legislative process
5048 does not affect the district's:
5149 (1) organization, existence, or validity;
5250 (2) right to issue any type of bond for the purposes
5351 for which the district is created or to pay the principal of and
5452 interest on a bond;
5553 (3) right to impose a tax; or
5654 (4) legality or operation.
5755 SUBCHAPTER B. BOARD OF DIRECTORS
5856 Sec. 7954.051. GOVERNING BODY; TERMS. (a) The district is
5957 governed by a board of five elected directors.
6058 (b) Except as provided by Section 7954.052, directors serve
6159 staggered four-year terms.
6260 Sec. 7954.052. TEMPORARY DIRECTORS. (a) On or after the
6361 effective date of the Act enacting this chapter, the owner or owners
6462 of a majority of the assessed value of the real property in the
6563 district may submit a petition to the commission requesting that
6664 the commission appoint as temporary directors the five persons
6765 named in the petition. The commission shall appoint as temporary
6866 directors the five persons named in the petition.
6967 (b) Temporary directors serve until the earlier of:
7068 (1) the date permanent directors are elected under
7169 Section 7954.003; or
7270 (2) the fourth anniversary of the effective date of
7371 the Act enacting this chapter.
7472 (c) If permanent directors have not been elected under
7573 Section 7954.003 and the terms of the temporary directors have
7674 expired, successor temporary directors shall be appointed or
7775 reappointed as provided by Subsection (d) to serve terms that
7876 expire on the earlier of:
7977 (1) the date permanent directors are elected under
8078 Section 7954.003; or
8179 (2) the fourth anniversary of the date of the
8280 appointment or reappointment.
8381 (d) If Subsection (c) applies, the owner or owners of a
8482 majority of the assessed value of the real property in the district
8583 may submit a petition to the commission requesting that the
8684 commission appoint as successor temporary directors the five
8785 persons named in the petition. The commission shall appoint as
8886 successor temporary directors the five persons named in the
8987 petition.
9088 SUBCHAPTER C. POWERS AND DUTIES
9189 Sec. 7954.101. GENERAL POWERS AND DUTIES. The district has
9290 the powers and duties necessary to accomplish the purposes for
9391 which the district is created.
9492 Sec. 7954.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9593 DUTIES. The district has the powers and duties provided by the
9694 general law of this state, including Chapters 49 and 54, Water Code,
9795 applicable to municipal utility districts created under Section 59,
9896 Article XVI, Texas Constitution.
9997 Sec. 7954.103. AUTHORITY FOR ROAD PROJECTS. Under Section
10098 52, Article III, Texas Constitution, the district may design,
10199 acquire, construct, finance, issue bonds for, improve, operate,
102100 maintain, and convey to this state, a county, or a municipality for
103101 operation and maintenance macadamized, graveled, or paved roads, or
104102 improvements, including storm drainage, in aid of those roads.
105103 Sec. 7954.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
106104 road project must meet all applicable construction standards,
107105 zoning and subdivision requirements, and regulations of each
108106 municipality in whose corporate limits or extraterritorial
109107 jurisdiction the road project is located.
110108 (b) If a road project is not located in the corporate limits
111109 or extraterritorial jurisdiction of a municipality, the road
112110 project must meet all applicable construction standards,
113111 subdivision requirements, and regulations of each county in which
114112 the road project is located.
115113 (c) If the state will maintain and operate the road, the
116114 Texas Transportation Commission must approve the plans and
117115 specifications of the road project.
118116 Sec. 7954.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
119117 OR RESOLUTION. The district shall comply with all applicable
120118 requirements of any ordinance or resolution that is adopted under
121119 Section 54.016 or 54.0165, Water Code, and that consents to the
122120 creation of the district or to the inclusion of land in the
123121 district.
124122 Sec. 7954.106. DIVISION OF DISTRICT. (a) The district may
125123 be divided into two or more new districts only if the district:
126124 (1) has no outstanding bonded debt; and
127125 (2) is not imposing ad valorem taxes.
128126 (b) This chapter applies to any new district created by the
129127 division of the district, and a new district has all the powers and
130128 duties of the district.
131129 (c) Any new district created by the division of the district
132130 may not, at the time the new district is created, contain any land
133131 outside the area described by Section 2 of the Act enacting this
134132 chapter.
135133 (d) The board, on its own motion or on receipt of a petition
136134 signed by the owner or owners of a majority of the assessed value of
137135 the real property in the district, may adopt an order dividing the
138136 district.
139137 (e) The board may adopt an order dividing the district
140138 before or after the date the board holds an election under Section
141139 7954.003 to confirm the district's creation.
142140 (f) An order dividing the district must:
143141 (1) name each new district;
144142 (2) include the metes and bounds description of the
145143 territory of each new district;
146144 (3) appoint temporary directors for each new district;
147145 and
148146 (4) provide for the division of assets and liabilities
149147 between or among the new districts.
150148 (g) On or before the 30th day after the date of adoption of
151149 an order dividing the district, the district shall file the order
152150 with the commission and record the order in the real property
153151 records of each county in which the district is located.
154152 (h) Any new district created by the division of the district
155153 shall hold a confirmation and directors' election as required by
156154 Section 7954.003.
157155 (i) Municipal consent to the creation of the district and to
158156 the inclusion of land in the district granted under Section
159157 7954.004 acts as municipal consent to the creation of any new
160158 district created by the division of the district and to the
161159 inclusion of land in the new district.
162160 (j) Any new district created by the division of the district
163161 must hold an election as required by this chapter to obtain voter
164162 approval before the district may impose a maintenance tax or issue
165163 bonds payable wholly or partly from ad valorem taxes.
166164 (k) If the creation of the new district is confirmed, the
167165 new district shall provide the election date and results to the
168166 commission.
169167 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
170168 Sec. 7954.151. ELECTIONS REGARDING TAXES OR BONDS.
171169 (a) The district may issue, without an election, bonds and other
172170 obligations secured by:
173171 (1) revenue other than ad valorem taxes; or
174172 (2) contract payments described by Section 7954.153.
175173 (b) The district must hold an election in the manner
176174 provided by Chapters 49 and 54, Water Code, to obtain voter approval
177175 before the district may impose an ad valorem tax or issue bonds
178176 payable from ad valorem taxes.
179177 (c) The district may not issue bonds payable from ad valorem
180178 taxes to finance a road project unless the issuance is approved by a
181179 vote of a two-thirds majority of the district voters voting at an
182180 election held for that purpose.
183181 Sec. 7954.152. OPERATION AND MAINTENANCE TAX. (a) If
184182 authorized at an election held under Section 7954.151, the district
185183 may impose an operation and maintenance tax on taxable property in
186184 the district in accordance with Section 49.107, Water Code.
187185 (b) The board shall determine the tax rate. The rate may not
188186 exceed the rate approved at the election.
189187 Sec. 7954.153. CONTRACT TAXES. (a) In accordance with
190188 Section 49.108, Water Code, the district may impose a tax other than
191189 an operation and maintenance tax and use the revenue derived from
192190 the tax to make payments under a contract after the provisions of
193191 the contract have been approved by a majority of the district voters
194192 voting at an election held for that purpose.
195193 (b) A contract approved by the district voters may contain a
196194 provision stating that the contract may be modified or amended by
197195 the board without further voter approval.
198196 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
199197 Sec. 7954.201. AUTHORITY TO ISSUE BONDS AND OTHER
200198 OBLIGATIONS. The district may issue bonds or other obligations
201199 payable wholly or partly from ad valorem taxes, impact fees,
202200 revenue, contract payments, grants, or other district money, or any
203201 combination of those sources, to pay for any authorized district
204202 purpose.
205203 Sec. 7954.202. TAXES FOR BONDS. At the time the district
206204 issues bonds payable wholly or partly from ad valorem taxes, the
207205 board shall provide for the annual imposition of a continuing
208206 direct ad valorem tax, without limit as to rate or amount, while all
209207 or part of the bonds are outstanding as required and in the manner
210208 provided by Sections 54.601 and 54.602, Water Code.
211209 Sec. 7954.203. BONDS FOR ROAD PROJECTS. At the time of
212210 issuance, the total principal amount of bonds or other obligations
213211 issued or incurred to finance road projects and payable from ad
214212 valorem taxes may not exceed one-fourth of the assessed value of the
215213 real property in the district.
216214 SECTION 2. The Montgomery County Municipal Utility District
217215 No. 153 initially includes all the territory contained in the
218216 following area:
219217 PARCEL 1(274.908 ACRES)
220218 All that certain tract or parcel of land situated in the
221219 William Bryan Survey, Abstract Number 108 and the T.A. & Helen
222220 McWhorter Survey, Abstract Number 800, in Montgomery County, Texas
223221 and being the West one-half of that certain 550 acres as described
224222 in Deed to Selected Lands, LTD, #12, recorded In Volume 822, Page
225223 932 of the Montgomery County Deed Records; said West one-half being

670668 its recommendations relating to this Act with the governor, the

677675 SECTION 4. (a) If this Act does not receive a two-thirds
678676 vote of all the members elected to each house, Subchapter C, Chapter
679677 7954, Special District Local Laws Code, as added by Section 1 of
680678 this Act, is amended by adding Section 7954.107 to read as follows:
681679 Sec. 7954.107. NO EMINENT DOMAIN POWER. The district may
682680 not exercise the power of eminent domain.
683681 (b) This section is not intended to be an expression of a
684682 legislative interpretation of the requirements of Section 17(c),
685683 Article I, Texas Constitution.
686684 SECTION 5. This Act takes effect immediately if it receives
687685 a vote of two-thirds of all the members elected to each house, as
688686 provided by Section 39, Article III, Texas Constitution. If this
689687 Act does not receive the vote necessary for immediate effect, this
690688 Act takes effect September 1, 2015.
