| 14 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 9 | | SECTION 1. Sections 8471.104 and 8471.105, Special District |
|---|
| 16 | 10 | | Local Laws Code, are amended to read as follows: |
|---|
| 17 | 11 | | Sec. 8471.104. NO [LIMITATION ON USE OF] EMINENT DOMAIN |
|---|
| 18 | 12 | | POWER. [(a)] The district may not exercise the power of eminent |
|---|
| 19 | 13 | | domain [except for the purpose of importing surface water or |
|---|
| 20 | 14 | | nonlocal groundwater into the district. |
|---|
| 21 | 15 | | [(b) For purposes of this section, nonlocal groundwater |
|---|
| 22 | 16 | | includes only groundwater that is withdrawn from a source outside |
|---|
| 23 | 17 | | the Edwards Aquifer and the Trinity Aquifer]. |
|---|
| 24 | 18 | | Sec. 8471.105. LIMITATION ON ANNEXATION. The district may |
|---|
| 25 | 19 | | not add land by petition of less than all the landowners under |
|---|
| 26 | 20 | | Section 49.302, Water Code[, unless the petition required under |
|---|
| 27 | 21 | | that section is signed by the owners of a two-thirds majority of the |
|---|
| 28 | 22 | | assessed value of the land in the defined area described by the |
|---|
| 29 | 23 | | petition]. |
|---|
| 30 | 24 | | SECTION 2. Section 8471.103(c), Special District Local Laws |
|---|
| 31 | 25 | | Code, is repealed. |
|---|
| 32 | 26 | | SECTION 3. This Act takes effect September 1, 2015, but only |
|---|
| 33 | 27 | | if H.B. 3405, S.B. 1440, or similar legislation of the 84th |
|---|
| 34 | 28 | | Legislature, Regular Session, 2015, that enlarges the territory of |
|---|
| 35 | 29 | | the Barton Springs-Edwards Aquifer Conservation District to |
|---|
| 36 | 30 | | include the territory of the Needmore Ranch Municipal Utility |
|---|
| 37 | 31 | | District No. 1, becomes law. If such a bill does not become law, |
|---|
| 38 | 32 | | this Act has no effect. |
