66 AN ACT
77 relating to authorizing the issuance of revenue bonds to fund
88 capital projects at public institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1111 amended by adding Sections 55.1781, 55.1782, 55.1783, 55.1784,
1212 55.1785, 55.1786, 55.1787, 55.1788, 55.1789, 55.17891, and
1313 55.17892 to read as follows:
1414 Sec. 55.1781. THE TEXAS A&M UNIVERSITY SYSTEM; ADDITIONAL
1515 BONDS. (a) In addition to the other authority granted by this
1616 subchapter, the board of regents of The Texas A&M University System
1717 may acquire, purchase, construct, improve, renovate, enlarge, or
1818 equip property and facilities, including roads and related
1919 infrastructure, for projects to be financed through the issuance of
2020 bonds in accordance with this subchapter and in accordance with a
2121 systemwide revenue financing program adopted by the board for the
2222 following institutions, not to exceed the following aggregate
2323 principal amounts for the projects specified, as follows:
2424 (1) Texas A&M University--Commerce, $60,000,000 for
2525 construction of a nursing and health sciences building;
2626 (2) Texas A&M University--Corpus Christi,
2727 $120,000,000 for construction of a life sciences research and
2828 engineering building;
2929 (3) Texas A&M University--Kingsville, $77,111,899 for
3030 construction of a music building;
3131 (4) Texas A&M University--Texarkana, $40,000,000 for
3232 construction of an academic and student health sciences building;
3333 (5) West Texas A&M University:
3434 (A) $20,000,000 for renovation of the Amarillo
3535 Center; and
3636 (B) $53,000,000 for construction of an
3737 agricultural sciences complex;
3838 (6) The Texas A&M University System Health Science
3939 Center:
4040 (A) $100,000,000 for construction of a
4141 multidisciplinary research and education facility in Bryan, Texas;
4242 and
4343 (B) $119,371,824 for construction of a dental
4444 clinic facility at the Baylor College of Dentistry;
4545 (7) Texas A&M International University, $60,625,000
4646 for construction of an academic and laboratory learning center;
4747 (8) Prairie View A&M University, $15,000,000 for
4848 construction of a fabrication center;
4949 (9) Tarleton State University:
5050 (A) $85,600,000 for construction of an applied
5151 sciences building; and
5252 (B) $99,600,000 for construction of a southwest
5353 metroplex building for the campus in Midlothian;
5454 (10) Texas A&M University, $95,000,000 for
5555 construction of a biocontainment research facility;
5656 (11) Texas A&M University at Galveston, $134,000,000
5757 for construction of an academic building;
5858 (12) Texas A&M University--Central Texas, $40,000,000
5959 for construction of a multipurpose building;
6060 (13) Texas A&M University--San Antonio, $70,000,000
6161 for construction of a science and technology building; and
6262 (14) the Texas Engineering Experiment Station,
6363 $65,000,000 for construction of a center for infrastructure
6464 renewal.
6565 (b) The board may pledge irrevocably to the payment of bonds
6666 authorized by this section all or any part of the revenue funds of
6767 an institution, branch, or entity of The Texas A&M University
6868 System, including student tuition charges. The amount of a pledge
6969 made under this subsection may not be reduced or abrogated while the
7070 bonds for which the pledge is made, or bonds issued to refund those
7171 bonds, are outstanding.
7272 (c) If sufficient funds are not available to the board to
7373 meet its obligations under this section, the board may transfer
7474 funds among institutions, branches, and entities of The Texas A&M
7575 University System to ensure the most equitable and efficient
7676 allocation of available resources for each institution, branch, or
7777 entity to carry out its duties and purposes.
7878 (d) The expanded capacity at system institutions
7979 attributable to the authorization provided for projects under
8080 Subsection (a) supports the provision of dual credit or career and
8181 technology education programs in furtherance of the goals of
8282 Chapter 211 (H.B. 5), Acts of the 83rd Legislature, Regular
8383 Session, 2013.
8484 Sec. 55.1782. THE UNIVERSITY OF TEXAS SYSTEM; ADDITIONAL
8585 BONDS. (a) In addition to the other authority granted by this
8686 subchapter, the board of regents of The University of Texas System
8787 may acquire, purchase, construct, improve, renovate, enlarge, or
8888 equip property and facilities, including roads and related
8989 infrastructure, for projects to be financed through the issuance of
9090 bonds in accordance with this subchapter and in accordance with a
9191 systemwide revenue financing program adopted by the board for the
9292 following institutions, not to exceed the following aggregate
9393 principal amounts for the projects specified, as follows:
9494 (1) The University of Texas at Austin, $125,000,000
9595 for renovation of Robert A. Welch Hall;
9696 (2) The University of Texas--Rio Grande Valley:
9797 (A) $50,600,000 for construction of a
9898 multipurpose academic center at the campus in Brownsville; and
9999 (B) $50,000,000 for construction of an
100100 interdisciplinary engineering and academic studies building at the
101101 campus in Edinburg;
102102 (3) The University of Texas Southwestern Medical
103103 Center at Dallas, $102,000,000 for the construction and renovation
104104 of a vivarium;
105105 (4) The University of Texas Health Science Center at
106106 San Antonio, $93,800,000 for the renovation of a medical and dental
107107 education building;
108108 (5) The University of Texas M. D. Anderson Cancer
109109 Center, $361,000,000 for construction of the Sheikh Zayed Bin
110110 Sultan Al Nahyan Building for Personalized Cancer Care;
111111 (6) The University of Texas Medical Branch at
112112 Galveston, $90,400,000 for construction of a health education
113113 center;
114114 (7) The University of Texas at Arlington, $244,000,000
115115 for construction of a science and engineering innovation and
116116 research building;
117117 (8) The University of Texas at Dallas, $110,000,000
118118 for construction of an engineering building;
119119 (9) The University of Texas at El Paso, $117,000,000
120120 for construction of an interdisciplinary research facility;
121121 (10) The University of Texas at San Antonio,
122122 $115,000,000 for construction of an instructional science and
123123 engineering building;
124124 (11) The University of Texas at Tyler, $76,000,000 for
125125 construction of a STEM building;
126126 (12) The University of Texas Health Science Center at
127127 Houston, $117,000,000 for the renovation and modernization of a
128128 medical school building;
129129 (13) The University of Texas Health Science Center at
130130 Tyler, $18,500,000 for the renovation of a facility for physician
131131 residents training; and
132132 (14) The University of Texas of the Permian Basin,
133133 $60,000,000 for construction of an engineering building.
134134 (b) The board may pledge irrevocably to the payment of bonds
135135 authorized by this section all or any part of the revenue funds of
136136 an institution, branch, or entity of The University of Texas
137137 System, including student tuition charges. The amount of a pledge
138138 made under this subsection may not be reduced or abrogated while the
139139 bonds for which the pledge is made, or bonds issued to refund those
140140 bonds, are outstanding.
141141 (c) If sufficient funds are not available to the board to
142142 meet its obligations under this section, the board may transfer
143143 funds among institutions, branches, and entities of The University
144144 of Texas System to ensure the most equitable and efficient
145145 allocation of available resources for each institution, branch, or
146146 entity to carry out its duties and purposes.
147147 (d) The expanded capacity at system institutions
148148 attributable to the authorization provided for projects under
149149 Subsection (a) supports the provision of dual credit or career and
150150 technology education programs in furtherance of the goals of
151151 Chapter 211 (H.B. 5), Acts of the 83rd Legislature, Regular
152152 Session, 2013.
153153 Sec. 55.1783. UNIVERSITY OF HOUSTON SYSTEM; ADDITIONAL
154154 BONDS. (a) In addition to the other authority granted by this
155155 subchapter, the board of regents of the University of Houston
156156 System may acquire, purchase, construct, improve, renovate,
157157 enlarge, or equip property and facilities, including roads and
158158 related infrastructure, for projects to be financed through the
159159 issuance of bonds in accordance with this subchapter and in
160160 accordance with a systemwide revenue financing program adopted by
161161 the board for the following institutions or entities, not to exceed
162162 the following aggregate principal amounts for the projects
163163 specified, as follows:
164164 (1) the University of Houston:
165165 (A) $165,000,000 for construction of a health and
166166 biomedical sciences center; and
167167 (B) $91,350,000 for construction of a new
168168 academic building located in Sugar Land, Texas;
169169 (2) the University of Houston--Clear Lake:
170170 (A) $34,200,000 for construction of a health
171171 sciences and classroom building located in Pearland, Texas; and
172172 (B) $101,875,000 for construction of a STEM and
173173 classroom building;
174174 (3) the University of Houston--Downtown, $104,700,000
175175 for construction of a science and technology building;
176176 (4) the University of Houston--Victoria, $85,420,000
177177 for construction of a science, technology, and classroom building;
178178 and
179179 (5) the University of Houston System, $36,540,000 for
180180 construction of a Cinco Ranch academic building located in the area
181181 near Katy, Texas.
182182 (b) The board may pledge irrevocably to the payment of bonds
183183 authorized by this section all or any part of the revenue funds of
184184 an institution, branch, or entity of the University of Houston
185185 System, including student tuition charges. The amount of a pledge
186186 made under this subsection may not be reduced or abrogated while the
187187 bonds for which the pledge is made, or bonds issued to refund those
188188 bonds, are outstanding.
189189 (c) If sufficient funds are not available to the board to
190190 meet its obligations under this section, the board may transfer
191191 funds among institutions, branches, and entities of the University
192192 of Houston System to ensure the most equitable and efficient
193193 allocation of available resources for each institution, branch, or
194194 entity to carry out its duties and purposes.
195195 (d) The expanded capacity at system institutions
196196 attributable to the authorization provided for projects under
197197 Subsection (a) supports the provision of dual credit or career and
198198 technology education programs in furtherance of the goals of
199199 Chapter 211 (H.B. 5), Acts of the 83rd Legislature, Regular
200200 Session, 2013.
201201 Sec. 55.1784. TEXAS STATE UNIVERSITY SYSTEM; ADDITIONAL
202202 BONDS. (a) In addition to the other authority granted by this
203203 subchapter, the board of regents of the Texas State University
204204 System may acquire, purchase, construct, improve, renovate,
205205 enlarge, or equip property and facilities, including roads and
206206 related infrastructure, for projects to be financed through the
207207 issuance of bonds in accordance with this subchapter and in
208208 accordance with a systemwide revenue financing program adopted by
209209 the board for the following institutions, not to exceed the
210210 following aggregate principal amounts for the projects specified,
211211 as follows:
212212 (1) Lamar University, $81,000,000 for construction of
213213 a science and technology building;
214214 (2) Lamar State College--Orange, $12,500,000 for
215215 construction of a multipurpose education building;
216216 (3) Lamar State College--Port Arthur, $10,100,000 for
217217 expansion of technology program facilities;
218218 (4) Lamar Institute of Technology, $16,500,000 for
219219 renovation of the technical arts buildings;
220220 (5) Texas State University:
221221 (A) $107,000,000 for construction of an
222222 engineering and sciences building; and
223223 (B) $67,500,000 for construction of a medical
224224 education and research building in Round Rock, Texas;
225225 (6) Sam Houston State University, $60,000,000 for
226226 construction of a biology laboratory building; and
227227 (7) Sul Ross State University, $7,800,000 for
228228 renovation and modernization of educational and related facilities
229229 and infrastructure.
230230 (b) The board may pledge irrevocably to the payment of bonds
231231 authorized by this section all or any part of the revenue funds of
232232 an institution, branch, or entity of the Texas State University
233233 System, including student tuition charges. The amount of a pledge
234234 made under this subsection may not be reduced or abrogated while the
235235 bonds for which the pledge is made, or bonds issued to refund those
236236 bonds, are outstanding.
237237 (c) If sufficient funds are not available to the board to
238238 meet its obligations under this section, the board may transfer
239239 funds among institutions, branches, and entities of the Texas State
240240 University System to ensure the most equitable and efficient
241241 allocation of available resources for each institution, branch, or
242242 entity to carry out its duties and purposes.
243243 (d) The expanded capacity at system institutions
244244 attributable to the authorization provided for projects under
245245 Subsection (a) supports the provision of dual credit or career and
246246 technology education programs in furtherance of the goals of
247247 Chapter 211 (H.B. 5), Acts of the 83rd Legislature, Regular
248248 Session, 2013.
249249 Sec. 55.1785. UNIVERSITY OF NORTH TEXAS SYSTEM; ADDITIONAL
250250 BONDS. (a) In addition to the other authority granted by this
251251 subchapter, the board of regents of the University of North Texas
252252 System may acquire, purchase, construct, improve, renovate,
253253 enlarge, or equip property and facilities, including roads and
254254 related infrastructure, for projects to be financed through the
255255 issuance of bonds in accordance with this subchapter and in
256256 accordance with a systemwide revenue financing program adopted by
257257 the board for the following institutions or entities, not to exceed
258258 the following aggregate principal amounts for the projects
259259 specified, as follows:
260260 (1) the University of North Texas System, $101,000,000
261261 for renovation of college of law buildings;
262262 (2) the University of North Texas, $92,000,000 for
263263 construction and renovation of college of visual arts and design
264264 facilities;
265265 (3) the University of North Texas at Dallas,
266266 $70,000,000 for construction of a student learning and success
267267 center; and
268268 (4) the University of North Texas Health Science
269269 Center at Fort Worth, $121,000,000 for construction of an
270270 interdisciplinary research building.
271271 (b) The board may pledge irrevocably to the payment of bonds
272272 authorized by this section all or any part of the revenue funds of
273273 an institution, branch, or entity of the University of North Texas
274274 System, including student tuition charges. The amount of a pledge
275275 made under this subsection may not be reduced or abrogated while the
276276 bonds for which the pledge is made, or bonds issued to refund those
277277 bonds, are outstanding.
278278 (c) If sufficient funds are not available to the board to
279279 meet its obligations under this section, the board may transfer
280280 funds among institutions, branches, and entities of the University
281281 of North Texas System to ensure the most equitable and efficient
282282 allocation of available resources for each institution, branch, or
283283 entity to carry out its duties and purposes.
284284 (d) The expanded capacity at system institutions
285285 attributable to the authorization provided for projects under
286286 Subsection (a) supports the provision of dual credit or career and
287287 technology education programs in furtherance of the goals of
288288 Chapter 211 (H.B. 5), Acts of the 83rd Legislature, Regular
289289 Session, 2013.
290290 Sec. 55.1786. TEXAS WOMAN'S UNIVERSITY. (a) In addition to
291291 the other authority granted by this subchapter, the board of
292292 regents of Texas Woman's University may acquire, purchase,
293293 construct, improve, renovate, enlarge, or equip property and
294294 facilities, including roads and related infrastructure, for a
295295 science and technology learning center, to be financed through the
296296 issuance of bonds in accordance with this subchapter, not to exceed
297297 the aggregate principal amount of $51,347,200.
298298 (b) The board may pledge irrevocably to the payment of bonds
299299 authorized by this section all or any part of the revenue funds of
300300 Texas Woman's University, including student tuition charges. The
301301 amount of a pledge made under this subsection may not be reduced or
302302 abrogated while the bonds for which the pledge is made, or bonds
303303 issued to refund those bonds, are outstanding.
304304 (c) The expanded capacity at the university attributable to
305305 the authorization provided under Subsection (a) supports the
306306 provision of dual credit or career and technology education
307307 programs in furtherance of the goals of Chapter 211 (H.B. 5), Acts
308308 of the 83rd Legislature, Regular Session, 2013.
309309 Sec. 55.1787. MIDWESTERN STATE UNIVERSITY; ADDITIONAL
310310 BONDS. (a) In addition to the other authority granted by this
311311 subchapter, the board of regents of Midwestern State University may
312312 acquire, purchase, construct, improve, renovate, enlarge, or equip
313313 property and facilities, including roads and related
314314 infrastructure, for the Gunn College of Health Sciences and Human
315315 Services, to be financed through the issuance of bonds in
316316 accordance with this subchapter, not to exceed the aggregate
317317 principal amount of $61,000,000.
318318 (b) The board may pledge irrevocably to the payment of bonds
319319 authorized by this section all or any part of the revenue funds of
320320 Midwestern State University, including student tuition charges.
321321 The amount of a pledge made under this subsection may not be reduced
322322 or abrogated while the bonds for which the pledge is made, or bonds
323323 issued to refund those bonds, are outstanding.
324324 (c) The expanded capacity at the university attributable to
325325 the authorization provided under Subsection (a) supports the
326326 provision of dual credit or career and technology education
327327 programs in furtherance of the goals of Chapter 211 (H.B. 5), Acts
328328 of the 83rd Legislature, Regular Session, 2013.
329329 Sec. 55.1788. STEPHEN F. AUSTIN STATE UNIVERSITY. (a) In
330330 addition to the other authority granted by this subchapter, the
331331 board of regents of Stephen F. Austin State University may acquire,
332332 purchase, construct, improve, renovate, enlarge, or equip property
333333 and facilities, including roads and related infrastructure, for a
334334 science, technology, engineering, and mathematics research
335335 building at Stephen F. Austin State University, to be financed
336336 through the issuance of bonds in accordance with this subchapter,
337337 not to exceed the aggregate principal amount of $58,000,000.
338338 (b) The board may pledge irrevocably to the payment of bonds
339339 authorized by this section all or any part of the revenue funds of
340340 Stephen F. Austin State University, including student tuition
341341 charges. The amount of a pledge made under this subsection may not
342342 be reduced or abrogated while the bonds for which the pledge is
343343 made, or bonds issued to refund those bonds, are outstanding.
344344 (c) The expanded capacity at the university attributable to
345345 the authorization provided under Subsection (a) supports the
346346 provision of dual credit or career and technology education
347347 programs in furtherance of the goals of Chapter 211 (H.B. 5), Acts
348348 of the 83rd Legislature, Regular Session, 2013.
349349 Sec. 55.1789. TEXAS TECH UNIVERSITY SYSTEM; ADDITIONAL
350350 BONDS. (a) In addition to the other authority granted by this
351351 subchapter, the board of regents of the Texas Tech University
352352 System may acquire, purchase, construct, improve, renovate,
353353 enlarge, or equip property and facilities, including roads and
354354 related infrastructure, for projects to be financed through the
355355 issuance of bonds in accordance with this subchapter and in
356356 accordance with a systemwide revenue financing program adopted by
357357 the board for the following institutions, not to exceed the
358358 following aggregate principal amounts for the projects specified,
359359 as follows:
360360 (1) Texas Tech University Health Sciences Center:
361361 (A) $83,700,000 for renovation and expansion of
362362 Lubbock education, research, and technology facilities;
363363 (B) $19,800,000 for construction of the Permian
364364 Basin academic facility; and
365365 (C) $9,750,000 for construction of the Amarillo
366366 Panhandle Clinical/Hospital Simulation;
367367 (2) Texas Tech University Health Sciences Center at El
368368 Paso, $94,400,000 for construction of the El Paso Medical Science
369369 Building II;
370370 (3) Texas Tech University, $97,700,000 for
371371 construction of an experimental sciences building; and
372372 (4) Angelo State University, $26,700,000 for
373373 construction of a College of Health and Human Services building.
374374 (b) The board may pledge irrevocably to the payment of bonds
375375 authorized by this section all or any part of the revenue funds of
376376 an institution, branch, or entity of the Texas Tech University
377377 System, including student tuition charges. The amount of a pledge
378378 made under this subsection may not be reduced or abrogated while the
379379 bonds for which the pledge is made, or bonds issued to refund those
380380 bonds, are outstanding.
381381 (c) If sufficient funds are not available to the board to
382382 meet its obligations under this section, the board may transfer
383383 funds among institutions, branches, and entities of the Texas Tech
384384 University System to ensure the most equitable and efficient
385385 allocation of available resources for each institution, branch, or
386386 entity to carry out its duties and purposes.
387387 (d) The expanded capacity at system institutions
388388 attributable to the authorization provided for projects under
389389 Subsection (a) supports the provision of dual credit or career and
390390 technology education programs in furtherance of the goals of
391391 Chapter 211 (H.B. 5), Acts of the 83rd Legislature, Regular
392392 Session, 2013.
393393 Sec. 55.17891. TEXAS SOUTHERN UNIVERSITY; ADDITIONAL
394394 BONDS. (a) In addition to the other authority granted by this
395395 subchapter, the board of regents of Texas Southern University may
396396 acquire, purchase, construct, improve, renovate, enlarge, or equip
397397 property and facilities, including roads and related
398398 infrastructure, for the Robert J. Terry Library at Texas Southern
399399 University, to be financed through the issuance of bonds in
400400 accordance with this subchapter, not to exceed the aggregate
401401 principal amount of $70,247,859.
402402 (b) The board may pledge irrevocably to the payment of bonds
403403 authorized by this section all or any part of the revenue funds of
404404 Texas Southern University, including student tuition charges. The
405405 amount of a pledge made under this subsection may not be reduced or
406406 abrogated while the bonds for which the pledge is made, or bonds
407407 issued to refund those bonds, are outstanding.
408408 (c) The expanded capacity at the university attributable to
409409 the authorization provided under Subsection (a) supports the
410410 provision of dual credit or career and technology education
411411 programs in furtherance of the goals of Chapter 211 (H.B. 5), Acts
412412 of the 83rd Legislature, Regular Session, 2013.
413413 Sec. 55.17892. TEXAS STATE TECHNICAL COLLEGE SYSTEM. (a) In
414414 addition to the other authority granted by this subchapter, the
415415 board of regents of the Texas State Technical College System may
416416 acquire, purchase, construct, improve, renovate, enlarge, or equip
417417 property and facilities, including roads and related
418418 infrastructure, for projects to be financed through the issuance of
419419 bonds in accordance with this subchapter for the following
420420 institutions, not to exceed the following aggregate principal
421421 amounts for the projects specified, as follows:
422422 (1) Texas State Technical College--West Texas,
423423 $12,000,000 for construction of an industrial technology center in
424424 Abilene, Texas;
425425 (2) Texas State Technical College--Harlingen,
426426 $3,750,000 for Phase II of the Engineering Technology Center
427427 renovation;
428428 (3) Texas State Technical College--Marshall,
429429 $31,350,440 for construction of a North Texas extension center; and
430430 (4) Texas State Technical College--Waco, $14,950,000
431431 for construction of the Fort Bend Industrial Technology Center.
432432 (b) The board may pledge irrevocably to the payment of those
433433 bonds all or any part of the revenue funds of an institution,
434434 branch, or entity of the Texas State Technical College System,
435435 including student tuition charges. The amount of a pledge made
436436 under this subsection may not be reduced or abrogated while the
437437 bonds for which the pledge is made, or bonds issued to refund those
438438 bonds, are outstanding.
439439 (c) If sufficient funds are not available to the board to
440440 meet its obligations under this section, the board may transfer
441441 funds among institutions, branches, and entities of the Texas State
442442 Technical College System to ensure the most equitable and efficient
443443 allocation of available resources for each institution, branch, or
444444 entity to carry out its duties and purposes.
445445 (d) The expanded capacity at system institutions
446446 attributable to the authorization provided for projects under
447447 Subsection (a) supports the provision of dual credit or career and
448448 technology education programs in furtherance of the goals of
449449 Chapter 211 (H.B. 5), Acts of the 83rd Legislature, Regular
450450 Session, 2013.
451451 SECTION 2. This Act does not affect any authority or
452452 restriction regarding the activities that a public institution of
453453 higher education may conduct in connection with a facility financed
454454 by bonds authorized by this Act.
455455 SECTION 3. This Act takes effect September 1, 2015.
