10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter A, Chapter 406, Labor Code, is | |
12 | 12 | amended by adding Section 406.0025 to read as follows: | |
13 | 13 | Sec. 406.0025. LIFE INSURANCE COVERAGE REQUIRED FOR | |
14 | 14 | NONSUBSCRIBING EMPLOYERS. (a) An employer who does not obtain | |
15 | 15 | workers' compensation insurance coverage must obtain life | |
16 | 16 | insurance coverage for each employee with a death benefit of not | |
17 | 17 | less than $200,000. | |
18 | 18 | (b) An employer may not be a beneficiary of a policy | |
19 | 19 | described by Subsection (a). | |
20 | 20 | (c) Acceptance of a death benefit paid by a life insurance | |
21 | 21 | policy under this section does not affect the right of the | |
22 | 22 | beneficiary or other person to bring a civil action against the | |
23 | 23 | employer. | |
24 | 24 | (d) An employer commits an administrative violation if the | |
25 | 25 | employer fails to comply with this section. | |
26 | 26 | SECTION 2. Section 406.004(b), Labor Code, is amended to | |
27 | 27 | read as follows: | |
28 | 28 | (b) The commissioner shall prescribe forms to be used for | |
29 | 29 | the employer notification and shall require the employer to | |
30 | 30 | provide: | |
31 | 31 | (1) reasonable information to the division about the | |
32 | 32 | employer's business; and | |
33 | 33 | (2) proof of the employer's compliance with Section | |
34 | 34 | 406.0025. | |
35 | 35 | SECTION 3. This Act takes effect January 1, 2016. |
