| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 25.0811, Education Code, is amended by | |
| 11 | 11 | adding Subsection (c) to read as follows: | |
| 12 | 12 | (c) Notwithstanding Subsection (a), a board of trustees of a | |
| 13 | 13 | school district may elect for the school district to begin | |
| 14 | 14 | instruction for students for a school year on or after the third | |
| 15 | 15 | Wednesday in August if beginning instruction on or after the fourth | |
| 16 | 16 | Monday in August would result in five or fewer instructional days in | |
| 17 | 17 | the month of August. | |
| 18 | 18 | SECTION 2. This Act applies beginning with the 2015-2016 | |
| 19 | 19 | school year. | |
| 20 | 20 | SECTION 3. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2015. |
