55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to health education curriculum and instruction in public
88 schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The legislature finds that:
1111 (1) Texas led the nation in 2010 in the rate of teenage
1212 mothers who had second children, according to the Centers for
1313 Disease Control and Prevention;
1414 (2) approximately 22 percent of births in Texas by
1515 girls age 15 to 19 were repeat births in 2010, compared to 18.3
1616 percent in the United States;
1717 (3) an estimated 82 percent of teen births are
1818 unintended and cost American taxpayers approximately $9.4 billion a
1919 year and cost Texas taxpayers $1.1 billion in 2010, according to the
2020 National Campaign to Prevent Teen and Unplanned Pregnancy;
2121 (4) the only certain way to avoid the termination of an
2222 unwanted pregnancy is to prevent the unwanted pregnancy;
2323 (5) the state has a compelling state interest in
2424 ensuring that there is appropriate knowledge of how a pregnancy
2525 occurs and how a pregnancy can be avoided; and
2626 (6) according to the Centers for Disease Control and
2727 Prevention, effective strategies to prevent teen pregnancy include
2828 evidence-based teen pregnancy prevention programs that address
2929 specific protective factors based on knowledge, skills, beliefs, or
3030 attitudes related to teen pregnancy, including knowledge of sexual
3131 issues, sexually transmitted diseases, infection with human
3232 immunodeficiency virus, acquired immune deficiency syndrome,
3333 pregnancy, and methods of pregnancy prevention.
3434 SECTION 2. Section 28.004, Education Code, is amended by
3535 amending Subsection (e) and adding Subsection (o) to read as
3636 follows:
3737 (e) Any course materials and instruction relating to human
3838 sexuality, sexually transmitted diseases, or human
3939 immunodeficiency virus or acquired immune deficiency syndrome
4040 shall be selected by the board of trustees with the advice of the
4141 local school health advisory council and must:
4242 (1) be evidence-based;
4343 (2) present abstinence from sexual activity as the
4444 preferred choice of behavior in relationship to all sexual activity
4545 for unmarried persons of school age;
4646 (3) [(2)] devote more attention to abstinence from
4747 sexual activity than to any other behavior;
4848 (4) [(3)] emphasize that abstinence from sexual
4949 activity, if used consistently and correctly, is the only method
5050 that is 100 percent effective in preventing pregnancy, sexually
5151 transmitted diseases, infection with human immunodeficiency virus,
5252 [or] acquired immune deficiency syndrome, and the emotional trauma
5353 associated with adolescent sexual activity;
5454 (5) [(4)] direct adolescents to a standard of behavior
5555 in which abstinence from sexual activity before marriage is the
5656 most effective way to prevent pregnancy, sexually transmitted
5757 diseases, [and] infection with human immunodeficiency virus, and
5858 [or] acquired immune deficiency syndrome; and
5959 (6) [(5)] teach contraception and condom use in terms
6060 of human use reality rates instead of theoretical laboratory rates,
6161 if instruction on contraception and condoms is included in
6262 curriculum content.
6363 (o) In this section, "evidence-based" means information
6464 verified or supported by research that is:
6565 (1) conducted in compliance with accepted scientific
6666 methods;
6767 (2) published in peer-reviewed journals, if
6868 appropriate;
6969 (3) recognized as medically accurate, objective, and
7070 complete by mainstream professional organizations and agencies
7171 with expertise in the relevant field, including the federal Centers
7272 for Disease Control and Prevention and the United States Department
7373 of Health and Human Services; and
7474 (4) proven through rigorous scientific evaluation to
7575 achieve positive outcomes on measures of sexual risk behavior or
7676 its health consequences.
7777 SECTION 3. This Act applies beginning with the 2015-2016
7878 school year.
7979 SECTION 4. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2015.
