55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the vaccination against bacterial meningitis of public
88 school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 38.001, Education Code, is amended by
1111 adding Subsection (a-1) to read as follows:
1212 (a-1) Each student shall be fully immunized against
1313 bacterial meningitis, except as provided by Subsection (c). To
1414 satisfy the requirement of this subsection, a student must show
1515 proof of a quadrivalent meningococcal conjugate vaccine and a
1616 booster dose in accordance with the recommended immunization
1717 schedule adopted by the Department of State Health Services. The
1818 executive commissioner of the Health and Human Services Commission
1919 shall adopt rules for the implementation of this subsection.
2020 SECTION 2. Not later than December 1, 2015, the executive
2121 commissioner of the Health and Human Services Commission shall
2222 adopt the rules necessary to implement Section 38.001(a-1),
2323 Education Code, as added by this Act.
2424 SECTION 3. Section 38.001(a-1), Education Code, as added by
2525 this Act, applies beginning with the 2016-2017 school year.
2626 SECTION 4. This Act takes effect October 1, 2015.
