9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 38.001, Education Code, is amended by | |
11 | 11 | adding Subsection (a-1) to read as follows: | |
12 | 12 | (a-1) Each student shall be fully immunized against | |
13 | 13 | bacterial meningitis, except as provided by Subsection (c). To | |
14 | 14 | satisfy the requirement of this subsection, a student must show | |
15 | 15 | proof of a quadrivalent meningococcal conjugate vaccine and a | |
16 | 16 | booster dose in accordance with the recommended immunization | |
17 | 17 | schedule adopted by the Department of State Health Services. The | |
18 | 18 | executive commissioner of the Health and Human Services Commission | |
19 | 19 | shall adopt rules for the implementation of this subsection. | |
20 | 20 | SECTION 2. Not later than December 1, 2015, the executive | |
21 | 21 | commissioner of the Health and Human Services Commission shall | |
22 | 22 | adopt the rules necessary to implement Section 38.001(a-1), | |
23 | 23 | Education Code, as added by this Act. | |
24 | 24 | SECTION 3. Section 38.001(a-1), Education Code, as added by | |
25 | 25 | this Act, applies beginning with the 2016-2017 school year. | |
26 | 26 | SECTION 4. This Act takes effect October 1, 2015. |
