97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Subchapter E, Chapter 263, Family Code, is
119 amended by adding Section 263.408 to read as follows:
1210 Sec. 263.408. REQUIREMENTS FOR APPOINTMENT OF NONPARENT AS
1311 MANAGING CONSERVATOR. (a) In a suit in which the court appoints a
1412 nonparent as managing conservator of a child:
1513 (1) the department must provide the nonparent with an
1614 explanation of the differences between appointment as a managing
1715 conservator of a child and adoption of a child, including specific
1816 statements informing the nonparent that:
1917 (A) the nonparent's appointment conveys only the
2018 rights specified by the court order or applicable laws instead of
2119 the complete rights of a parent conveyed by adoption;
2220 (B) a parent may be entitled to request
2321 visitation with the child or petition the court to appoint the
2422 parent as the child's managing conservator, notwithstanding the
2523 nonparent's appointment as managing conservator; and
2624 (C) the nonparent's appointment as the child's
2725 managing conservator will not result in the eligibility of the
2826 nonparent and child for postadoption benefits; and
2927 (2) in addition to the rights and duties provided
3028 under Section 153.371, the court order appointing the nonparent as
3129 managing conservator must include provisions that address the
3230 authority of the nonparent to:
3331 (A) authorize immunization of the child or any
3432 other medical treatment that requires parental consent;
3533 (B) obtain and maintain health insurance
3634 coverage for the child and automobile insurance coverage for the
3735 child, if appropriate;
3836 (C) enroll the child in a day-care program or
3937 school, including prekindergarten;
4038 (D) authorize the child to participate in
4139 school-related or extracurricular or social activities, including
4240 athletic activities;
4341 (E) authorize the child to obtain a learner's
4442 permit, driver's license, or state-issued identification card;
4543 (F) authorize employment of the child;
4644 (G) apply for and receive public benefits for or
4745 on behalf of the child; and
4846 (H) obtain legal services for the child and
4947 execute contracts or other legal documents for the child.
5048 (b) The court must require evidence that the nonparent was
5149 informed of the rights and duties of a nonparent appointed as
5250 managing conservator of a child before the court renders an order
5351 appointing the nonparent as managing conservator of a child.
5452 SECTION 2. Section 263.408, Family Code, as added by this
5553 Act, applies to a suit affecting the parent-child relationship that
5654 is pending in a trial court on or filed on or after the effective
5755 date of this Act.
5856 SECTION 3. This Act takes effect September 1, 2015.
