1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the enforcement of certain motor vehicle weight and
1414 safety standards.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 621.402, Transportation Code, is amended
1717 by adding Subsection (e) to read as follows:
1818 (e) The Department of Public Safety:
1919 (1) shall establish by rule uniform weighing
2020 procedures for weight enforcement officers to ensure an accurate
2121 weight is obtained for a motor vehicle; and
2222 (2) may revoke or rescind the authority of:
2323 (A) a weight enforcement officer who fails to
2424 comply with those rules; or
2525 (B) weight enforcement officers of a municipal
2626 police department, sheriff's department, or constable's office that
2727 fails to comply with those rules.
2828 SECTION 2. Section 644.101(b), Transportation Code, is
2929 amended to read as follows:
3030 (b) A police officer of any of the following municipalities
3131 is eligible to apply for certification under this section:
3232 (1) a municipality with a population of 50,000 or
3333 more;
3434 (2) a municipality with a population of 25,000 or more
3535 any part of which is located in a county with a population of
3636 500,000 or more;
3737 (3) a municipality with a population of less than
3838 25,000:
3939 (A) any part of which is located in a county with
4040 a population of 3.3 million; and
4141 (B) that contains or is adjacent to an
4242 international port;
4343 (4) a municipality with a population of at least
4444 34,000 that is located in a county that borders two or more states;
4545 (5) a municipality any part of which is located in a
4646 county bordering the United Mexican States;
4747 (6) a municipality with a population of less than
4848 5,000 that is located:
4949 (A) adjacent to a bay connected to the Gulf of
5050 Mexico; and
5151 (B) in a county adjacent to a county with a
5252 population greater than 3.3 million;
5353 (7) a municipality that is located:
5454 (A) within 25 miles of an international port; and
5555 (B) in a county that does not contain a highway
5656 that is part of the national system of interstate and defense
5757 highways and is adjacent to a county with a population greater than
5858 3.3 million; [or]
5959 (8) a municipality with a population of less than
6060 8,500 that:
6161 (A) is the county seat; and
6262 (B) contains a highway that is part of the
6363 national system of interstate and defense highways; or
6464 (9) a municipality located in a county with a
6565 population between 60,000 and 66,000 adjacent to a bay connected to
6666 the Gulf of Mexico.
6767 SECTION 3. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2015.
