15 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

16 | 10 | | SECTION 1. Section 16.01(a), Alcoholic Beverage Code, is |
---|
17 | 11 | | amended to read as follows: |
---|
18 | 12 | | (a) Except as provided by Section 16.011, the holder of a |
---|
19 | 13 | | winery permit may: |
---|
20 | 14 | | (1) manufacture, bottle, label, and package wine |
---|
21 | 15 | | containing not more than 24 percent alcohol by volume; |
---|
22 | 16 | | (2) manufacture fruit brandy and: |
---|
23 | 17 | | (A) use that brandy on the winery permit holder's |
---|
24 | 18 | | permitted premises for fortifying purposes only; or |
---|
25 | 19 | | (B) sell that brandy to other winery permit |
---|
26 | 20 | | holders; |
---|
27 | 21 | | (3) import or buy fruit brandy from a permit holder |
---|
28 | 22 | | authorized to manufacture fruit brandy and use that brandy on the |
---|
29 | 23 | | winery permit holder's permitted premises for fortifying purposes |
---|
30 | 24 | | only; |
---|
31 | 25 | | (4) sell wine in this state to or buy wine from permit |
---|
32 | 26 | | holders authorized to purchase and sell wine, including holders of |
---|
33 | 27 | | wholesaler's permits, winery permits, and wine bottler's permits; |
---|
34 | 28 | | (5) sell wine to ultimate consumers[: |
---|
35 | 29 | | [(A)] for consumption on the winery premises; |
---|
36 | 30 | | (6) sell wine manufactured or bottled by the winery |
---|
37 | 31 | | permit holder to ultimate consumers in unbroken packages for |
---|
38 | 32 | | off-premises consumption in an amount not to exceed 155,000 gallons |
---|
39 | 33 | | annually; |
---|
40 | 34 | | (7) sell wine that is not manufactured or bottled by |
---|
41 | 35 | | the winery permit holder to ultimate consumers [or |
---|
42 | 36 | | [(B)] in unbroken packages for off-premises |
---|
43 | 37 | | consumption in an amount not to exceed 25,000 [35,000] gallons |

45 | 39 | | (8) [(6)] sell the wine outside this state to |

46 | 40 | | qualified persons; |

---|

---|
50 | 44 | | (11) [(9)] purchase and import wine from the holder |
---|
51 | 45 | | of a nonresident seller's permit. |
---|
52 | 46 | | SECTION 2. Section 54.02, Alcoholic Beverage Code, is |
---|
53 | 47 | | amended to read as follows: |
---|
54 | 48 | | Sec. 54.02. PROHIBITED ACTIVITIES. The holder of an |
---|
55 | 49 | | out-of-state winery direct shipper's permit may not: |
---|
56 | 50 | | (1) sell or ship wine to a minor; |
---|
57 | 51 | | (2) deliver wine to a consumer using a carrier that |
---|
58 | 52 | | does not hold a carrier's permit under this code; |
---|
59 | 53 | | (3) deliver to the same consumer in this state more |
---|
60 | 54 | | than nine gallons of wine within any calendar month or more than 36 |
---|
61 | 55 | | gallons of wine within any 12-month period; or |
---|
62 | 56 | | (4) sell to ultimate consumers more than 155,000 |
---|
63 | 57 | | [35,000] gallons of wine annually. |

64 | 58 | | SECTION 3. This Act takes effect September 1, 2015. |
