55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the duties of the General Land Office and other state
88 agencies with regard to the accounting for and management of real
99 property owned by the state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 437.154(b), Government Code, is amended
1212 to read as follows:
1313 (b) Not later than August 1 of each [the] year [in which the
1414 commissioner of the General Land Office submits a report as
1515 provided by Section 31.157, Natural Resources Code], the department
1616 shall submit a preliminary report of the report required under
1717 Subsection (a) to the commissioner of the General Land Office
1818 identifying the real property used for military purposes. Not
1919 later than September 1 of each [the] year [in which the commissioner
2020 of the General Land Office submits a report as provided by Section
2121 31.157, Natural Resources Code], the department shall submit the
2222 final report as required by Subsection (a) to:
2323 (1) the governor;
2424 (2) the presiding officer of each house of the
2525 legislature;
2626 (3) the Legislative Budget Board; and
2727 (4) the Governor's Office of Budget, Planning, and
2828 Policy [governor's budget office].
2929 SECTION 2. Sections 31.155(a) and (b), Natural Resources
3030 Code, are amended to read as follows:
3131 (a) The division is not responsible for maintaining the
3232 inventory records, as provided by Section 31.154, of the real
3333 property administered by [the Texas Department of Transportation,]
3434 an institution of higher education[, the Employees Retirement
3535 System of Texas, or the Teacher Retirement System of Texas]. The
3636 institution of higher education [agencies] administering the real
3737 property shall maintain those records.
3838 (b) An institution of higher education [The Texas
3939 Department of Transportation], on the request of the division, but
4040 not more than semiannually, shall submit its real property
4141 inventory records to the division[. The real property inventory
4242 records of an institution of higher education, the Employees
4343 Retirement System of Texas, and the Teacher Retirement System of
4444 Texas, on the request of the division, but not more than
4545 semiannually, shall be submitted to the division] for information
4646 purposes only. The division shall maintain the inventory records
4747 of the former Texas National Research Laboratory Commission, to the
4848 extent possible, and is responsible for the disposal of any real
4949 property interests held by the former commission as provided by
5050 Subchapter G.
5151 SECTION 3. Section 31.155(d), Natural Resources Code, as
5252 amended by Chapters 713 (H.B. 3436), 1153 (S.B. 211), and 1339 (S.B.
5353 894), Acts of the 83rd Legislature, Regular Session, 2013, is
5454 reenacted and amended to read as follows:
5555 (d) The duty under this subchapter of the division to review
5656 and verify real property records and to make recommendations
5757 regarding real property and of the commissioner to prepare a report
5858 involving real property does not apply to:
5959 (1) the real property of an institution of higher
6060 education;
6161 (2) the real property that is part of a fund created or
6262 specifically authorized by the constitution of this state and that
6363 is administered by or with the assistance of the land office; and
6464 (3) [the real property of the Employees Retirement
6565 System of Texas;
6666 [(4) the real property of the Teacher Retirement
6767 System of Texas; and
6868 [(5)] the real property located in the Capitol
6969 complex, as defined by Section 443.0071, Government Code
7070 [(5) the real property included in the Capitol Complex
7171 as defined by Section 411.061(a)(1), Government Code].
7272 SECTION 4. Sections 31.156(a) and (e), Natural Resources
7373 Code, are amended to read as follows:
7474 (a) The division shall review the real property inventory of
7575 each state agency annually [not less than every four years, and a
7676 review shall be made during the calendar year before the agency is
7777 scheduled for abolition under the Texas Sunset Act (Chapter 325,
7878 Government Code)]. The division may verify the accuracy of
7979 inventory records provided by an agency.
8080 (e) The [In any year that the division will evaluate real
8181 property under the management and control of the Texas Military
8282 Department, the] division shall notify the Texas Military
8383 Department [department] before the division begins an [the]
8484 evaluation of real property under the management and control of the
8585 department.
8686 SECTION 5. Section 31.157(e), Natural Resources Code, is
8787 amended to read as follows:
8888 (e) The final report shall be submitted to the governor, all
8989 members [the presiding officers of both houses] of the legislature,
9090 the Legislative Budget Board, and the Governor's Office of Budget,
9191 Planning, and Policy [governor's budget office] not later than
9292 September 1 of each year.
9393 SECTION 6. Section 31.155(c), Natural Resources Code, is
9494 repealed.
9595 SECTION 7. The change in law made by this Act applies only
9696 to a final report required to be submitted under Section 31.157,
9797 Natural Resources Code, after the effective date of this Act. A
9898 report required to be submitted on or before the effective date of
9999 this Act is governed by the law in effect immediately preceding the
100100 effective date of this Act, and that law is continued in effect for
101101 that purpose.
102102 SECTION 8. This Act takes effect September 1, 2015.
