6	6	AN ACT
7	7	relating to the duties of the General Land Office and other state
8	8	agencies with regard to the accounting for and management of real
9	9	property owned by the state.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 437.154(b), Government Code, is amended
12	12	to read as follows:
13	13	(b) Not later than August 1 of each [the] year [in which the
14	14	commissioner of the General Land Office submits a report as
15	15	provided by Section 31.157, Natural Resources Code], the department
16	16	shall submit a preliminary report of the report required under
17	17	Subsection (a) to the commissioner of the General Land Office
18	18	identifying the real property used for military purposes. Not
19	19	later than September 1 of each [the] year [in which the commissioner
20	20	of the General Land Office submits a report as provided by Section
21	21	31.157, Natural Resources Code], the department shall submit the
22	22	final report as required by Subsection (a) to:
23	23	(1) the governor;
24	24	(2) the presiding officer of each house of the
25	25	legislature;
26	26	(3) the Legislative Budget Board; and
27	27	(4) the Governor's Office of Budget, Planning, and
28	28	Policy [governor's budget office].
29	29	SECTION 2. Sections 31.155(a) and (b), Natural Resources
30	30	Code, are amended to read as follows:
31	31	(a) The division is not responsible for maintaining the
32	32	inventory records, as provided by Section 31.154, of the real
33	33	property administered by [the Texas Department of Transportation,]
34	34	an institution of higher education[, the Employees Retirement
35	35	System of Texas, or the Teacher Retirement System of Texas]. The
36	36	institution of higher education [agencies] administering the real
37	37	property shall maintain those records.
38	38	(b) An institution of higher education [The Texas
39	39	Department of Transportation], on the request of the division, but
40	40	not more than semiannually, shall submit its real property
41	41	inventory records to the division[. The real property inventory
42	42	records of an institution of higher education, the Employees
43	43	Retirement System of Texas, and the Teacher Retirement System of
44	44	Texas, on the request of the division, but not more than
45	45	semiannually, shall be submitted to the division] for information
46	46	purposes only. The division shall maintain the inventory records
47	47	of the former Texas National Research Laboratory Commission, to the
48	48	extent possible, and is responsible for the disposal of any real
49	49	property interests held by the former commission as provided by
50	50	Subchapter G.
51	51	SECTION 3. Section 31.155(d), Natural Resources Code, as
52	52	amended by Chapters 713 (H.B. 3436), 1153 (S.B. 211), and 1339 (S.B.
53	53	894), Acts of the 83rd Legislature, Regular Session, 2013, is
54	54	reenacted and amended to read as follows:
55	55	(d) The duty under this subchapter of the division to review
56	56	and verify real property records and to make recommendations
57	57	regarding real property and of the commissioner to prepare a report
58	58	involving real property does not apply to:
59	59	(1) the real property of an institution of higher
60	60	education;
61	61	(2) the real property that is part of a fund created or
62	62	specifically authorized by the constitution of this state and that
63	63	is administered by or with the assistance of the land office; and
64	64	(3) [the real property of the Employees Retirement
65	65	System of Texas;
66	66	[(4) the real property of the Teacher Retirement
67	67	System of Texas; and
68	68	[(5)] the real property located in the Capitol
69	69	complex, as defined by Section 443.0071, Government Code
70	70	[(5) the real property included in the Capitol Complex
71	71	as defined by Section 411.061(a)(1), Government Code].
72	72	SECTION 4. Sections 31.156(a) and (e), Natural Resources
73	73	Code, are amended to read as follows:
74	74	(a) The division shall review the real property inventory of
75	75	each state agency annually [not less than every four years, and a
76	76	review shall be made during the calendar year before the agency is
77	77	scheduled for abolition under the Texas Sunset Act (Chapter 325,
78	78	Government Code)]. The division may verify the accuracy of
79	79	inventory records provided by an agency.
80	80	(e) The [In any year that the division will evaluate real
81	81	property under the management and control of the Texas Military
82	82	Department, the] division shall notify the Texas Military
83	83	Department [department] before the division begins an [the]
84	84	evaluation of real property under the management and control of the
85	85	department.
86	86	SECTION 5. Section 31.157(e), Natural Resources Code, is
87	87	amended to read as follows:
88	88	(e) The final report shall be submitted to the governor, all
89	89	members [the presiding officers of both houses] of the legislature,
90	90	the Legislative Budget Board, and the Governor's Office of Budget,
91	91	Planning, and Policy [governor's budget office] not later than
92	92	September 1 of each year.
93	93	SECTION 6. Section 31.155(c), Natural Resources Code, is
94	94	repealed.
95	95	SECTION 7. The change in law made by this Act applies only
96	96	to a final report required to be submitted under Section 31.157,
97	97	Natural Resources Code, after the effective date of this Act. A
98	98	report required to be submitted on or before the effective date of
99	99	this Act is governed by the law in effect immediately preceding the
100	100	effective date of this Act, and that law is continued in effect for
101	101	that purpose.
102	102	SECTION 8. This Act takes effect September 1, 2015.
