66 AN ACT
77 relating to requiring the Texas Higher Education Coordinating Board
88 to maintain an inventory of postsecondary educational programs and
99 services for persons with intellectual and developmental
1010 disabilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1313 amended by adding Section 61.0663 to read as follows:
1414 Sec. 61.0663. INVENTORY OF POSTSECONDARY EDUCATIONAL
1515 PROGRAMS AND SERVICES FOR PERSONS WITH INTELLECTUAL AND
1616 DEVELOPMENTAL DISABILITIES. (a) The board shall maintain an
1717 inventory of all postsecondary educational programs and services
1818 provided for persons with intellectual and developmental
1919 disabilities by institutions of higher education.
2020 (b) The board shall:
2121 (1) post the inventory on the board's Internet website
2222 in an easily identifiable and accessible location;
2323 (2) submit the inventory to the Texas Education Agency
2424 for inclusion in the transition and employment guide under Section
2525 29.0112; and
2626 (3) update the inventory at least once every two
2727 years.
2828 (c) At times prescribed by the board, each institution of
2929 higher education shall report to the board all programs and
3030 services described by Subsection (a) provided by that institution.
3131 SECTION 2. Section 29.0112(b), Education Code, is amended
3232 to read as follows:
3333 (b) The transition and employment guide must contain
3434 information specific to this state regarding:
3535 (1) transition services;
3636 (2) employment and supported employment services;
3737 (3) social security programs;
3838 (4) community and long-term services and support;
3939 (5) postsecondary educational programs and services,
4040 including the inventory maintained by the Texas Higher Education
4141 Coordinating Board under Section 61.0663;
4242 (6) information sharing with health and human services
4343 agencies and providers;
4444 (7) guardianship and alternatives to guardianship;
4545 (8) self-advocacy, person-directed planning, and
4646 self-determination; and
4747 (9) contact information for all relevant state
4848 agencies.
4949 SECTION 3. The Texas Higher Education Coordinating Board
5050 shall compile the inventory required by Section 61.0663, Education
5151 Code, as added by this Act, not later than September 1, 2016. The
5252 Texas Education Agency shall comply with Section 29.0112(b)(5),
5353 Education Code, as amended by this Act, as soon as practicable after
5454 the inventory is available.
5555 SECTION 4. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2015.
