8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 8.01(a), Penal Code, is amended to read | |
10 | 10 | as follows: | |
11 | 11 | (a) It is an affirmative defense to prosecution that, at the | |
12 | 12 | time of the conduct charged, the actor, as a result of severe mental | |
13 | 13 | disease or defect, did not appreciate [know] that the actor's [his] | |
14 | 14 | conduct was either legally or morally wrong. | |
15 | 15 | SECTION 2. The change in law made by this Act in amending | |
16 | 16 | Section 8.01(a), Penal Code, applies only to a defendant acquitted | |
17 | 17 | of an offense committed on or after the effective date of this Act. | |
18 | 18 | A defendant acquitted of an offense committed before the effective | |
19 | 19 | date of this Act is covered by the law in effect when the offense was | |
20 | 20 | committed, and the former law is continued in effect for that | |
21 | 21 | purpose. For purposes of this section, an offense was committed | |
22 | 22 | before the effective date of this Act if any element of the offense | |
23 | 23 | occurred before that date. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2015. |
