| 7 | 7 | | relating to the first day of instruction in certain school |

| 8 | 8 | | districts. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 25.0811(a), Education Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) Except as provided by this section, a school district |
|---|
| 13 | 13 | | may not begin instruction for students for a school year before the |
|---|
| 14 | 14 | | fourth Monday in August. A school district may: |
|---|
| 15 | 15 | | (1) begin instruction for students for a school year |
|---|
| 16 | 16 | | before the fourth Monday in August if the district operates a |
|---|
| 17 | 17 | | year-round system under Section 25.084; [or] |
|---|
| 18 | 18 | | (2) begin instruction for students for a school year |
|---|
| 19 | 19 | | on or after the first Monday in August at a campus or at not more |
|---|
| 20 | 20 | | than 20 percent of the campuses in the district if: |
|---|
| 21 | 21 | | (A) the district has a student enrollment of |
|---|
| 22 | 22 | | 190,000 or more; |
|---|
| 23 | 23 | | (B) the district at the beginning of the school |
|---|
| 24 | 24 | | year provides, financed with local funds, days of instruction for |
|---|
| 25 | 25 | | students at the campus or at each of the multiple campuses, in |
|---|
| 26 | 26 | | addition to the minimum number of days of instruction required |
|---|
| 27 | 27 | | under Section 25.081; |
|---|
| 28 | 28 | | (C) the campus or each of the multiple campuses |
|---|
| 29 | 29 | | are undergoing comprehensive reform, as determined by the board of |
|---|
| 30 | 30 | | trustees of the district; and |
|---|
| 31 | 31 | | (D) a majority of the students at the campus or at |
|---|
| 32 | 32 | | each of the multiple campuses are educationally disadvantaged; or |
|---|
| 33 | 33 | | (3) begin instruction for students for a school year |
|---|
| 34 | 34 | | on or after the second Monday in August if the district has a |
|---|
| 35 | 35 | | student enrollment of fewer than 32,000 and is located in a county |
|---|
| 36 | 36 | | with a population of less than 300,000. |
|---|
| 37 | 37 | | SECTION 2. This Act applies beginning with the 2015-2016 |
|---|
| 38 | 38 | | school year. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2015. |
