66 AN ACT
77 relating to the first day of instruction in certain school
88 districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.0811(a), Education Code, is amended
1111 to read as follows:
1212 (a) Except as provided by this section, a school district
1313 may not begin instruction for students for a school year before the
1414 fourth Monday in August. A school district may:
1515 (1) begin instruction for students for a school year
1616 before the fourth Monday in August if the district operates a
1717 year-round system under Section 25.084; [or]
1818 (2) begin instruction for students for a school year
1919 on or after the first Monday in August at a campus or at not more
2020 than 20 percent of the campuses in the district if:
2121 (A) the district has a student enrollment of
2222 190,000 or more;
2323 (B) the district at the beginning of the school
2424 year provides, financed with local funds, days of instruction for
2525 students at the campus or at each of the multiple campuses, in
2626 addition to the minimum number of days of instruction required
2727 under Section 25.081;
2828 (C) the campus or each of the multiple campuses
2929 are undergoing comprehensive reform, as determined by the board of
3030 trustees of the district; and
3131 (D) a majority of the students at the campus or at
3232 each of the multiple campuses are educationally disadvantaged; or
3333 (3) begin instruction for students for a school year
3434 on or after the second Monday in August if the district has a
3535 student enrollment of fewer than 32,000 and is located in a county
3636 with a population of less than 300,000.
3737 SECTION 2. This Act applies beginning with the 2015-2016
3838 school year.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2015.
