| 7 | 7 | | relating to allowing the holder of a brewpub license to sell ale and |

| 8 | 8 | | malt liquor to certain wholesalers. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 19.01, Alcoholic Beverage Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 19.01. AUTHORIZED ACTIVITIES. The holder of a |
|---|
| 13 | 13 | | wholesaler's permit may: |
|---|
| 14 | 14 | | (1) purchase and import liquor from distillers, |
|---|
| 15 | 15 | | brewers, wineries, wine bottlers, rectifiers, and manufacturers |
|---|
| 16 | 16 | | who are holders of nonresident seller's permits or from their |
|---|
| 17 | 17 | | agents who hold manufacturer's agents permits; |
|---|
| 18 | 18 | | (2) purchase ale and malt liquor from holders of |
|---|
| 19 | 19 | | brewpub licenses; |
|---|
| 20 | 20 | | (3) purchase liquor from other wholesalers in the |
|---|
| 21 | 21 | | state; |
|---|
| 22 | 22 | | (4) [(3)] sell liquor in the original containers in |
|---|
| 23 | 23 | | which it is received to retailers and wholesalers in this state |
|---|
| 24 | 24 | | authorized to sell the liquor; |
|---|
| 25 | 25 | | (5) [(4)] sell liquor to qualified persons outside the |
|---|
| 26 | 26 | | state; and |
|---|
| 27 | 27 | | (6) [(5)] sell ale and malt liquor to a holder of a |
|---|
| 28 | 28 | | private club registration permit. |

| 29 | 29 | | SECTION 2. Section 21.01, Alcoholic Beverage Code, is |
|---|
| 30 | 30 | | amended to read as follows: |
|---|
| 31 | 31 | | Sec. 21.01. AUTHORIZED ACTIVITIES. The holder of a local |
|---|
| 32 | 32 | | class B wholesaler's permit may: |
|---|
| 33 | 33 | | (1) purchase and import malt and vinous liquors from |
|---|
| 34 | 34 | | brewers, wineries, rectifiers, and wine manufacturers and bottlers |
|---|
| 35 | 35 | | who are holders of nonresident seller's permits and from their |
|---|
| 36 | 36 | | agents who are holders of manufacturer's agent permits; |
|---|
| 37 | 37 | | (2) purchase malt and vinous liquors from holders of |
|---|
| 38 | 38 | | brewer's permits, holders of brewpub licenses, and [from] other |
|---|
| 39 | 39 | | wholesalers in the state; |
|---|
| 40 | 40 | | (3) sell the malt and vinous liquors, in the original |
|---|
| 41 | 41 | | containers in which the permit holder [he] receives them, to |
|---|
| 42 | 42 | | general and local class B wholesaler's permittees and, in the |
|---|
| 43 | 43 | | permit holder's [his] county of residence, to local distributor's |
|---|
| 44 | 44 | | permittees and retailers, including mixed beverage permittees and |
|---|
| 45 | 45 | | daily temporary mixed beverage permittees; and |
|---|
| 46 | 46 | | (4) sell ale and malt liquor to a holder of a private |
|---|
| 47 | 47 | | club registration permit. |
|---|
| 48 | 48 | | SECTION 3. Section 74.10(a), Alcoholic Beverage Code, is |
|---|
| 49 | 49 | | amended to read as follows: |
|---|
| 50 | 50 | | (a) In addition to the activities authorized by Section |
|---|
| 51 | 51 | | 74.01, the holder of a brewpub license may sell ale and malt liquor |
|---|
| 52 | 52 | | to the holder of a wholesaler's permit, a general class B |
|---|
| 53 | 53 | | wholesaler's permit, or a local class B wholesaler's permit. |
|---|
| 54 | 54 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 58 | 58 | | Act takes effect September 1, 2015. |
