64 AN ACT
75 relating to the powers and duties of a county treasurer.
86 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
97 SECTION 1. Section 602.002, Government Code, is amended to
108 read as follows:
119 Sec. 602.002. OATH MADE IN TEXAS. An oath made in this
1210 state may be administered and a certificate of the fact given by:
1311 (1) a judge, retired judge, or clerk of a municipal
1412 court;
1513 (2) a judge, retired judge, senior judge, clerk, or
1614 commissioner of a court of record;
1715 (3) a justice of the peace or a clerk of a justice
1816 court;
1917 (4) an associate judge, magistrate, master, referee,
2018 or criminal law hearing officer;
2119 (5) a notary public;
2220 (6) a member of a board or commission created by a law
2321 of this state, in a matter pertaining to a duty of the board or
2422 commission;
2523 (7) a person employed by the Texas Ethics Commission
2624 who has a duty related to a report required by Title 15, Election
2725 Code, in a matter pertaining to that duty;
2826 (8) a county tax assessor-collector or an employee of
2927 the county tax assessor-collector if the oath relates to a document
3028 that is required or authorized to be filed in the office of the
3129 county tax assessor-collector;
3230 (9) the secretary of state or a former secretary of
3331 state;
3432 (10) an employee of a personal bond office, or an
3533 employee of a county, who is employed to obtain information
3634 required to be obtained under oath if the oath is required or
3735 authorized by Article 17.04 or by Article 26.04(n) or (o), Code of
3836 Criminal Procedure;
3937 (11) the lieutenant governor or a former lieutenant
4038 governor;
4139 (12) the speaker of the house of representatives or a
4240 former speaker of the house of representatives;
4341 (13) the governor or a former governor;
4442 (14) a legislator or retired legislator;
4543 (15) the attorney general or a former attorney
4644 general;
4745 (16) the secretary or clerk of a municipality in a
4846 matter pertaining to the official business of the municipality;
4947 [or]
5048 (17) a peace officer described by Article 2.12, Code
5149 of Criminal Procedure, if:
5250 (A) the oath is administered when the officer is
5351 engaged in the performance of the officer's duties; and
5452 (B) the administration of the oath relates to the
5553 officer's duties; or
5654 (18) a county treasurer.
5755 SECTION 2. Section 83.003(a), Local Government Code, is
5856 amended to read as follows:
5957 (a) A [person first takes office as] county treasurer must
6058 successfully complete an introductory course of instruction in the
6159 performance of the duties of county treasurer:
6260 (1) within one year after the date on which the person
6361 is first elected [takes office] if elected to a full term; or
6462 (2) at the earliest available date after appointment
6563 or election, as applicable, if appointed by the commissioners court
6664 or elected to an unexpired term of county treasurer.
6765 SECTION 3. This Act takes effect September 1, 2015.
