| 7 | 7 | | relating to the amount of financial assistance paid to the |

| 8 | 8 | | survivors of certain law enforcement officers, firefighters, and |
|---|
| 9 | 9 | | other public employees killed in the line of duty. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 615.022, Government Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | Sec. 615.022. PAYMENT TO SURVIVORS. (a) If there is an |
|---|
| 14 | 14 | | eligible surviving spouse, the state shall pay $500,000 [$250,000] |
|---|
| 15 | 15 | | to the eligible surviving spouse. |
|---|
| 16 | 16 | | (b) If there is no eligible surviving spouse, the state |
|---|
| 17 | 17 | | shall pay $500,000 [$250,000] in equal shares to surviving |
|---|
| 18 | 18 | | children. |
|---|
| 19 | 19 | | (c) If there is no eligible surviving spouse or child, the |
|---|
| 20 | 20 | | state shall pay $500,000 [$250,000] in equal shares to surviving |
|---|
| 21 | 21 | | parents. |
|---|
| 22 | 22 | | SECTION 2. Section 615.023(a), Government Code, is amended |
|---|
| 23 | 23 | | to read as follows: |
|---|
| 24 | 24 | | (a) The state shall pay to the duly appointed or qualified |
|---|
| 25 | 25 | | guardian or other legal representative of an eligible surviving |
|---|
| 26 | 26 | | minor child: |
|---|
| 27 | 27 | | (1) $400 [$200] each month, if there is one surviving |
|---|
| 28 | 28 | | child; |
|---|
| 29 | 29 | | (2) $600 [$300] each month, if there are two surviving |
|---|
| 30 | 30 | | children; or |
|---|
| 31 | 31 | | (3) $800 [$400] each month, if there are three or more |
|---|
| 32 | 32 | | surviving children. |
|---|
| 33 | 33 | | SECTION 3. The changes in law made by this Act relating to |
|---|
| 34 | 34 | | the death of certain public servants apply only in relation to a |
|---|
| 35 | 35 | | death that occurs on or after September 1, 2015. Matters regarding |
|---|
| 36 | 36 | | eligibility, payment, and other benefits in relation to a death |
|---|
| 37 | 37 | | that occurs before September 1, 2015, are governed by the law in |
|---|
| 38 | 38 | | effect when the death occurs, and the former law is continued in |
|---|
| 39 | 39 | | effect for that purpose. |

| 40 | 40 | | SECTION 4. This Act takes effect September 1, 2015. |
