55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the operation and movement of motorcycles on certain
88 highways during periods of traffic congestion.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 545.060, Transportation Code, is amended
1111 by amending Subsection (a) and adding Subsection (e) to read as
1212 follows:
1313 (a) An operator on a roadway divided into two or more
1414 clearly marked lanes for traffic:
1515 (1) shall drive as nearly as practical entirely within
1616 a single lane, except as provided by Subsection (e); and
1717 (2) may not move from the lane unless that movement can
1818 be made safely.
1919 (e) The operator of a motorcycle operating on a
2020 limited-access or controlled-access highway may operate the
2121 motorcycle for a safe distance between lanes of traffic moving in
2222 the same direction during periods of traffic congestion if the
2323 operator operates the motorcycle:
2424 (1) at a speed not more than five miles per hour
2525 greater than the speed of the other traffic; and
2626 (2) in traffic that is moving at a speed of 20 miles
2727 per hour or less.
2828 SECTION 2. This Act takes effect September 1, 2015.
