9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 545.060, Transportation Code, is amended | |
11 | 11 | by amending Subsection (a) and adding Subsection (e) to read as | |
12 | 12 | follows: | |
13 | 13 | (a) An operator on a roadway divided into two or more | |
14 | 14 | clearly marked lanes for traffic: | |
15 | 15 | (1) shall drive as nearly as practical entirely within | |
16 | 16 | a single lane, except as provided by Subsection (e); and | |
17 | 17 | (2) may not move from the lane unless that movement can | |
18 | 18 | be made safely. | |
19 | 19 | (e) The operator of a motorcycle operating on a | |
20 | 20 | limited-access or controlled-access highway may operate the | |
21 | 21 | motorcycle for a safe distance between lanes of traffic moving in | |
22 | 22 | the same direction during periods of traffic congestion if the | |
23 | 23 | operator operates the motorcycle: | |
24 | 24 | (1) at a speed not more than five miles per hour | |
25 | 25 | greater than the speed of the other traffic; and | |
26 | 26 | (2) in traffic that is moving at a speed of 20 miles | |
27 | 27 | per hour or less. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2015. |
