55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to eliminating certain state-required assessment
88 instruments administered to public school students in certain
99 grades.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 39.023(a), Education Code, as effective
1212 until on or before September 1, 2015, is amended to read as follows:
1313 (a) The agency shall adopt or develop appropriate
1414 criterion-referenced assessment instruments designed to assess
1515 essential knowledge and skills in reading, [writing,] mathematics,
1616 [social studies,] and science. Except as provided by Subsection
1717 (a-2), all students, other than students assessed under Subsection
1818 (b) or (l) or exempted under Section 39.027, shall be assessed in:
1919 (1) mathematics, annually in grades three through
2020 seven without the aid of technology and in grade eight with the aid
2121 of technology on any assessment instrument that includes algebra;
2222 (2) reading, annually in grades three through eight;
2323 (3) [writing, including spelling and grammar, in
2424 grades four and seven;
2525 [(4) social studies, in grade eight;
2626 [(5)] science, in grades five and eight; and
2727 (4) [(6)] any other subject and grade required by
2828 federal law.
2929 SECTION 2. Section 39.023(a), Education Code, as effective
3030 on or before September 1, 2015, is amended to read as follows:
3131 (a) The agency shall adopt or develop appropriate
3232 criterion-referenced assessment instruments designed to assess
3333 essential knowledge and skills in reading, [writing,] mathematics,
3434 [social studies,] and science. Except as provided by Subsection
3535 (a-2), all students, other than students assessed under Subsection
3636 (b) or (l) or exempted under Section 39.027, shall be assessed in:
3737 (1) mathematics, in grades three and five without the
3838 aid of technology and in grade eight with the aid of technology on
3939 any assessment instrument that includes algebra;
4040 (2) reading, in grades three, five, and eight; and
4141 (3) [writing, including spelling and grammar, in
4242 grades four and seven;
4343 [(4) social studies, in grade eight; and
4444 [(5)] science, in grades five and eight.
4545 SECTION 3. Section 39.023(a), Education Code, as effective
4646 September 1, 2017, is amended to read as follows:
4747 (a) The agency shall adopt or develop appropriate
4848 criterion-referenced assessment instruments designed to assess
4949 essential knowledge and skills in reading, [writing,] mathematics,
5050 [social studies,] and science. Except as provided by Subsection
5151 (a-2), all students, other than students assessed under Subsection
5252 (b) or (l) or exempted under Section 39.027, shall be assessed in:
5353 (1) mathematics, annually in grades three through
5454 seven without the aid of technology and in grade eight with the aid
5555 of technology on any assessment instrument that includes algebra;
5656 (2) reading, annually in grades three through eight;
5757 (3) [writing, including spelling and grammar, in
5858 grades four and seven;
5959 [(4) social studies, in grade eight;
6060 [(5)] science, in grades five and eight; and
6161 (4) [(6)] any other subject and grade required by
6262 federal law.
6363 SECTION 4. This Act applies beginning with the 2015-2016
6464 school year.
6565 SECTION 5. This Act takes effect immediately if it receives
6666 a vote of two-thirds of all the members elected to each house, as
6767 provided by Section 39, Article III, Texas Constitution. If this
6868 Act does not receive the vote necessary for immediate effect, this
6969 Act takes effect September 1, 2015.
