6	6	AN ACT
7	7	relating to eliminating certain state-required assessment
8	8	instruments administered to public school students in certain
9	9	grades.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 39.023(a), Education Code, as effective
12	12	until on or before September 1, 2015, is amended to read as follows:
13	13	(a) The agency shall adopt or develop appropriate
14	14	criterion-referenced assessment instruments designed to assess
15	15	essential knowledge and skills in reading, [writing,] mathematics,
16	16	[social studies,] and science. Except as provided by Subsection
17	17	(a-2), all students, other than students assessed under Subsection
18	18	(b) or (l) or exempted under Section 39.027, shall be assessed in:
19	19	(1) mathematics, annually in grades three through
20	20	seven without the aid of technology and in grade eight with the aid
21	21	of technology on any assessment instrument that includes algebra;
22	22	(2) reading, annually in grades three through eight;
23	23	(3) [writing, including spelling and grammar, in
24	24	grades four and seven;
25	25	[(4) social studies, in grade eight;
26	26	[(5)] science, in grades five and eight; and
27	27	(4) [(6)] any other subject and grade required by
28	28	federal law.
29	29	SECTION 2. Section 39.023(a), Education Code, as effective
30	30	on or before September 1, 2015, is amended to read as follows:
31	31	(a) The agency shall adopt or develop appropriate

51	51	(a-2), all students, other than students assessed under Subsection
52	52	(b) or (l) or exempted under Section 39.027, shall be assessed in:
53	53	(1) mathematics, annually in grades three through
54	54	seven without the aid of technology and in grade eight with the aid
55	55	of technology on any assessment instrument that includes algebra;
56	56	(2) reading, annually in grades three through eight;
57	57	(3) [writing, including spelling and grammar, in
58	58	grades four and seven;
59	59	[(4) social studies, in grade eight;
60	60	[(5)] science, in grades five and eight; and
61	61	(4) [(6)] any other subject and grade required by
62	62	federal law.
63	63	SECTION 4. This Act applies beginning with the 2015-2016
64	64	school year.
65	65	SECTION 5. This Act takes effect immediately if it receives
66	66	a vote of two-thirds of all the members elected to each house, as
67	67	provided by Section 39, Article III, Texas Constitution. If this
68	68	Act does not receive the vote necessary for immediate effect, this
69	69	Act takes effect September 1, 2015.
