9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 28, Education Code, is |
---|
11 | 11 | | amended by adding Section 28.0081 to read as follows: |

12 | 12 | | Sec. 28.0081. ADMINISTRATION OF ASSESSMENT INSTRUMENT FOR |
---|
13 | 13 | | DIAGNOSTIC PURPOSES. Not later than April 1 of each school year, a |
---|
14 | 14 | | school district shall administer an assessment instrument |
---|
15 | 15 | | designated by the Texas Higher Education Coordinating Board under |
---|
16 | 16 | | Section 51.3062(c) to each student in the district enrolled in the |
---|
17 | 17 | | 10th grade. A student's performance on the assessment instrument |
---|
18 | 18 | | may only be used for diagnostic purposes, including a determination |
---|
19 | 19 | | as to whether a student should be enrolled in developmental |
---|
20 | 20 | | education courses. If a student is in a special education program |
---|
21 | 21 | | under Subchapter A, Chapter 29, the student's admission, review, |
---|
22 | 22 | | and dismissal committee shall determine if it is appropriate for |
---|
23 | 23 | | the student to be administered the assessment instrument required |
---|
24 | 24 | | under this section. |
---|
25 | 25 | | SECTION 2. This Act applies beginning with the 2015-2016 |
---|
26 | 26 | | school year. |
---|
27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
---|
28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
---|
29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
---|
31 | 31 | | Act takes effect September 1, 2015. |
