77 relating to administering the Texas Success Initiative assessment
88 instrument to certain public school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 28, Education Code, is
1111 amended by adding Section 28.0081 to read as follows:
1212 Sec. 28.0081. ADMINISTRATION OF ASSESSMENT INSTRUMENT FOR
1313 DIAGNOSTIC PURPOSES. Not later than April 1 of each school year, a
1414 school district shall administer an assessment instrument
1515 designated by the Texas Higher Education Coordinating Board under
1616 Section 51.3062(c) to each student in the district enrolled in the
1717 10th grade. A student's performance on the assessment instrument
1818 may only be used for diagnostic purposes, including a determination
1919 as to whether a student should be enrolled in developmental
2020 education courses. If a student is in a special education program
2121 under Subchapter A, Chapter 29, the student's admission, review,
2222 and dismissal committee shall determine if it is appropriate for
2323 the student to be administered the assessment instrument required
2424 under this section.
2525 SECTION 2. This Act applies beginning with the 2015-2016
2626 school year.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2015.
