77 relating to the eligibility of certain persons for the supplemental
88 nutrition assistance program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1111 is amended by adding Section 33.018 to read as follows:
1212 Sec. 33.018. INAPPLICABILITY OF CERTAIN FEDERAL LAW IN
1313 DETERMINING ELIGIBILITY. As authorized by 21 U.S.C. Section
1414 862a(d)(1)(A), 21 U.S.C. Section 862a(a) does not apply in
1515 determining the eligibility of a person for the supplemental
1616 nutrition assistance program.
1717 SECTION 2. The changes in law made by this Act apply only to
1818 a determination of eligibility of a person for supplemental
1919 nutrition assistance benefits made on or after the effective date
2020 of this Act. A determination of eligibility made before the
2121 effective date of this Act is governed by the law in effect on the
2222 date the determination was made, and the former law is continued in
2323 effect for that purpose.
2424 SECTION 3. If before implementing any provision of this Act
2525 a state agency determines that a waiver or authorization from a
2626 federal agency is necessary for implementation of that provision,
2727 the agency affected by the provision shall request the waiver or
2828 authorization and may delay implementing that provision until the
2929 waiver or authorization is granted.
3030 SECTION 4. This Act takes effect September 1, 2015.
