55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of human sexuality and family planning
88 instruction in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.004, Education Code, is amended by
1111 adding Subsections (e-1) and (e-2) to read as follows:
1212 (e-1) An entity or individual that performs abortions or an
1313 affiliate of an entity or individual that performs abortions may
1414 not provide human sexuality or family planning instruction or
1515 instructional materials for use in human sexuality or family
1616 planning instruction in a public school.
1717 (e-2) For purposes of Subsection (e-1), "affiliate" means
1818 an entity or individual that:
1919 (1) has a legal relationship with another entity or
2020 individual that is created or governed by at least one written
2121 instrument that demonstrates:
2222 (A) common ownership, management, or control;
2323 (B) the existence of a franchise; or
2424 (C) the granting or extension of a license or
2525 other agreement that authorizes the affiliate to use the entity's
2626 or individual's brand name, trademark, service mark, or other
2727 registered identification mark; or
2828 (2) may receive a financial benefit from the
2929 instruction or instructional materials.
3030 SECTION 2. This Act applies beginning with the 2015-2016
3131 school year.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2015.
