| 7 | 7 | | relating to the provision of human sexuality and family planning |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 28.004, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsections (e-1) and (e-2) to read as follows: |
|---|
| 12 | 12 | | (e-1) An entity or individual that performs abortions or an |
|---|
| 13 | 13 | | affiliate of an entity or individual that performs abortions may |
|---|
| 14 | 14 | | not provide human sexuality or family planning instruction or |
|---|
| 15 | 15 | | instructional materials for use in human sexuality or family |
|---|
| 16 | 16 | | planning instruction in a public school. |
|---|
| 17 | 17 | | (e-2) For purposes of Subsection (e-1), "affiliate" means |
|---|
| 18 | 18 | | an entity or individual that: |
|---|
| 19 | 19 | | (1) has a legal relationship with another entity or |
|---|
| 20 | 20 | | individual that is created or governed by at least one written |
|---|
| 21 | 21 | | instrument that demonstrates: |
|---|
| 22 | 22 | | (A) common ownership, management, or control; |
|---|
| 23 | 23 | | (B) the existence of a franchise; or |
|---|
| 24 | 24 | | (C) the granting or extension of a license or |
|---|
| 25 | 25 | | other agreement that authorizes the affiliate to use the entity's |
|---|
| 26 | 26 | | or individual's brand name, trademark, service mark, or other |
|---|
| 27 | 27 | | registered identification mark; or |
|---|
| 28 | 28 | | (2) may receive a financial benefit from the |
|---|
| 29 | 29 | | instruction or instructional materials. |
|---|
| 30 | 30 | | SECTION 2. This Act applies beginning with the 2015-2016 |
|---|
| 31 | 31 | | school year. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2015. |
