66 AN ACT
77 relating to the use of radio frequency identification technology to
88 transmit information regarding public school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 25, Education Code, is
1111 amended by adding Section 25.902 to read as follows:
1212 Sec. 25.902. CERTAIN MANDATORY STUDENT IDENTIFICATION
1313 METHODS PROHIBITED. (a) In this section, "active radio frequency
1414 identification technology" means a wireless identification system
1515 that uses a transmitter and a battery or other active power source
1616 to broadcast an electromagnetic radio frequency signal to transmit
1717 data without physical contact between a card, badge, or tag and
1818 another device.
1919 (b) A school district may not require a student to use an
2020 identification device that uses active radio frequency
2121 identification technology or similar technology to identify the
2222 student, transmit information regarding the student, or track the
2323 location of the student.
2424 SECTION 2. This Act applies beginning with the 2015-2016
2525 school year.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2015.
