5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to reducing paperwork and duplicate reports required of a
8	8	school district.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 7.060, Education Code, is amended by
11	11	adding Subsection (a-1) to read as follows:
12	12	(a-1) The review conducted under Subsection (a) must
13	13	include a comparison of the reports and paperwork required by state
14	14	law and the reports and paperwork required by federal law. The
15	15	commissioner shall eliminate any reports or paperwork required by
16	16	state law that duplicate the content of reports or paperwork also
17	17	required by federal law.
18	18	SECTION 2. Section 11.201(d), Education Code, is amended to
19	19	read as follows:
20	20	(d) The duties of the superintendent include:
21	21	(1) assuming administrative responsibility and
22	22	leadership for the planning, organization, operation, supervision,
23	23	and evaluation of the education programs, services, and facilities
24	24	of the district and for the annual performance appraisal of the
25	25	district's staff;
26	26	(2) except as provided by Section 11.202, assuming
27	27	administrative authority and responsibility for the assignment,
28	28	supervision, and evaluation of all personnel of the district other
29	29	than the superintendent;
30	30	(3) overseeing compliance with the standards for
31	31	school facilities established by the commissioner under Section
32	32	46.008;
33	33	(4) initiating the termination or suspension of an
34	34	employee or the nonrenewal of an employee's term contract;
35	35	(5) managing the day-to-day operations of the district
36	36	as its administrative manager, including implementing and
37	37	monitoring plans, procedures, programs, and systems to achieve
38	38	clearly defined and desired results in major areas of district
39	39	operations;
40	40	(6) preparing and submitting to the board of trustees
41	41	a proposed budget as provided by Section 44.002 and rules adopted
42	42	under that section, and administering the budget;
43	43	(7) preparing recommendations for policies to be
44	44	adopted by the board of trustees and overseeing the implementation
45	45	of adopted policies;
46	46	(8) developing or causing to be developed appropriate
47	47	administrative regulations to implement policies established by
48	48	the board of trustees;
49	49	(9) providing leadership for the attainment and, if
50	50	necessary, improvement of student performance in the district based
51	51	on the indicators adopted under Sections 39.053 and 39.301 and
52	52	other indicators adopted by the commissioner or the district's
53	53	board of trustees;
54	54	(10) organizing the district's central
55	55	administration;
56	56	(11) consulting with the district-level committee as
57	57	required under Section 11.252(f);
58	58	(12) ensuring:
59	59	(A) adoption of a student code of conduct as
60	60	required under Section 37.001 and enforcement of that code of
61	61	conduct; and
62	62	(B) adoption and enforcement of other student
63	63	disciplinary rules and procedures as necessary;
64	64	(13) submitting reports as required by state or
65	65	federal law, rule, or regulation, and ensuring that a copy of any
66	66	report required by federal law, rule, or regulation is also
67	67	delivered to the agency;
68	68	(14) providing joint leadership with the board of
69	69	trustees to ensure that the responsibilities of the board and
70	70	superintendent team are carried out; and
71	71	(15) performing any other duties assigned by action of
72	72	the board of trustees.
73	73	SECTION 3. This Act takes effect immediately if it receives
74	74	a vote of two-thirds of all the members elected to each house, as
75	75	provided by Section 39, Article III, Texas Constitution. If this
76	76	Act does not receive the vote necessary for immediate effect, this
77	77	Act takes effect September 1, 2015.
