55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reducing paperwork and duplicate reports required of a
88 school district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 7.060, Education Code, is amended by
1111 adding Subsection (a-1) to read as follows:
1212 (a-1) The review conducted under Subsection (a) must
1313 include a comparison of the reports and paperwork required by state
1414 law and the reports and paperwork required by federal law. The
1515 commissioner shall eliminate any reports or paperwork required by
1616 state law that duplicate the content of reports or paperwork also
1717 required by federal law.
1818 SECTION 2. Section 11.201(d), Education Code, is amended to
1919 read as follows:
2020 (d) The duties of the superintendent include:
2121 (1) assuming administrative responsibility and
2222 leadership for the planning, organization, operation, supervision,
2323 and evaluation of the education programs, services, and facilities
2424 of the district and for the annual performance appraisal of the
2525 district's staff;
2626 (2) except as provided by Section 11.202, assuming
2727 administrative authority and responsibility for the assignment,
2828 supervision, and evaluation of all personnel of the district other
2929 than the superintendent;
3030 (3) overseeing compliance with the standards for
3131 school facilities established by the commissioner under Section
3232 46.008;
3333 (4) initiating the termination or suspension of an
3434 employee or the nonrenewal of an employee's term contract;
3535 (5) managing the day-to-day operations of the district
3636 as its administrative manager, including implementing and
3737 monitoring plans, procedures, programs, and systems to achieve
3838 clearly defined and desired results in major areas of district
3939 operations;
4040 (6) preparing and submitting to the board of trustees
4141 a proposed budget as provided by Section 44.002 and rules adopted
4242 under that section, and administering the budget;
4343 (7) preparing recommendations for policies to be
4444 adopted by the board of trustees and overseeing the implementation
4545 of adopted policies;
4646 (8) developing or causing to be developed appropriate
4747 administrative regulations to implement policies established by
4848 the board of trustees;
4949 (9) providing leadership for the attainment and, if
5050 necessary, improvement of student performance in the district based
5151 on the indicators adopted under Sections 39.053 and 39.301 and
5252 other indicators adopted by the commissioner or the district's
5353 board of trustees;
5454 (10) organizing the district's central
5555 administration;
5656 (11) consulting with the district-level committee as
5757 required under Section 11.252(f);
5858 (12) ensuring:
5959 (A) adoption of a student code of conduct as
6060 required under Section 37.001 and enforcement of that code of
6161 conduct; and
6262 (B) adoption and enforcement of other student
6363 disciplinary rules and procedures as necessary;
6464 (13) submitting reports as required by state or
6565 federal law, rule, or regulation, and ensuring that a copy of any
6666 report required by federal law, rule, or regulation is also
6767 delivered to the agency;
6868 (14) providing joint leadership with the board of
6969 trustees to ensure that the responsibilities of the board and
7070 superintendent team are carried out; and
7171 (15) performing any other duties assigned by action of
7272 the board of trustees.
7373 SECTION 3. This Act takes effect immediately if it receives
7474 a vote of two-thirds of all the members elected to each house, as
7575 provided by Section 39, Article III, Texas Constitution. If this
7676 Act does not receive the vote necessary for immediate effect, this
7777 Act takes effect September 1, 2015.
