| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Section 436.1531(a), Government Code, is amended |
|---|
| 11 | 9 | | to read as follows: |
|---|
| 12 | 10 | | (a) The office may provide a loan of financial assistance to |
|---|
| 13 | 11 | | a defense community for an economic development project that |
|---|
| 14 | 12 | | minimizes the negative effects of a defense base reduction on the |
|---|
| 15 | 13 | | defense community as a result of a United States Department of |
|---|
| 16 | 14 | | Defense base realignment process that occurs during 1995 [2005] or |
|---|
| 17 | 15 | | later. The loan shall be made from the Texas military value |
|---|
| 18 | 16 | | revolving loan account established under Section 436.156. |
|---|
| 19 | 17 | | SECTION 2. Section 436.1532(a), Government Code, is amended |
|---|
| 20 | 18 | | to read as follows: |
|---|
| 21 | 19 | | (a) The office may provide a loan of financial assistance to |
|---|
| 22 | 20 | | a defense community for an infrastructure project to accommodate |
|---|
| 23 | 21 | | new or expanded military missions assigned to a military base or |
|---|
| 24 | 22 | | defense facility located in, near, or adjacent to the defense |
|---|
| 25 | 23 | | community as a result of a United States Department of Defense base |
|---|
| 26 | 24 | | realignment process that occurs during 1995 [2005] or later. The |
|---|
| 27 | 25 | | loan shall be made from the Texas military value revolving loan |
|---|
| 28 | 26 | | account established under Section 436.156. |
|---|
| 29 | 27 | | SECTION 3. Sections 436.202(a) and (b), Government Code, |
|---|
| 30 | 28 | | are amended to read as follows: |
|---|
| 31 | 29 | | (a) From money appropriated for this purpose, the |
|---|
| 32 | 30 | | commission may make a grant to an eligible local governmental |
|---|
| 33 | 31 | | entity to: |
|---|
| 34 | 32 | | (1) enable the entity to match money or meet an |
|---|
| 35 | 33 | | investment requirement necessary to receive federal assistance |
|---|
| 36 | 34 | | provided to the local governmental entity for responding to or |
|---|
| 37 | 35 | | recovering from an event described by Section 436.201(b); |
|---|
| 38 | 36 | | (2) match the entity's contribution for a purpose |
|---|
| 39 | 37 | | described by Section 436.203 at a closed or realigned defense |
|---|
| 40 | 38 | | facility; [or] |
|---|
| 41 | 39 | | (3) construct infrastructure and other projects |
|---|
| 42 | 40 | | necessary to accommodate a new or expanded military mission at a |
|---|
| 43 | 41 | | military base or to reduce the impact of an action of the United |
|---|
| 44 | 42 | | States Department of Defense that will negatively impact a defense |
|---|
| 45 | 43 | | facility located in or near the entity; or |
|---|
| 46 | 44 | | (4) construct infrastructure and other projects |
|---|
| 47 | 45 | | necessary to prevent the reduction or closing of a defense |
|---|
| 48 | 46 | | facility. |
|---|
| 49 | 47 | | (b) The commission may not make a grant for an amount less |
|---|
| 50 | 48 | | than $50,000 or an amount more than the lesser of: |
|---|
| 51 | 49 | | (1) 50 percent of the amount of matching money or |
|---|
| 52 | 50 | | investment that the local governmental entity is required to |
|---|
| 53 | 51 | | provide, subject to Subsection (c); |
|---|
| 54 | 52 | | (2) 50 percent of the local governmental entity's |
|---|
| 55 | 53 | | investment for purposes described by Section 436.203 if federal |
|---|
| 56 | 54 | | assistance is unavailable; or |
|---|
| 57 | 55 | | (3) $5 [$2] million. |
|---|
| 58 | 56 | | SECTION 4. Section 436.203(c), Government Code, is amended |
|---|
| 59 | 57 | | to read as follows: |
|---|
| 60 | 58 | | (c) An eligible local governmental entity described by |
|---|
| 61 | 59 | | Section 436.201(a)(3), [or] (4), or (5) may use the proceeds of the |
|---|
| 62 | 60 | | grant to purchase or lease equipment to train defense workers whose |
|---|
| 63 | 61 | | jobs have been threatened or lost because of an event described by |
|---|
| 64 | 62 | | Section 436.201(b) or to train workers to support military |
|---|
| 65 | 63 | | installations or defense facilities. |
|---|
| 66 | 64 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 67 | 65 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 68 | 66 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 69 | 67 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 70 | 68 | | Act takes effect September 1, 2015. |
|---|
