64 AN ACT
75 relating to financial assistance to local governmental entities
86 affected by the realignment of defense jobs or facilities.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 436.1531(a), Government Code, is amended
119 to read as follows:
1210 (a) The office may provide a loan of financial assistance to
1311 a defense community for an economic development project that
1412 minimizes the negative effects of a defense base reduction on the
1513 defense community as a result of a United States Department of
1614 Defense base realignment process that occurs during 1995 [2005] or
1715 later. The loan shall be made from the Texas military value
1816 revolving loan account established under Section 436.156.
1917 SECTION 2. Section 436.1532(a), Government Code, is amended
2018 to read as follows:
2119 (a) The office may provide a loan of financial assistance to
2220 a defense community for an infrastructure project to accommodate
2321 new or expanded military missions assigned to a military base or
2422 defense facility located in, near, or adjacent to the defense
2523 community as a result of a United States Department of Defense base
2624 realignment process that occurs during 1995 [2005] or later. The
2725 loan shall be made from the Texas military value revolving loan
2826 account established under Section 436.156.
2927 SECTION 3. Sections 436.202(a) and (b), Government Code,
3028 are amended to read as follows:
3129 (a) From money appropriated for this purpose, the
3230 commission may make a grant to an eligible local governmental
3331 entity to:
3432 (1) enable the entity to match money or meet an
3533 investment requirement necessary to receive federal assistance
3634 provided to the local governmental entity for responding to or
3735 recovering from an event described by Section 436.201(b);
3836 (2) match the entity's contribution for a purpose
3937 described by Section 436.203 at a closed or realigned defense
4038 facility; [or]
4139 (3) construct infrastructure and other projects
4240 necessary to accommodate a new or expanded military mission at a
4341 military base or to reduce the impact of an action of the United
4442 States Department of Defense that will negatively impact a defense
4543 facility located in or near the entity; or
4644 (4) construct infrastructure and other projects
4745 necessary to prevent the reduction or closing of a defense
4846 facility.
4947 (b) The commission may not make a grant for an amount less
5048 than $50,000 or an amount more than the lesser of:
5149 (1) 50 percent of the amount of matching money or
5250 investment that the local governmental entity is required to
5351 provide, subject to Subsection (c);
5452 (2) 50 percent of the local governmental entity's
5553 investment for purposes described by Section 436.203 if federal
5654 assistance is unavailable; or
5755 (3) $5 [$2] million.
5856 SECTION 4. Section 436.203(c), Government Code, is amended
5957 to read as follows:
6058 (c) An eligible local governmental entity described by
6159 Section 436.201(a)(3), [or] (4), or (5) may use the proceeds of the
6260 grant to purchase or lease equipment to train defense workers whose
6361 jobs have been threatened or lost because of an event described by
6462 Section 436.201(b) or to train workers to support military
6563 installations or defense facilities.
6664 SECTION 5. This Act takes effect immediately if it receives
6765 a vote of two-thirds of all the members elected to each house, as
6866 provided by Section 39, Article III, Texas Constitution. If this
6967 Act does not receive the vote necessary for immediate effect, this
7068 Act takes effect September 1, 2015.
