7 | 7 | | relating to the parking and movement of vehicles in the Capitol |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 411.063(a), Government Code, is amended |
---|
11 | 11 | | to read as follows: |
---|
12 | 12 | | (a) The department [State Preservation Board] shall adopt |
---|
13 | 13 | | rules for the safe movement and the parking of vehicles in the |
---|
14 | 14 | | Capitol Complex. [ The department shall administer and enforce the |
---|
15 | 15 | | rules adopted by the preservation board and shall administer and |
---|
16 | 16 | | enforce this subchapter. This subsection does not affect the |
---|
17 | 17 | | authority of the department to adopt rules under Section 411.067.] |
---|
18 | 18 | | SECTION 2. Section 411.065(a), Government Code, is amended |
---|
19 | 19 | | to read as follows: |
---|
20 | 20 | | (a) A person commits an offense if the person violates a |
---|
21 | 21 | | rule of the department adopted under Section 411.062 or [a rule of |
---|
22 | 22 | | the State Preservation Board adopted under] Section 411.063. |
---|
23 | 23 | | SECTION 3. On the effective date of this Act, rules of the |
---|
24 | 24 | | State Preservation Board adopted under Section 411.063, Government |
---|
25 | 25 | | Code, are transferred to the Department of Public Safety of the |
---|
26 | 26 | | State of Texas and are continued in effect until amended or repealed |
---|
27 | 27 | | by the Department of Public Safety. |
---|
28 | 28 | | SECTION 4. The change in law made by this Act to Section |
---|
29 | 29 | | 411.065, Government Code, applies only to an offense committed on |
---|
30 | 30 | | or after the effective date of this Act. An offense committed |
---|
31 | 31 | | before the effective date of this Act is governed by the law in |
---|
32 | 32 | | effect on the date the offense was committed, and the former law is |
---|
33 | 33 | | continued in effect for that purpose. For purposes of this section, |
---|
34 | 34 | | an offense was committed before the effective date of this Act if |
---|
35 | 35 | | any element of the offense occurred before that date. |
---|
36 | 36 | | SECTION 5. This Act takes effect immediately if it receives |
---|
37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
---|
38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
---|
40 | 40 | | Act takes effect September 1, 2015. |
---|
