55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the parking and movement of vehicles in the Capitol
88 Complex.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.063(a), Government Code, is amended
1111 to read as follows:
1212 (a) The department [State Preservation Board] shall adopt
1313 rules for the safe movement and the parking of vehicles in the
1414 Capitol Complex. [ The department shall administer and enforce the
1515 rules adopted by the preservation board and shall administer and
1616 enforce this subchapter. This subsection does not affect the
1717 authority of the department to adopt rules under Section 411.067.]
1818 SECTION 2. Section 411.065(a), Government Code, is amended
1919 to read as follows:
2020 (a) A person commits an offense if the person violates a
2121 rule of the department adopted under Section 411.062 or [a rule of
2222 the State Preservation Board adopted under] Section 411.063.
2323 SECTION 3. On the effective date of this Act, rules of the
2424 State Preservation Board adopted under Section 411.063, Government
2525 Code, are transferred to the Department of Public Safety of the
2626 State of Texas and are continued in effect until amended or repealed
2727 by the Department of Public Safety.
2828 SECTION 4. The change in law made by this Act to Section
2929 411.065, Government Code, applies only to an offense committed on
3030 or after the effective date of this Act. An offense committed
3131 before the effective date of this Act is governed by the law in
3232 effect on the date the offense was committed, and the former law is
3333 continued in effect for that purpose. For purposes of this section,
3434 an offense was committed before the effective date of this Act if
3535 any element of the offense occurred before that date.
3636 SECTION 5. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2015.
