66 AN ACT
77 relating to the authority of a psychologist to delegate certain
88 care to an intern.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 501.351(a), Occupations Code, is amended
1111 to read as follows:
1212 (a) A psychologist licensed under this chapter may delegate
1313 to a provisionally licensed psychologist, a newly licensed
1414 psychologist who is not eligible for managed care panels, a person
1515 who holds a temporary license issued under Section 501.263, a
1616 person enrolled in a formal internship as provided by board rules,
1717 and a person who satisfies Section 501.255(a) and is in the process
1818 of acquiring the supervised experience required by Section
1919 501.252(b)(2) any psychological test or service that a reasonable
2020 and prudent psychologist could delegate within the scope of sound
2121 psychological judgment if the psychologist determines that:
2222 (1) the test or service can be properly and safely
2323 performed by the person;
2424 (2) the person does not represent to the public that
2525 the person is authorized to practice psychology; and
2626 (3) the test or service will be performed in the
2727 customary manner and in compliance with any other law.
2828 SECTION 2. This Act takes effect September 1, 2015.
