9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 81.047, Health and Safety Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | Sec. 81.047. EPIDEMIOLOGICAL REPORTS. (a) Subject to the |
---|
13 | 13 | | confidentiality requirements of this chapter, the department shall |
---|
14 | 14 | | require epidemiological reports of disease outbreaks and of |
---|
15 | 15 | | individual cases of disease suspected or known to be of importance |
---|
16 | 16 | | to the public health, including vaccine preventable diseases. The |
---|
17 | 17 | | department shall evaluate the reports to determine the trends |
---|
18 | 18 | | involved and the nature and magnitude of the hazards. |
---|
19 | 19 | | (b) The department shall prepare and submit to the |
---|
20 | 20 | | legislature and the governor not later than December 1 of each |
---|
21 | 21 | | even-numbered year a biennial report that contains: |
---|
22 | 22 | | (1) a report of outbreaks of vaccine preventable |
---|
23 | 23 | | diseases in this state; and |
---|
24 | 24 | | (2) de-identified immunization exemption data, |
---|
25 | 25 | | including the number of persons claiming an exemption from the |
---|
26 | 26 | | immunization requirements of Section 161.004 of this code, Sections |
---|
27 | 27 | | 38.001, 51.9192, and 51.933, Education Code, and Section 42.043, |
---|
28 | 28 | | Human Resources Code. |
---|
29 | 29 | | SECTION 2. Section 38.002, Education Code, is amended by |
---|
30 | 30 | | amending Subsections (a) and (c) and adding Subsections (d) and (e) |
---|
31 | 31 | | to read as follows: |
---|
32 | 32 | | (a) Each public school shall keep an individual |
---|
33 | 33 | | immunization record during the period of attendance for each |
---|
34 | 34 | | student admitted. The records shall be open for inspection at all |
---|
35 | 35 | | reasonable times by the Texas Education Agency or by |
---|
36 | 36 | | representatives of local health departments or the [Texas] |
---|
37 | 37 | | Department of State Health Services. |
---|
38 | 38 | | (c) The Texas Education Agency and the [Texas] Department of |
---|
39 | 39 | | State Health Services shall develop the form for a required annual |
---|
40 | 40 | | report of the immunization status of students. The report shall be |
---|
41 | 41 | | submitted by all schools at the time and in the manner indicated in |
---|
42 | 42 | | the instructions printed on the form. |
---|
43 | 43 | | (d) Each school district shall provide the information |
---|
44 | 44 | | required by Subsection (c) for the district as a whole and for each |
---|
45 | 45 | | school campus in the district. |
---|
46 | 46 | | (e) The Department of State Health Services shall make |
---|
47 | 47 | | available to the public in electronic form, on the department's |
---|
48 | 48 | | Internet website, the required annual report of the immunization |
---|
49 | 49 | | status of students for each school district and for each school |
---|
50 | 50 | | campus, submitted under Subsection (c). |
---|
51 | 51 | | SECTION 3. Section 38.019(a), Education Code, is amended to |
---|
52 | 52 | | read as follows: |
---|
53 | 53 | | (a) A school district that maintains an Internet website |
---|
54 | 54 | | shall post prominently on the website: |
---|
55 | 55 | | (1) a list, in English and Spanish, of: |
---|
56 | 56 | | (A) the immunizations required for admission to |
---|
57 | 57 | | public school by rules of the Department of State Health Services |
---|
58 | 58 | | adopted under Section 38.001; |
---|
59 | 59 | | (B) any immunizations or vaccines recommended |
---|
60 | 60 | | for public school students by the Department of State Health |
---|
61 | 61 | | Services; [and] |
---|
62 | 62 | | (C) health clinics in the district that offer the |
---|
63 | 63 | | influenza vaccine, to the extent those clinics are known to the |
---|
64 | 64 | | district; and |
---|
65 | 65 | | (D) de-identified immunization exemption data, |
---|
66 | 66 | | including the number of persons claiming an exemption from the |
---|
67 | 67 | | immunization requirements of Section 38.001, for the district as a |
---|
68 | 68 | | whole and for each school campus in the district; and |
---|
69 | 69 | | (2) a link to the Department of State Health Services |
---|
70 | 70 | | Internet website where a person may obtain information relating to |
---|
71 | 71 | | the procedures for claiming an exemption from the immunization |
---|
72 | 72 | | requirements of Section 38.001. |
---|
73 | 73 | | SECTION 4. As soon as practicable after the effective date |
---|
74 | 74 | | of this Act, the Texas Education Agency shall update the form |
---|
75 | 75 | | required by Section 38.002(c), Education Code, as amended by this |
---|
76 | 76 | | Act, to comply with Section 38.002(d), Education Code, as added by |
---|
77 | 77 | | this Act. |
---|
78 | 78 | | SECTION 5. This Act applies beginning with the 2015-2016 |
---|
79 | 79 | | school year. |
---|
80 | 80 | | SECTION 6. This Act takes effect immediately if it receives |
---|
81 | 81 | | a vote of two-thirds of all the members elected to each house, as |
---|
82 | 82 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
83 | 83 | | Act does not receive the vote necessary for immediate effect, this |
---|
84 | 84 | | Act takes effect September 1, 2015. |
