5	5	AN ACT
6	6	relating to the creation of the Coates Ranch Municipal Utility
7	7	District No. 1; providing authority to issue bonds; providing
8	8	authority to impose assessments, fees, and taxes.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subtitle F, Title 6, Special District Local Laws
11	11	Code, is amended by adding Chapter 8373 to read as follows:
12	12	CHAPTER 8373. COATES RANCH MUNICIPAL UTILITY DISTRICT NO. 1
13	13	SUBCHAPTER A. GENERAL PROVISIONS
14	14	Sec. 8373.001. DEFINITIONS. In this chapter:
15	15	(1) "Board" means the district's board of directors.
16	16	(2) "Commission" means the Texas Commission on
17	17	Environmental Quality.
18	18	(3) "Director" means a board member.
19	19	(4) "District" means the Coates Ranch Municipal
20	20	Utility District No. 1.
21	21	Sec. 8373.002. NATURE OF DISTRICT. The district is a
22	22	municipal utility district created under Section 59, Article XVI,
23	23	Texas Constitution.
24	24	Sec. 8373.003. CONFIRMATION AND DIRECTORS' ELECTION
25	25	REQUIRED. The temporary directors shall hold an election to
26	26	confirm the creation of the district and to elect five permanent
27	27	directors as provided by Section 49.102, Water Code.
28	28	Sec. 8373.004. CONSENT OF MUNICIPALITY REQUIRED. The
29	29	temporary directors may not hold an election under Section 8373.003
30	30	until each municipality in whose corporate limits or
31	31	extraterritorial jurisdiction the district is located has
32	32	consented by ordinance or resolution to the creation of the
33	33	district and to the inclusion of land in the district.
34	34	Sec. 8373.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
35	35	(a) The district is created to serve a public purpose and benefit.
36	36	(b) The district is created to accomplish the purposes of:
37	37	(1) a municipal utility district as provided by
38	38	general law and Section 59, Article XVI, Texas Constitution; and
39	39	(2) Section 52, Article III, Texas Constitution, that
40	40	relate to the construction, acquisition, or improvement of
41	41	macadamized, graveled, or paved roads described by Section 54.234,
42	42	Water Code, or improvements, including storm drainage, in aid of
43	43	those roads.
44	44	Sec. 8373.006. INITIAL DISTRICT TERRITORY. (a) The
45	45	district is initially composed of the territory described by
46	46	Section 2 of the Act enacting this chapter.
47	47	(b) The boundaries and field notes contained in Section 2 of
48	48	the Act enacting this chapter form a closure. A mistake made in the
49	49	field notes or in copying the field notes in the legislative process
50	50	does not affect the district's:
51	51	(1) organization, existence, or validity;
52	52	(2) right to issue any type of bond for the purposes
53	53	for which the district is created or to pay the principal of and
54	54	interest on a bond;
55	55	(3) right to impose a tax; or
56	56	(4) legality or operation.
57	57	SUBCHAPTER B. BOARD OF DIRECTORS
58	58	Sec. 8373.051. GOVERNING BODY; TERMS. (a) The district is
59	59	governed by a board of five elected directors.
60	60	(b) Except as provided by Section 8373.052, directors serve
61	61	staggered four-year terms.
62	62	Sec. 8373.052. TEMPORARY DIRECTORS. (a) The temporary
63	63	board consists of:
64	64	(1) Hugh Coates;
65	65	(2) Dennette Coates; and
66	66	(3) Greg Leach.
67	67	(b) On or after the effective date of the Act enacting this
68	68	chapter, the owner or owners of a majority of the assessed value of
69	69	the real property in the district may submit a petition to the
70	70	commission requesting that the commission appoint as temporary
71	71	directors the three persons named in the petition. The commission
72	72	shall appoint as temporary directors the three persons named in the
73	73	petition.
74	74	(c) Temporary directors serve until the earlier of:
75	75	(1) the date permanent directors are elected under
76	76	Section 8373.003; or
77	77	(2) the fourth anniversary of the effective date of
78	78	the Act enacting this chapter.
79	79	(d) If permanent directors have not been elected under
80	80	Section 8373.003 and the terms of the temporary directors have
81	81	expired, successor temporary directors shall be appointed or
82	82	reappointed as provided by Subsection (e) to serve terms that
83	83	expire on the earlier of:
84	84	(1) the date permanent directors are elected under
85	85	Section 8373.003; or
86	86	(2) the fourth anniversary of the date of the
87	87	appointment or reappointment.
88	88	(e) If Subsection (d) applies, the owner or owners of a
89	89	majority of the assessed value of the real property in the district
90	90	may submit a petition to the commission requesting that the
91	91	commission appoint as successor temporary directors the persons
92	92	named in the petition. The commission shall appoint as successor
93	93	temporary directors the persons named in the petition.
94	94	SUBCHAPTER C. POWERS AND DUTIES
95	95	Sec. 8373.101. GENERAL POWERS AND DUTIES. The district has
96	96	the powers and duties necessary to accomplish the purposes for
97	97	which the district is created.
98	98	Sec. 8373.102. MUNICIPAL UTILITY DISTRICT POWERS AND
99	99	DUTIES. The district has the powers and duties provided by the
100	100	general law of this state, including Chapters 49 and 54, Water Code,
101	101	applicable to municipal utility districts created under Section 59,
102	102	Article XVI, Texas Constitution.
103	103	Sec. 8373.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
104	104	Section 52, Article III, Texas Constitution, the district may
105	105	design, acquire, construct, finance, issue bonds for, improve, and
106	106	convey to this state, a county, or a municipality for operation and
107	107	maintenance macadamized, graveled, or paved roads described by
108	108	Section 54.234, Water Code, or improvements, including storm
109	109	drainage, in aid of those roads.
110	110	(b) The district may exercise the powers provided by this
111	111	section without submitting a petition to or obtaining approval from
112	112	the commission as required by Section 54.234, Water Code.
113	113	Sec. 8373.104. APPROVAL OF ROAD PROJECT. (a) The district
114	114	may not undertake a road project authorized by Section 8373.103
115	115	unless:
116	116	(1) each municipality or county that will operate and
117	117	maintain the road has approved the plans and specifications of the
118	118	road project, if a municipality or county will operate and maintain
119	119	the road; or
120	120	(2) the Texas Transportation Commission has approved
121	121	the plans and specifications of the road project, if the state will
122	122	operate and maintain the road.
123	123	(b) Except as provided by Subsection (a), the district is
124	124	not required to obtain approval from the Texas Transportation
125	125	Commission to design, acquire, construct, finance, issue bonds for,
126	126	improve, or convey a road project.
127	127	Sec. 8373.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
128	128	OR RESOLUTION. The district shall comply with all applicable
129	129	requirements of any ordinance or resolution that is adopted under
130	130	Section 54.016 or 54.0165, Water Code, and that consents to the
131	131	creation of the district or to the inclusion of land in the
132	132	district.
133	133	Sec. 8373.106. NO EMINENT DOMAIN POWER. The district may
134	134	not exercise the power of eminent domain.
135	135	SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
136	136	Sec. 8373.151. ELECTIONS REGARDING TAXES OR BONDS.
137	137	(a) The district may issue, without an election, bonds and other
138	138	obligations secured by:
139	139	(1) revenue other than ad valorem taxes; or
140	140	(2) contract payments described by Section 8373.153.
141	141	(b) The district must hold an election in the manner
142	142	provided by Chapters 49 and 54, Water Code, to obtain voter approval
143	143	before the district may impose an ad valorem tax or issue bonds
144	144	payable from ad valorem taxes.
145	145	(c) The district may not issue bonds payable from ad valorem
146	146	taxes to finance a road project unless the issuance is approved by a
147	147	vote of a two-thirds majority of the district voters voting at an
148	148	election held for that purpose.
149	149	Sec. 8373.152. OPERATION AND MAINTENANCE TAX. (a) If
150	150	authorized at an election held under Section 8373.151, the district
151	151	may impose an operation and maintenance tax on taxable property in
152	152	the district in accordance with Section 49.107, Water Code.
153	153	(b) The board shall determine the tax rate. The rate may not
154	154	exceed the rate approved at the election.
155	155	Sec. 8373.153. CONTRACT TAXES. (a) In accordance with
156	156	Section 49.108, Water Code, the district may impose a tax other than
157	157	an operation and maintenance tax and use the revenue derived from
158	158	the tax to make payments under a contract after the provisions of
159	159	the contract have been approved by a majority of the district voters
160	160	voting at an election held for that purpose.
161	161	(b) A contract approved by the district voters may contain a
162	162	provision stating that the contract may be modified or amended by
163	163	the board without further voter approval.
164	164	SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
165	165	Sec. 8373.201. AUTHORITY TO ISSUE BONDS AND OTHER
166	166	OBLIGATIONS. The district may issue bonds or other obligations
167	167	payable wholly or partly from ad valorem taxes, impact fees,
168	168	revenue, contract payments, grants, or other district money, or any
169	169	combination of those sources, to pay for any authorized district
170	170	purpose.
171	171	Sec. 8373.202. TAXES FOR BONDS. At the time the district
172	172	issues bonds payable wholly or partly from ad valorem taxes, the
173	173	board shall provide for the annual imposition of a continuing
174	174	direct ad valorem tax, without limit as to rate or amount, while all
175	175	or part of the bonds are outstanding as required and in the manner
176	176	provided by Sections 54.601 and 54.602, Water Code.
177	177	Sec. 8373.203. BONDS FOR ROAD PROJECTS. At the time of
178	178	issuance, the total principal amount of bonds or other obligations
179	179	issued or incurred to finance road projects and payable from ad
180	180	valorem taxes may not exceed one-fourth of the assessed value of the
181	181	real property in the district.
182	182	SECTION 2. The Coates Ranch Municipal Utility District No.
183	183	1 initially includes all the territory contained in the following
184	184	area:
185	185	Tract I:
186	186	Said 921.8551 acres of land lying and being situated in
187	187	Kinney County, Texas; about seven miles N 21° W of the City of
188	188	Brackettville, the County Seat; containing acreages in the various

412	412	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
413	413	Government Code.
414	414	(b) The governor, one of the required recipients, has
415	415	submitted the notice and Act to the Texas Commission on
416	416	Environmental Quality.
417	417	(c) The Texas Commission on Environmental Quality has filed
418	418	its recommendations relating to this Act with the governor, the
419	419	lieutenant governor, and the speaker of the house of
420	420	representatives within the required time.
421	421	(d) All requirements of the constitution and laws of this
422	422	state and the rules and procedures of the legislature with respect
423	423	to the notice, introduction, and passage of this Act are fulfilled
424	424	and accomplished.
425	425	SECTION 4. This Act takes effect immediately if it receives
426	426	a vote of two-thirds of all the members elected to each house, as
427	427	provided by Section 39, Article III, Texas Constitution. If this
428	428	Act does not receive the vote necessary for immediate effect, this
429	429	Act takes effect September 1, 2015.
