55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to zero-based budgeting for state agencies as part of the
88 sunset review process.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 325.007, Government Code,
1111 is amended to read as follows:
1212 Sec. 325.007. AGENCY REPORT TO COMMISSION; ZERO-BASED
1313 BUDGET.
1414 SECTION 2. Section 325.007, Government Code, is amended by
1515 adding Subsections (c) and (d) to read as follows:
1616 (c) Before November 1 of the odd-numbered year before the
1717 year in which a state agency subject to this chapter is abolished,
1818 the agency shall present to the commission a zero-based budget for
1919 the state fiscal biennium that begins on the date the agency is
2020 scheduled to be abolished that contains:
2121 (1) a description of the discrete activities the
2222 agency is charged with conducting or performing, together with a
2323 justification for each activity by reference to a statute or other
2424 legal authority;
2525 (2) for each activity identified under Subdivision
2626 (1), a quantitative estimate of any adverse effects that reasonably
2727 may be expected to result if the activity were discontinued,
2828 together with a description of the methods by which the adverse
2929 effects were estimated;
3030 (3) for each activity identified under Subdivision
3131 (1), an itemized account of expenditures required to maintain the
3232 activity at the minimum level of service required by the statute or
3333 other legal authority, together with a concise statement of the
3434 quantity and quality of service required at that minimum level;
3535 (4) for each activity identified under Subdivision
3636 (1), an itemized account of expenditures required to maintain the
3737 activity at the current level of service, together with a concise
3838 statement of the quantity and quality of service provided at that
3939 level; and
4040 (5) a ranking of activities identified under
4141 Subdivision (1) that illustrates the relative importance of each
4242 activity to the overall goals and purposes of the agency at current
4343 service levels.
4444 (d) As part of a state agency's legislative appropriations
4545 request for the state fiscal biennium that begins on the date the
4646 agency is scheduled to be abolished, the agency shall submit to the
4747 Legislative Budget Board:
4848 (1) the zero-based budget required under Subsection
4949 (c); and
5050 (2) a statement of the estimated amount of any unspent
5151 and unencumbered money appropriated to the agency for the state
5252 fiscal biennium preceding that fiscal biennium.
5353 SECTION 3. The changes in law made by this Act apply in
5454 relation to the review by the Sunset Advisory Commission of
5555 agencies scheduled to be abolished on or after September 1, 2019, if
5656 not continued in accordance with Chapter 325, Government Code, and
5757 in relation to any other agencies that by law are reviewed during
5858 those review periods by the Sunset Advisory Commission.
5959 SECTION 4. This Act takes effect September 1, 2015.
