6	6	AN ACT
7	7	relating to zero-based budgeting for state agencies as part of the
8	8	sunset review process.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. The heading to Section 325.007, Government Code,
11	11	is amended to read as follows:
12	12	Sec. 325.007. AGENCY REPORT TO COMMISSION; ZERO-BASED
13	13	BUDGET.
14	14	SECTION 2. Section 325.007, Government Code, is amended by
15	15	adding Subsections (c) and (d) to read as follows:
16	16	(c) Before November 1 of the odd-numbered year before the
17	17	year in which a state agency subject to this chapter is abolished,
18	18	the agency shall present to the commission a zero-based budget for
19	19	the state fiscal biennium that begins on the date the agency is
20	20	scheduled to be abolished that contains:
21	21	(1) a description of the discrete activities the
22	22	agency is charged with conducting or performing, together with a
23	23	justification for each activity by reference to a statute or other
24	24	legal authority;
25	25	(2) for each activity identified under Subdivision
26	26	(1), a quantitative estimate of any adverse effects that reasonably
27	27	may be expected to result if the activity were discontinued,
28	28	together with a description of the methods by which the adverse
29	29	effects were estimated;
30	30	(3) for each activity identified under Subdivision
31	31	(1), an itemized account of expenditures required to maintain the
32	32	activity at the minimum level of service required by the statute or
33	33	other legal authority, together with a concise statement of the
34	34	quantity and quality of service required at that minimum level;
35	35	(4) for each activity identified under Subdivision
36	36	(1), an itemized account of expenditures required to maintain the
37	37	activity at the current level of service, together with a concise
38	38	statement of the quantity and quality of service provided at that
39	39	level; and
40	40	(5) a ranking of activities identified under
41	41	Subdivision (1) that illustrates the relative importance of each
42	42	activity to the overall goals and purposes of the agency at current
43	43	service levels.
44	44	(d) As part of a state agency's legislative appropriations
45	45	request for the state fiscal biennium that begins on the date the
46	46	agency is scheduled to be abolished, the agency shall submit to the
47	47	Legislative Budget Board:
48	48	(1) the zero-based budget required under Subsection
49	49	(c); and
50	50	(2) a statement of the estimated amount of any unspent
51	51	and unencumbered money appropriated to the agency for the state
52	52	fiscal biennium preceding that fiscal biennium.
53	53	SECTION 3. The changes in law made by this Act apply in
54	54	relation to the review by the Sunset Advisory Commission of
55	55	agencies scheduled to be abolished on or after September 1, 2019, if
56	56	not continued in accordance with Chapter 325, Government Code, and
57	57	in relation to any other agencies that by law are reviewed during
58	58	those review periods by the Sunset Advisory Commission.
59	59	SECTION 4. This Act takes effect September 1, 2015.
