77 relating to the resident physician expansion grant program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 61.511(a), (c), (d), (e), (f), and (j),
1010 Education Code, are amended to read as follows:
1111 (a) The board shall administer the Resident Physician
1212 Expansion Grant Program [as a competitive grant program] to
1313 encourage the creation of new graduate medical education positions
1414 through community collaboration and innovative funding. The board
1515 shall award grants to new or existing physician residency programs
1616 at teaching hospitals and other appropriate health care entities
1717 according to the program criteria established under Subsections (b)
1818 and (i).
1919 (c) The board may provide grants only to support a residency
2020 position that:
2121 (1) is created and accredited on or after July
2222 [January] 1, 2016 [2014]; or
2323 (2) was created and accredited before July [January]
2424 1, 2015 [2013], but as of that date had not yet been filled.
2525 (d) A grant award may be used only to pay direct costs
2626 associated with the position, including the creation and
2727 maintenance of the position and the salary of the resident
2828 physician.
2929 (e) Each grant application must specify:
3030 (1) the number of residency positions expected to be
3131 created or maintained with the grant money; and
3232 (2) the grant amount requested for each year.
3333 (f) The board by rule shall ensure that [award] grants are
3434 awarded for each [all] residency position for which a grant was
3535 [positions] awarded [a grant under this section] in the preceding
3636 year [before awarding a grant for a residency position that did not
3737 receive a grant in the preceding year], until the resident in that
3838 position in the preceding year has completed the requirements of
3939 the position and provided that the applicable grant recipient from
4040 the preceding year complies with all conditions of the grant as
4141 described by Subsection (g).
4242 (j) Not later than March [January] 1 of each even-numbered
4343 year, the board shall prepare and submit to the governor, the
4444 lieutenant governor, the speaker of the house of representatives,
4545 the standing committees of the senate and house of representatives
4646 with responsibility for oversight of health and human services
4747 issues, and the Legislative Budget Board a report that:
4848 (1) specifies each of the following with respect to
4949 the preceding program year:
5050 (A) the number of grants awarded under the
5151 program;
5252 (B) the amount of each grant awarded under the
5353 program;
5454 (C) the number of residency positions created
5555 with the support of grant money;
5656 (D) the medical specialty of the residency
5757 positions created; and
5858 (E) whether physicians who complete their
5959 training through residency positions created under the program
6060 choose to practice in this state and which medical specialties they
6161 choose for their practices; and
6262 (2) makes appropriate recommendations for legislative
6363 changes as necessary.
6464 SECTION 2. This Act takes effect September 1, 2015.
