55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the driver responsibility program and the collection of
88 delinquent driver responsibility program surcharges.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 466.407(a), Government Code, is amended
1111 to read as follows:
1212 (a) The executive director shall deduct the amount of a
1313 delinquent tax or other money from the winnings of a prize winner
1414 who has been finally determined to be:
1515 (1) delinquent in the payment of a tax or other money
1616 to a state agency and that delinquency is reported to the
1717 comptroller under Section 403.055;
1818 (2) in default on a loan made under Chapter 52,
1919 Education Code; [or]
2020 (3) in default on a loan guaranteed under Chapter 57,
2121 Education Code; or
2222 (4) delinquent in the payment of a surcharge assessed
2323 under Chapter 708, Transportation Code.
2424 SECTION 2. Section 74.501, Property Code, is amended by
2525 amending Subsection (e) and adding Subsection (g) to read as
2626 follows:
2727 (e) Except as provided by Subsections [Subsection] (f) and
2828 (g), the comptroller may not pay to the following persons a claim to
2929 which this section applies:
3030 (1) a creditor, a judgment creditor, a lienholder, or
3131 an assignee of the reported owner or of the owner's heirs; or
3232 (2) a person holding a power of attorney from the
3333 reported owner or the owner's heirs.
3434 (g) The comptroller may approve a claim for a surcharge owed
3535 by the reported owner of the property under Chapter 708,
3636 Transportation Code. A claim under this subsection may be submitted
3737 by the Department of Public Safety.
3838 SECTION 3. This Act takes effect September 1, 2015.
