66 AN ACT
77 relating to the production of the index of the parties to all suits
88 by the clerk of a district court; authorizing a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 51.303, Government Code, is amended by
1111 adding Subsection (d) to read as follows:
1212 (d) On application by any person, the clerk of a district
1313 court shall promptly produce the index of the parties to all suits,
1414 or a portion of the index, not otherwise confidential by law for
1515 inspection or copying. If the index is in an electronic form, the
1616 clerk shall provide an electronic copy of the index or the portion
1717 of the index for a fee set in accordance with the rules prescribed
1818 by the attorney general that are applicable to the provision of
1919 electronic copies of public information.
2020 SECTION 2. Subchapter D, Chapter 101, Government Code, is
2121 amended by adding Section 101.06111 to read as follows:
2222 Sec. 101.06111. ADDITIONAL DISTRICT COURT FEES: GOVERNMENT
2323 CODE. The clerk of a district court shall collect a fee for
2424 providing an electronic copy of the index of the parties to all
2525 suits, or a portion of the index, not otherwise confidential by law
2626 under Section 51.303, Government Code, in an amount set in
2727 accordance with the rules prescribed by the attorney general that
2828 are applicable to the provision of electronic copies of public
2929 information.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2015.
