| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. The heading to Subchapter F, Chapter 203, |
|---|
| 11 | 9 | | Transportation Code, is amended to read as follows: |
|---|
| 12 | 10 | | SUBCHAPTER F. USE [LEASE] OF CERTAIN PROPERTY |
|---|
| 13 | 11 | | SECTION 2. Subchapter F, Chapter 203, Transportation Code, |
|---|
| 14 | 12 | | is amended by adding Section 203.112 to read as follows: |
|---|
| 15 | 13 | | Sec. 203.112. PROHIBITION OR RESTRICTION OF FIREWORKS AT |
|---|
| 16 | 14 | | REST AREA. (a) In this section, "rest area" means public real |
|---|
| 17 | 15 | | property designated as a rest area, comfort station, picnic area, |
|---|
| 18 | 16 | | roadside park, or scenic overlook by the department. |
|---|
| 19 | 17 | | (b) The commission by order shall prohibit or restrict the |
|---|
| 20 | 18 | | use of fireworks at a state highway rest area in the unincorporated |
|---|
| 21 | 19 | | area of a county if: |
|---|
| 22 | 20 | | (1) the commissioners court of the county petitions |
|---|
| 23 | 21 | | the commission to adopt the order; and |
|---|
| 24 | 22 | | (2) the county pays the department for the costs of |
|---|
| 25 | 23 | | designing, constructing, and erecting signs at the rest area giving |
|---|
| 26 | 24 | | notice of the order. |
|---|
| 27 | 25 | | (c) After an order is adopted under Subsection (b), the |
|---|
| 28 | 26 | | department shall erect signs at the rest area giving notice of the |
|---|
| 29 | 27 | | order. If a sign is damaged or destroyed, the department shall |
|---|
| 30 | 28 | | replace the sign if the county: |
|---|
| 31 | 29 | | (1) submits to the department a written request for |
|---|
| 32 | 30 | | replacement; and |
|---|
| 33 | 31 | | (2) pays the department for the costs of constructing |
|---|
| 34 | 32 | | and replacing the sign. |
|---|
| 35 | 33 | | (d) A person who knowingly or intentionally violates a |
|---|
| 36 | 34 | | prohibition or restriction established by an order adopted under |
|---|
| 37 | 35 | | this section commits an offense. An offense under this subsection |
|---|
| 38 | 36 | | is a Class C misdemeanor. |

| 39 | 37 | | SECTION 3. This Act takes effect September 1, 2015. |
