| 10 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 7 | | SECTION 1. Section 438.046, Health and Safety Code, is |
|---|
| 12 | 8 | | amended by adding Subsection (b-1) to read as follows: |
|---|
| 13 | 9 | | (b-1) A food service worker trained in a food handler |
|---|
| 14 | 10 | | training course accredited by the American National Standards |
|---|
| 15 | 11 | | Institute is considered to have met a local health jurisdiction's |
|---|
| 16 | 12 | | training, testing, and permitting requirements. A local health |
|---|
| 17 | 13 | | jurisdiction may require a food establishment, as that term is |
|---|
| 18 | 14 | | defined by Section 438.101, to maintain on the premises of the food |
|---|
| 19 | 15 | | establishment a certificate of completion of the training course |
|---|
| 20 | 16 | | for employees of the food establishment. |
|---|
| 21 | 17 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 22 | 18 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 19 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 20 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 21 | | Act takes effect September 1, 2015. |
