95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to the content of detailed reports filed by registered
128 lobbyists.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Sections 305.0061(a), (b), and (c), Government
1511 Code, are amended to read as follows:
1612 (a) If a registrant or a person on the registrant's behalf
1713 and with the registrant's consent or ratification makes
1814 expenditures that exceed $50 [60 percent of the amount of the
1915 legislative per diem in] a day for transportation or lodging for a
2016 member of the legislative or executive branch or for the immediate
2117 family of a member of the legislative or executive branch, the
2218 registrant shall also state the following on the report filed under
2319 Section 305.006:
2420 (1) the name of the member of the legislative or
2521 executive branch in whose behalf the expenditure is made;
2622 (2) the place and date of the transportation or
2723 lodging; and
2824 (3) the purpose of the transportation or lodging.
2925 (b) If a registrant or a person on the registrant's behalf
3026 and with the registrant's consent or ratification makes
3127 expenditures that exceed $50 [60 percent of the amount of the
3228 legislative per diem in] a day for food and beverages for a member
3329 of the legislative or executive branch or for the immediate family
3430 of a member of the legislative or executive branch or makes
3531 expenditures that exceed $50 [60 percent of the amount of the
3632 legislative per diem in] a day for entertainment for a member of the
3733 legislative or executive branch or for the immediate family of a
3834 member of the legislative or executive branch, the registrant shall
3935 also state the following on the report filed under Section 305.006:
4036 (1) the name of the member of the legislative or
4137 executive branch in whose behalf the expenditure is made;
4238 (2) the place and date of the expenditure; and
4339 (3) the amount of the expenditure by the appropriate
4440 category of the amount, as determined by the commission.
4541 (c) If a registrant or a person on the registrant's behalf
4642 and with the registrant's consent or ratification gives to a member
4743 of the legislative or executive branch, or to the immediate family
4844 of a member of the legislative or executive branch, a gift or an
4945 award or memento, the value of which exceeds $50 per gift, award, or
5046 memento, the registrant shall also state the following on the
5147 report filed under Section 305.006:
5248 (1) the name of the member of the legislative or
5349 executive branch in whose behalf the expenditure is made;
5450 (2) a general description of the gift, award, or
5551 memento; and
5652 (3) the amount of the expenditure by the appropriate
5753 category of the amount, as determined by the commission.
5854 SECTION 2. Section 305.0061(g), Government Code, is
5955 repealed.
6056 SECTION 3. The changes in law made by this Act apply only to
6157 a gift, award, or memento given to or expenditures for
6258 transportation, lodging, food, beverages, or entertainment made
6359 for a member of the legislative or executive branch or the immediate
6460 family of a member of the legislative or executive branch on or
6561 after the effective date of this Act. A gift, award, or memento
6662 given to or an expenditure for transportation, lodging, food,
6763 beverages, or entertainment made for a member of the legislative or
6864 executive branch or the immediate family of a member of the
6965 legislative or executive branch before the effective date of this
7066 Act is governed by the law in effect on the date the gift, award, or
7167 memento was given, or the date the expenditure for transportation,
7268 lodging, food, beverages, or entertainment was made, and the former
7369 law is continued in effect for that purpose.
7470 SECTION 4. This Act takes effect September 1, 2015.
